About this file
This is a Brand Name Justification document supporting a limited-source procurement by the Department of the Interior, United States Geological Survey (USGS).
The USGS Central Midwest Water Science Center requires Fondriest Environmental NexSens data buoys integrated with 69 kHz real-time acoustic telemetry systems for ongoing multi-agency telemetry studies and monitoring of invasive carp and native species in the Illinois Waterway, Mississippi River, Maumee River, Sandusky River, and Huron River. The buoy-mounted telemetry detection systems are necessary to monitor invasive carp behavior for control efforts. The procurement will be conducted on a firm-fixed-price basis through GSA Advantage. Market research confirms that Fondriest Environmental is the sole U.S. distributor for NexSens integrated systems (data buoys, data loggers, software, data hosting, and ancillary equipment), with NexSens Technology, Inc. as the sole source manufacturer. The USGS has partnered with multiple federal and state agencies and universities that have invested several million dollars in existing Innovasea telemetry equipment and infrastructure. The specified NexSens data buoys uniquely support seamless integration with existing Innovasea real-time telemetry detection systems through proprietary coding and hot-swappable XB-200 data well inserts, providing system redundancy and continuity of data. No other brand of data buoys are compatible with the existing Innovasea XB-200 data well inserts and 69 kHz telemetry network. The justification documents extensive market research, field testing, and agency consultation conducted prior to the equipment recommendation, and recommends award on a limited-source basis in accordance with FAR 13.106-1.

Text version
equipment (i.e., buoy-mounted real-time telemetry detection systems) specified above in Paragraph 3 to successfully complete objectives for ongoing real-time monitoring and studies. If the Government were to purchase equipment other than Fondriest Environmental NexSens data buoys, the continuity of data and system redundancy would be lost.
7. Other Information. N/A
8. The Efforts to Identify Additional Sources Including the Market Research Conducted.
Market research via the Internet indicates Fondriest Environmental is the sole source for the selling, servicing and upgrading of any NexSens integrated systems in the United States. This includes data buoys, data loggers, software, data hosting, and ancillary equipment. NexSens Technology, Inc. is the sole source manufacturer. Extensive market research, field testing of available products, and consultation with other agencies was conducted prior to the recommendation of the equipment specified. Additionally, existing telemetry systems compatible with NexSens data buoys, deployed as part of ongoing studies and monitoring efforts, require backup instrumentation identical in make and model to the existing telemetry systems. The immediate need for telemetry systems to support ongoing studies prevents consideration of new systems or technologies not yet available on the market.
9. Actions to Overcome Barriers to Competition. The specified products are part of proprietary real-time telemetry detection systems and must be compatible across all study participants. No other manufacturer can provide these items. Other components of studies that use buoy-mounted real-time telemetry detection systems, but are not yet implemented, will continue to examine existing and emerging technologies in the application of focused investigations and continuous monitoring efforts. The products required are proprietary and must work in concert with existing equipment.
10. Recommendation and Certification from Program Office Based on the above, I recommend that this acquisition be conducted on a limited-source basis. I certify that the technical data that forms the basis for this justification, which is the responsibility of technical or requirements personnel, is complete and accurate.
11. Certifications and Approval from the Contracting Officer:
This requirement will be completed on GSA Advantage, which promotes competition. All the requirements of the Competition in Contracting Act, (41 U.S.C. 253), as implemented in the Federal and Interior Acquisition Regulations, have been considered in preparing this justification. This justification is accurate and complete to the best of my knowledge and belief.
The Contracting Officer will be able to determine that the prices paid under this effort are fair and reasonable based on competition, a price list, or invoices for similar or like services received.
