About this file

This document contains a justification for a sole source contract award and a related special notice of intent. The justification provides details on a requirement by the National Park Service Midwest Region for boat slip rental, acid wash, installation and removal of buoys, and storage services from Wolf Marine. The vendor must be located within 5 miles of the federal zone and north of the Zebra Mussel closure zone to support patrol operations. Market research found Wolf Marine to be the only company that meets the location and capability requirements. The special notice announces the intent to award a firm fixed price contract to Wolf Marine for these services, identifies the NAICS code as 713930, and invites capability statements from other sources by a specified date, though no competitive quotes are requested as only one source is deemed reasonably available.

SOLICITING FROM A SINGLE SOURCE (FAR 13.106-1(b))

COTI 1443.06-01 Contracting by Other than Full and Open Competition

Date: 12/1/2023 Purchase Request No:

Authority cited: Open Market - FAR 6.302-1, Only One Responsible Source

I. Park & Contracting Office Information: National Park Service, Midwest Region, Midwest Regional Office Major Acquisition Buying Office (MWRO MABO)

II. Nature and/or description of the park’s need being approved: This is a request the use of other than full and open competition procedures to purchase the following:

SACN Slip Rental and acid wash for boat and Install, removal and storage of 6-8 buoys - Sole Source

III. Description of the supplies or services required to meet the park’s needs:

SACN's Resource Protection Division requires a boat slip to maintain an 22' boat for visitor services operations in the Stillwater Islands this season. The vessel is used for routine, daily water safety, resource protection patrols and visitor contacts (e.g., fishing license inspections). The vendor needs to be located within 5 miles of the federal zone of the park, as well as south of the Zebra Mussel closure zone, which is part of the patrol area of this boat. The vendor needs to have the equipment cable of installing and removing 6-8 buoys from the river for a closure, washing them, and sufficient room to store them over winter.

IV. A demonstration that the proposed contractor’s unique qualifications (sole source), unique product features (brand name), or the nature of the acquisition requires use of the authority cited:

(2) Only one source is capable of responding due to the unique or specialized nature of the work.

Only one company exists both within the park and north of the Stillwater Bridge that can provide slip use as well as winterization options. The location of Wolf Marine in regard to headquarters and the law enforcement offices reduces travel time to facilities south of the Stillwater Bridge, and on-water time commuting to incidents north of the Stillwater Bridge. Additionally, it reduces the likelihood of the spread of zebra mussel, for which the NPS has an obligation to manage in the general area.

V. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was, or will be publicized as required by FAR Subpart 5.2, and if not, which exemption under Far 5.202 applies (not applicable for GSA):

http://wcp.den.nps.gov/Policy-General/COTI%201443.06-01%20Contracting%20by%20Other%20than%20Full%20and%20Open%20Competition,%20Rev%202,%20Feb%202012.pdf

Not publicized because this requirement is not expected to meet the threshold in FAR 5.101(a)(1). Park considered past awards for this same service and Contract Specialist performed market research using the Dynamic Small Business Search tool from www.sba.gov searching for the vendors with the appropriate NAICS code in Wisconsin and Minnesota.

VI. A description of the market research conducted and the results or a statement of the reason market research was not conducted:

In 2016, a Contract Specialist performed additional market research and did not find any other businesses that had an active SAM registration and could provide the service to fulfill the requirement. Contract Specialist used the SBA DSBS tool searching NAICS 713930 Marinas in Wisconsin and Minnesota. Results show that there are only three Marinas registered as a small business with NAICS 713930. Two of the three would require too much time to be useful to the Park and at an increased fuel price to cover the distance. The distance would not support necessary law enforcement and/or safety response times.

VII. Any other facts supporting the justification.

Wolf Marine was the only marina found in the area of the Park which can provide the necessary service. Wolf Marine has had other contracts with the National Park Service and has positive performance on them.

VIII. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition (not applicable for GSA):

N/A

IX. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before subsequent acquisitions for the supplies/services required:

Market research will be performed to assess the current market conditions at that time.

Technical personnel certification of accuracy: The supporting data that forms the basis of this justification has been certified to be complete and accurate, to the best of their knowledge and belief, by the technical/requirements organization.

Contracting Officer’s Certification: The Contracting Officer certifies that the contents of this justification are accurate and complete to the best of their knowledge and belief. Additionally, the Contracting Officer will determine that the anticipated cost to the Government is fair and reasonable prior to award.
