JUSTIFICATION & APPROVAL FOR OTHER THAN FULL AND OPEN

COMPETITION (JFOC) for SIMPLIFIED ACQUISITIONS OVER $10,000

($2,000/$2500 for Construction/Services) AND UP TO $250.000 (See FAR 13.106-1)

1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):

The National Capital Area (NCA) – National Mall and Memorial Parks (NAMA) requires a contractor to provide continued preventative maintenance and operation services at the Lincoln Memorial Reflecting Pool (LMRP) and the Water Treatment Plant (WTP). The preventative maintenance and operations are required to ensure the effective and efficient operation of the LMRP and WTP, to ensure high quality water and clarity within the pool and the longevity of the system as required by system and operation manuals.

This is a short-term contract, with a Period of Performance of two(2) months, to allow more time for a proper competitive contract to be put in place. The current contract 140P3021C0012 that was awarded to Pearl Purity Water Solution, LLC ends on May 31, 2021.

The services are required to maintain the effective and efficient operation of the LMRP and WTP and are required to prevent system break down.

Government Estimate: $42,457.60.

There is currently a contract in place, 140P3021C0012 that is due for recompete this Fiscal Year. The NAMA program did get the new competitive package in early October 2020; however due to significant acquisition staffing shortages with staff leaving and/or long-term emergency medical leave for a few other staff members it left this requirement hanging out there longer than maybe it should have been. As a result, the competitive solicitation for the new requirement is not going to be issued in time to make the new contract award by May 31, 2021. The new solicitation is in progress and will be issued sometime in May through Beta.SAM.gov.

If the Government does not keep these services in place during the recompete, there is a significant risk to the Government in terms of damaged equipment. The damage to one piece of equipment can lead to further operation problems and increased costs due to larger failures, which may lead to increased costs, not to mention the public image. The LMRP is world renowned location, that has been the backdrop for many historical events through the ages and is regularly viewed by the public. If there is damage caused during the lapse in service, which causes the LMRP to be down and not operation for a time, it presents an unnecessary public image crisis, that is even more difficult to determine in terms of costs and time to restore.

Additionally, as the intent of this contract is to provide for continued short-term operation support, it does not make sense from a business and cost perspective to compete this requirement. The current contractor has the familiarity and experience with the systems in place, which any new contractor would not have. As there is always a period of learning and understanding for any new contractor taking on a project, it is not considered in the Government best interest for a two-month contract. Awarding a single source contract to Pearl Purity Water Solutions, LLC significantly reduces the risk and costs associated with competing a new short term contract. Plus it will provide for consistency in services during this time, while the recompete is being issued.

The Contracting Officer considers the award of short-term single source contract an effective risk management strategy as authorized by FAR 1.102-2 (d) that is reasonably considered to provide less risk to the taxpayer. The Government would be at greater risk in terms of cost, should the service lapse while the new solicitation in being competed.

As the ability to exercise the option is not available, the only option remaining is to issue a short-term sole-source contract to Pearl Purity Water Solutions, LLC, as authorized by FAR 13.106-1 (b)(1)(i). The Contracting Officer (CO) using sound business judgment, as authorized by FAR 1.102 (d) and FAR 1.102-4 (e), considers a sole source award to Pearl Purity Water Solution, LLC to be in the best interest of the Government.

3. Market Research.

The Government conducted extensive Market Research, in preparation of the recompete of the new longer-term contract to replace contracts P16PC00096 and 140P3021C0012. It was found that multiple vendors are available under the NAICS Code 221310 – Water Supply and Irrigation Systems, including Small Business Concerns during this research. These services were also found to be available under the new GSA – Building Management and Operations (BMO) strategic contracts; however Pearl Purity Water Solution, LLC is not listed as one of the contractors available under that option.

Since, Pearl Purity Water Solution, LLC is the current contractor providing these services, it is not considered in the best interests of the Government to seek alternate sources for a short-term contract. The intent is to award from a single source as noted above in previous sections, and the market research found will not be considered for this award process but will be applied and considered for the new long-term requirement.

Pearl Purity Water Solution, LLC is a self-certified disadvantage small business and women owned business.

4. If this is a determination for sole source, the contracting officer certifies:

a. Other reasons exist for soliciting from a single source as stated above.

b. The anticipated price was determined fair and reasonable using the price analysis techniques described in FAR Part 13.106-3(a).
