About this file

This is a Sole Source Justification and Approval document for a simplified acquisition by the Department of the Interior, Wildland Fire Service, Rocky Mountain Geographic Area.

The procurement requests payment of prescribed fire permit fees to the Colorado Department of Health and Environment, as mandated by the Clean Air Act (42 USC Section 7418(a)) and Colorado Air Quality Control Commission Regulation Number 9 Open Burning, Prescribed Fire, and Permitting (5CCR 100-11). The service is for prescribed fire smoke permit fee services covering one base year plus four option years, with a total estimated cost of $28,200.91. The fees cover permits issued, denied, suspended, withdrawn, or revoked, regardless of whether actual burning activity occurred. This procurement is classified as a sole source acquisition under 41 U.S.C. 1901 (Simplified Acquisition Procedures) because federal agencies must comply with Colorado state regulations governing air pollutant discharge, and only the State of Colorado can provide this statutorily required service. No competition is available or permitted. The Contracting Officer, Scott Voigt, certified the justification as accurate and complete on June 8, 2026.
