Sole Source – Under SAT Page 1 of 2

Preserving unimpaired the natural and cultural resources and values of the national park system for the enjoyment, education, and inspiration of this and future generations.

JUSTIFICATION & APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION (JFOC) for

SIMPLIFIED ACQUISITIONS OVER $10,000

($2,000/$2,500 for Construction/Services) AND UP TO $250,000 (See FAR 13.106-1, FAR 6.303-2)

PR Number: 0040565573

1. Identification of the agency and the contracting activity:

Agency: Department of the Interior – National Park Service – Region 1 – National Capital Area – National Mall and Memorial Parks.

Contracting Activity: Major Acquisition Buying Office (MABO) – Construction, A&E and Strategic Contracts

2. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):

The National Capital Area (NCA) – National Mall and Memorial Parks (NAMA) requires repairs to two electronically operated security gates that are installed at the United States Park Police (USPP) D1 substation. The gates were originally manufactured by the AMETCO Manufacturing Corporation and installed in September 2020 under contract number P16PC00558 by Integrated Security Technologies.

Currently both security gates are damaged and not operational. One was struck by a vehicle and damaged beyond repair, and at present, concrete barriers belonging to the Government have been installed by the Government to completely block off vehicle traffic to the facility. The other gate has broken down and no longer operates; it has been forced open to allow entry/exit of the site. Considering security of the facility is paramount, the contractor is required to coordinate the removal of the concrete barricades as needed to perform the repairs. Additionally, the replacement gate and all components must match the existing barrier design and work with the existing fencing and the gates must operate with the current electronic system that operates the existing gates.

This contract is to permit Integrated Security Technologies, INC. to promptly make these repairs to ensure the physical security of the USPP District 1 substation.

Government Estimate: $49,985.10

3. Sole Source Justification rationale (Check one and explain below):

Only one Responsible Source Urgent and Complling Circumstances Exist Other

Authority: IAW FAR 6.302-2(a) – Urgent and Compelling Urgency:

4. Nature of the acquisition that requires use of the authority cited:

The original procurement was to repair only one damaged security gate, however, while planning that acquisition, the only other security gated ceased working leaving no way to adequately secure the USPP D1 substation. At this moment one gate has been forced open to allow for entry/egress from the compound, whereas the other gate has been blocked with concrete barriers to prevent entry/egress. With both gates compromised and not secured allows for civilian vehicle and pedestrian traffic to enter into a restricted government area.

The simultaneous failure of both gates has brought forth an extreme risk with regard for the safety and security of law enforcement staff and unchecked access into the interior of restricted area within what is required to be a secure facility, protecting sensitive government law enforcement equipment and any legal evidence housed within. Considering this

Sole Source – Under SAT Page 2 of 3

Preserving unimpaired the natural and cultural resources and values of the national park system for the enjoyment, education, and inspiration extreme risk, the government is intending to award a sole source contract to Integrated Security Technologies, Inc. as they were the original contractor that installed the existing gates.

Using the original installer of the existing gates for the repairs, is in the best interest of the Government as they already have the background and documentation from the original install that will allow them to rapidly respond. This prior experience is reasonably considered the best way to manage risk in accordance with FAR 1.102-2 (c)(2) because they have knowledge and experience with these gates that other contractors would not have. This would allow them to swiftly mitigate the physical security failures that are present with the broken gates. The government is at an extreme risk in terms of physical security for the law enforcement officers and the public if the security gates are not repaired quickly and properly. If repairs are not made the life and wellbeing of law enforcement officers and any unauthorized civilians that choose to enter, with or without knowledge of the secure area, are at an extreme risk for harm.

Awarding a sole source contract to Integrated Security Technologies, Inc. is also reasonably considered to minimize administrative operating costs per FAR 1.102-2 (b). Integrated Security Technologies, Inc. has experience with the specific gates, and they know the access procedures, etc. that other contractors would not. While the Government will be present, the level of involvement will be less, as the contractor is both familiar the specific products that are broken as they were the original installer, and they are familiar with the facilities and security requirements. It just takes more time, to introduce a new contractor to a facility and even more so when they do not have a working knowledge (i.e. particular installation characteristics from original install).

5. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by subpart 5.2 and, if not, which exception under 5.202 applies:

Considering the urgent nature of this acquisition and its estimated value, the government has determined that is in their best interest to issue a Sole Source Award directly to Integrated Security Technologies, INC. A notice for this action will not be publicized IAW FAR 5.202 Exceptions (a)(2).

6. Market Research.

The Government conducted extensive Market Research, in preparation of the original package to establish a contract to repair one damaged gate. Multiple vendors were found under NAICS Code 561210 during market research that would qualify for the opportunity, however, in the midst of completing the requirement document package the only other entrance gate, also electronic, failed. Since both security gates are non-operational a considerable security risk has presented itself. The Government identified Integrated Security Technologies, Inc. based on prior experience in working with them on other electronic security gate and barrier contracts. They are a small business contractor fully capable of responding rapidly to this urgent situation. The Government is confident that Integrated Security Technologies, Inc. will make the repairs immediately and restore functionality and security to the electronic gate systems at the USPP compound.

5. If this is a determination for sole source, the contracting officer certifies:

The need is extremely urgent and the fact that Integrated Security Technologies, Inc. has been found fair and reasonably priced on other security barrier specific awards is an indicator that the anticipated cost to the Government will be fair and reasonable. Furthermore, the Contracting Officer will provide documentation IAW FAR 13.106-3(a)(2) to ensure the price provided by Integrated Security Technologies, Inc. is fair and reasonable.
