United States Department of the Interior Office of the Assistant Secretary - Indian Affairs

Washington, DC 20240

Brand Name Justification Simplified Procedures for Certain Commercial Items

Authority: FAR 13.501(a), 41 U.S.C. 1901 Control #:

1. Identification of the agency and the contracting activity, and specific identification of the document as a “Brand Name Justification.”

Contracting Activity: This document is a brand name justification for other than full and open competition for the Department of the Interior, Bureau of Indian Affairs, DEMD.

2. Nature and/or description of the action being approved.

Requirement: Purchase terrain data that will be used to produce dam failure inundation studies for use in emergency action plans.

Pricing: Firm-Fixed price

3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).

The BIA's SOD is tasked with producing dam failure inundation studies for use in emergency action plans. The use of the most recently acquired elevation data is essential to provide accurate studies. The NEXTMap data from Intermap Technologies has been evaluated and judged able to provide low-cost, high-quality elevation data. The estimated value is $30,000.00.

4. An identification of the statutory authority permitting other than full and open competition.

FAR 13.106-1(b)(1)(i)

5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.

Proprietary airborne radar mapping technology providing both 'digital surface models' and 'digital terrain models.’ These 'models' are required to have a absolute accuracy of better than 1.0 meters in the horizontal and 50 centimeters in the vertical RMSE. In addition, the data must be provided with a maximum of 1-meter elevation post spacing. Data must also

21-0159 conform to ISO 9001-2000 standards, with ISO certified methods being used in all stages from acquisition through final edit, to create quality, accuracy, and consistency. Intermap Technologies is the only vendor found able to provide data with these requirements. In addition, all elevation data currently required by the BIA Safety of Dams Branch (SOD) has been previously collected and processed by Intermap Technologies, thus eliminating any schedule delays due to inadequate data coverage. In addition, BIA SOD teaming partner, USBR's TSC, is now using this vendor's data for work on BIA facilities. The ability to use identical data on the same facilities will eliminate a large source of error now existing. Furthermore, Bureau of Indian Affairs (BIA) currently retains a credit with Intermap Technologies totaling $174,835.07 for a NEXTMap 5m USA data license it purchased in 2011 through Carahsoft Technologies. The current Price Quotation delivers data equal to this credit with a license uplift fee ($30,000.00) to upgrade the data supplied from NEXTMap 5m to NEXTMap One (1m). This will provide a cost savings of at least $174,835.07.

6. A description of efforts made to ensure that offerors are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.

A notice of intent to sole-source will be posted to sam.gov for 5 days.

7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.

I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable. The contracting officer determines that the anticipated price(s) will be fair and reasonable based on adequate price competition expected to result from the solicitation.

8. A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted.

Market Research indicates that there are no ISBEE vendors available to submit a competitive quote for this requirement.

9. Any other facts supporting the use of justification for other than full and open competition.

N/A

10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition.

11. A statement of any actions the agency may take to removed or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.

12. Requirements personnel certification.

I certify the technical data, which forms a basis for this justification, is complete, accurate, and meets the Government’s minimum needs.

13. Contracting officer certification that the justification is accurate and complete to the best of the contracting officer’s knowledge and belief.

I certify this justification is accurate and complete to the best of my knowledge and belief.
