About this file
This document is a Justification for Other than Full and Open Competition (JOFOC) for a federal contract opportunity related to Media Advertising Services. The government conducted market research from June 2023 to June 2024, which included posting sources sought and intent to sole source notices. Out of the 12 responses received, only 3 small businesses were determined capable of fully performing the work. The Contracting Officer determined the anticipated price will be fair and reasonable based on comparison to previous purchases and price lists. The agency plans to award a multiple award Blanket Purchase Agreement (BPA) for these services by March 2025, and any future requirements will be competed among the BPA awardees. The related federal contract opportunity is for Media Advertising Services (Year 3), awarded to an unknown vendor in September 2024 under Solicitation Number 140D0424Q0695.

potential sources as is practicable, including whether a notice was or will be publicized as required by FAR Subpart 5.2 and, if not, which exception under FAR 5.202 applies.
During previous market research, a sources sought notice was posted on SAM.gov from 6/8/2023 to 6/14/2023, requesting interested and capable parties to respond for this requirement. The Government received twelve (12) responses (1 large & 11 small businesses). However, the technical subject matter experts revealed that out of the 12 responses received only three (3) small business were determined to be capable of fully performing the work described in the SOW which included one (1) WOSB. Additionally, an Intent to Sole Source Notice was issued on SAM.gov from 7/5/2023 to 7/7/2023. As a result, two (2) additional responses were received from small business concerns. The Contracting Officer and FCG reviewed the additional responses and determined they were not capable of supporting this requirement, and they were also not WOSBs.
7. A determination by the contracting officer that the anticipated cost to the
Government will be fair and reasonable.
Price reasonableness will be determined by utilizing the price analysis techniques in accordance with DOI-AAAP-0024, v09. The Contracting Officer will determine that the anticipated price(s) are fair and reasonable based on comparison of the proposed price with prices found fair and reasonable on previous purchases in accordance with FAR 13.106-3(a)(2)(ii), and based on current price lists, catalogs, or advertisements in accordance with FAR 13.106-3(a)(2)(iii).
8. A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted.
Market research was conducted from 6/5/2024 to 6/17/2024, which included a search and review of several Government databases and websites, commercial sources in the open market, and a review of previous market research conducted for a similar requirement. The search of Government databases and websites found several Contractors with a GSA Professional Services Schedule (PSS) Multiple Award Schedule (MAS) in category 541810 (Advertising Services) who could possibly support this requirement; however, according to the IGE, the Order-Level Material (OLM) amount estimated for the requirement would exceed 33% of the total value of the award, thus not allowing for the utilization of GSA MAS per General Services Administration Regulation (GSAR) clause 552.238-115 (Special Ordering Procedures for the Acquisition of Order-Level Materials). A review of commercial sources using the Small Business Administration’s (SBA) Dynamic Small Business Search (DSBS) engine returned results of many small businesses under the NAICS 541810 (Advertising Agencies). These results were very similar to the results of previous market research conducted for a similar requirement between the dates of 6/1/2023 to 7/7/2023. During this timeframe, the Government issued two (2) synopses (Sources Sought Notice and Intent to Sole Source Notice) to further narrow down the commercial open market results and identify capable sources. Although 14 sources responded to the Notices
11. A statement of any actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
A requirement for professional services that will provide marketing and advertising services, media advertisement placement and video production services in support of marketing strategies and communication plan needs is currently being worked with the intent to award a multiple award BPA by 03/14/2025. Any further requirements of this nature will be competed amongst the awardees of the multiple award BPA once awarded.
