About this file

This document is a Notice of Intent to Sole Source and a redacted Sole Source Document for the Panther Prolifics Licensing and Maintenance requirement under Solicitation #140D0424Q0520.

The key details are:

  • The requirement is for Panther Prolifics software licenses and maintenance, which have historically been purchased via sole source from Prolifics, the manufacturer and sole distributor, as there are no other authorized resellers available.
  • Market research confirmed Prolifics is the sole source for the Panther software, which is not available through mandatory sources like AbilityOne or NASA SEWP.
  • The Contracting Officer determined the anticipated pricing is fair and reasonable based on comparison to historical pricing for the same licenses.
  • There was no interest expressed by any other sources besides Prolifics for this requirement.
  • Changing software would require extensive end user training and impact the government's ability to perform its mission.

Solicitation #: 140D0424Q0520 resellers. In addition, prior acquisition history was researched, which confirmed that Prolifics has been the sole provider for the requirement for several years.

Panther is not available through the mandatory sources specified in FAR Parts 8.002 and 8.003.

A search of AbilityOne returned no results. A search of NASA SEWP returned no results.

7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.

The Contracting Officer shall determine the price is fair and reasonable based on 15.404- 1(b)(2)(ii), comparing of the proposed prices to historical prices paid of the same or similar items, adjusting for differing economic factors. This rationale was used in award 140D0423P0210. FY 22 award for the same licenses cited 140D0422P0177 This price analysis was completed using the guidelines established in FAR 15.404-1(b)(2)(ii), comparing of the proposed prices to historical prices paid of the same or similar items, adjusting for differing economic factors.

8. A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted.

The Government performed market research by contacting Prolifics, the manufacturer and owner of the desired Panther software. Prolifics confirmed that they are the only source which distributes Panther, and there are no authorized resellers. In addition, prior acquisition history was researched, which confirmed that Prolifics has been the sole provider for the requirement for several years. The Government also reviewed acquisition strategies for prior awards 140D0422P0177 and 140D0423P0210 which show these licenses have historically been purchased via sole source requirements with no socio-economic set-asides.

Panther Prolifics is not available through the mandatory sources specified in FAR Parts 8.002 and 8.003. A search of AbilityOne returned no results. A search of NASA SEWP returned no results.

9. Any other facts supporting the use of other than full and open competition, such as:

Only Panther Prolifics is able to meet BLM’s desired need. Changing software would necessitate multiple end users needing training and man hours to learn new software and would hamper the Government’s ability to perform their mission. There are no authorized sellers for these licenses and no GWAC’s offer said licenses.

10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition.

No sources other than Prolifics have expressed interest in this requirement.
