JUSTIFICATION FOR OTHER THAN
FULL AND OPEN COMPETITION
In accordance with the authority granted under 41 U.S.C. 253(c), this request for award under other than full and open competition is hereby submitted.
1. Identification of the agency and the contracting activity:
Bureau of Land Management, Alaska State Office
2. Nature and/or description of the action being approved:
Due to the circumstances described below I request the following be acquired using other than full and open competition in support of BLM requirement for standardized Alaska Land Mobile Radio (ALMR) systems for the law enforcement program.
3. A description of the supplies or services required to meet the agency’s needs (including the estimated value):
The BLM Alaska law enforcement program requires an update the existing radio systems in use. The existing radios are Motorola XTS/XTL 5000s. These radios were purchased over ten years ago and support and repair is no longer provided by Motorola. These radios are outdated and in some cases, failing.
This purchase would update the law enforcement program’s radio system with APX8500 and APX6000 radios. These radios are required to maintain compatibility with the ALMR system and the Office of Law Enforcement and Security’s policy compliance, located in General Order 18 of BLM Manual 9260.
Installation and programming maintenance would be performed by the Alaska Fire Service radio shop in Fairbanks, Alaska. The radio shop is set up to provide programming for the Motorola radio systems.
The estimated cost of purchasing eleven (11) complete sets of mobile and handheld radios, to include accessories such as chargers, antennas, and vehicle wiring, is $124,500.
4. An identification of the Statutory Authority permitting other than full and open competition:
446 DM Chapter 16 BLM Manual 1290 BLM Manual 9260
The statutory authority for this action is FAR 11.105 -- Items Peculiar to One Manufacturer.
(a)(1) The particular brand name, product, or feature is essential to the Government’s requirements, and market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s needs;
41. U.S.C. 253(c) (1) as implemented by FAR 6.302-1 Citation 10 USC 2304 (c)(1).
5. A demonstration that the proposed brand name possesses unique qualifications or the nature of the acquisition requires use of the authority cited:
The ALMR system is maintained largely by the Alaska Department of Public Safety.
The Alaska State Troopers use Motorola radios systems and the BLM law enforcement program dispatches through the Alaska State Trooper dispatch centers in Fairbanks and Wasilla, Alaska.
The existing law enforcement vehicle fleet has Motorola radios installed, making the installation of a different radio system potentially problematic.
The Office of Law Enforcement and Security, Region 2 consisting of Alaska, Oregon/Washington, and Idaho utilize Motorola systems for the law enforcement programs in each state.
BLM Manual 9260, General Order 18 requires the law enforcement program to utilize systems that are compatible with future and existing radio networks and maintain interoperability with the overall national program.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Federal Acquisition Regulation (FAR) Subpart 5.2, and, if not, which exception under
5.202 applies:
This requirement will be solicited under the DOI Field Com IDIQ in accordance with the mandatory Use Policy Memorandum dated 5/11/2018.
7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable, and the basis for that determination:
Cost has already been determined Fair and Reasonable under the IDIQ
8. A description of the market research conducted (FAR part 10) and the results or a statement of the reason market research was not conducted:
The DOI Field Com IDIQ is a mandatory source.
9. Any other facts supporting the use of other than full and open competition FAR 6.303-2(a) (9)): none
10. A listing of sources, if any, that expressed, in writing, an interest in the acquisition:
none
11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required:
BLM-AK Law Enforcement will continue to purchase under the DOI Field Com IDIQ as required.
