JUSTIFICATION & APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION (JFOC) for

SIMPLIFIED ACQUISITIONS OVER $10,000

($2,000/$2,500 for Construction/Services) AND UP TO $250,000 (See FAR 13.106-1)

PR Number: 0040592132

1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):

The National Capital Region (NCA) National Capital Parks East (NACE) requires a contractor to repair eight damaged wood double-hung windows at the Frederick Douglass House (FRDO). The window repair work is required to help ensure windows get repaired as efficiently as possible. While task order 140P3021F0089 included the mechanical rehabilitation of the structure, it did not include optional pricing for this work as required by DOI Policy, so the option cannot be exercised.

The window repair services are required to help maintain the historic appearance of the building and the humidity and temperature within the building. This is a small, short-term project with a Period of Performance of two (2) months after the Notice to Proceed is issued. The current task order was awarded to Autumn General Contracting, LLC (AGC) to undertake a larger mechanical rehabilitation of the structure and does not end until June 30, 2023. Autumn is capable of exercising this scope of work, and they are currently working on site, diminishing mobilization costs and eliminating the need to coordinate between two contractors.

Government Estimate:

2. Description of the supplies or services req include:

I. Wood and glazing repairs of seven (7) windows on the Frederick Douglass House with a preference that the sashes remain in place.

II. Wood and glazing repairs of one (1) window on the Caretak ce that the sash remain in place.

3. Sole Source Justification rationale:

Other:

The Frederick Douglass House needs the windows repaired without risking conflicts between different on-site contractors due to space constraints causing delays. Awarding to Autumn General Contracting, LLC also allows for continuity of the warranty between the Task Order and this proposed contract. Since AGC is already on-site, utilizing them will also eliminate the costs associated with mobilization.

In addition, the NACE program did not get the new competitive construction package to contracting until 08/10/2022 and as a result, a competitive solicitation for the new requirement cannot be issued in time to make a new contract award by the September 24, 2022, fiscal year-end deadline.

The Contracting Officer considers the award of short-term single source contract an effective risk management strategy as authorized by FAR 1.102-2 (d) that is reasonably considered to provide less risk to the taxpayer. The Government would be at greater risk in terms of cost, should the delay in soliciting, awarding, and starting a competitive Purchase Order for the window repair construction services cause warranty issues and work delays on the already awarded task order and this contract which can lead to additional costs to the taxpayer.

Since the ability to modify the current task order for this work is not available, the only option remaining is to issue a short-term sole-source construction services contract to Autumn General Contracting, LLC, as authorized by FAR 13.106- 1 (b)(1)(i). The Contracting Officer (CO) using sound business judgement, as authorized by FAR 1.102 (d) and FAR 1.102-4 (e), considers a sole source award to Autumn General Contracting, LLC to be in the best interest of the Government.
