LIMITED SOURCESJUSTIFICATION

Over $150,000 (FAR 8.4056(c))

1. Identification of the agency and the contracting activity.

National Park Service, Denver Service Center, Contracting Division

2. Nature and/or description of the action being approved.

New task order for additional construction management services for the Shoring and Stabilization of Building 64 project on Alcatraz Island.

3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).

The primary role of the construction management representative (CMR) is to inspect the work of the construction contractor for progress, workmanship, and conformance with the contract documents and existing codes. The CMR shall promptly notify the Contracting Officer’s Representative (COR) of any problems or issues observed. The CMR will be expected to draft all contract related correspondence for the CO or COR’s signature;

arrange, attend, and facilitate a variety of meetings including, but not limited to, weekly progress meetings at project site; review, comment, and process Construction Contractor’s Division 01 Specifications and technical and informational submittals; monitor Construction Contractor compliance with submittals; review construction contractor pay requests and associated documents, and recommend approval to the COR; assist with construction modifications.

Estimated value of the task order is $30,354.80.

4. The authority and supporting rationale (see 8.4056(a)(1)(i) and (b)(1)) and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

Authority: 8.405-6 (a)(1)(C) - In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order or BPA must not have been previously issued under sole-source or limited-sources procedures.

Rationale: DSC is seeking approval of a limited sources justification for logical follow-on work to an original Federal Supply Schedule order based on the following rationale:

(1) The new work represents a continuation of the construction management services performed during construction. At this point of the project (approx. 90% complete), the current CM firm is the only firm that has the complete understanding and history of the project to ensure the remaining construction meets the workmanship requirements and conforms with the contract documents and existing codes.

(2) It is not feasible for another CM firm to oversee and inspect the work of the construction contractor without significant added risk. This would result in unnecessary added costs due to a steep learning curve and the potential for incorrect interpretation of the contract documents, and inadequate inspection and oversight of construction, for which there is no bona fide need.

(3) The current CM firm demonstrated superior technical capability; performed satisfactorily;

and proposed and negotiated fair and reasonable pricing. There is no evidence or rationale not to proceed with services using this firm. Continuing on results in lowest cost and risk to the government. Conversely, not continuing with the selected firm poses additional cost and risks that are unnecessary and cannot be supported or validated.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with 8.404(d).

Since (a) GSA has already determined the prices of the supplies and services under FSS contracts, including rates for services offered at fixed hourly rates, to be fair and reasonable; and (b) by placing an order against a schedule contract using the procedures in FAR 8.405-2, the ordering activity CO has concluded that the order represents the best value and results in the lowest overall cost alternative.

6. A description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted.

Market research was not conducted as it was conducted for the original order, and this new work is a logical follow-on to that original order.

7. Any other facts supporting the justification.

If the action is not done as a logical follow-on to the original FSS order, there would be unacceptable delays in fulfilling the agency’s requirements and duplication of cost by award to another organization.

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

There are future plans to acquire the same type of services via competitive multiple-award Blanket Purchase Agreement’s (BPA’s) set up against GSA contracts. Once established, individual call orders will be competed amongst the BPA holders.

9. This acquisition is conducted under the authority of the MultipleAward Schedule Program (see 8.401).
