About this file
This document is a Justification for Other Than Full and Open Competition (JOFOC) for a sole source procurement of software and firmware updates, site support, and maintenance services for Trimble-brand surveying equipment owned by the Bureau of Land Management (BLM).
The BLM requires these services to support its Cadastral Survey duties, as the Trimble equipment is proprietary and can only be serviced by Trimble Inc. or its authorized dealers. The BLM plans to award a sole source task order to Trimble Inc. utilizing a pre-established Blanket Purchase Agreement with the Department of the Interior, which was previously determined to have fair and reasonable pricing. The total estimated cost for the maintenance services is $. The BLM will post a notice on SAM.gov encouraging other Trimble authorized dealers to submit capability statements, but the agency anticipates proceeding with the sole source award to Trimble Inc. due to the need for continuity and the lack of viable competitive alternatives.

JUSTIFICATION FOR OTHER THAN
FULL AND OPEN COMPETITION
In accordance with the authority granted under 41 U.S.C. 253(c), this request for award under other than full and open competition is hereby submitted.
1. Identification of the agency and the contracting activity:
Bureau of Land Management (BLM), Anchorage State Office, 940 - Division of Lands and Cadastral
2. Nature and/or description of the action being approved:
We request a sole source procurement of recurring required system updates with site support and maintenance through a Trimble Inc. authorized dealer as required in the warranty for each item listed in paragraph 3. Due to the location of the equipment and the potential need for the dealer to provide hands-on support or maintenance, our request includes a need to go through the only Trimble Inc. authorized dealer in our region, Frontier Precision, Inc.
3. A description of the supplies or services required to meet the agency’s needs (including the estimated value):
The Cadastral Branch has a responsibility of preservation of the Public Land Survey System (PLSS) and boundary determination of federal interest lands. Numerous technological survey instruments and tools are used and are required to fulfill these duties. The Bureau owns and has a need for system updates, site support and maintenance for the following Trimble-brand items:
- Trimble TSC5 Controllers, lapsed maintenance> 1 year, Quantity: 26
- Trimble TSC5 Controllers, Quantity: 3
- Trimble RlO-2 Receivers, Quantity: 12
- Trimble RiO-I Receivers, Quantity: 2
- Trimble Rl2i Receivers, Quantity: $
Total cost for maintenance is
4. An identification of the Statutory Authority permitting other than full and open competition:
41 U.S.C. 253(c) (1) as implemented by fAR 6.302-1. Only one responsible source and no other supplies or services will satisfy agency requirements.
5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited:
The updates, site support and maintenance are proprietary to the brand name of the owned equipment. Only Trimble Inc. software and firmware system updates will work on the Trimble-brand equipment, and no other companies’ system updates will work. In accordance with the warranties of each item, no other contractor, other than a Trimble Inc. authorized dealer can provide support and maintenance. Continuity in the Trimble Inc. infrastructure is required for the functionality of the existing items listed in paragraph 3 and is an essential need for the performance of Cadastral Survey duties.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Federal Acquisition Regulation (FAR) Stibpart 5.2, and, if not, which exception under 5.202 applies:
A notice will be posted to the Government-wide Point of Entry (SAM.gov) to publicize the Bureau’s intent to award a sole source contract with Trimble. The request encourages other responsible entities who are Trimble authorized dealers to provide a capability statement if they can offer the updates and services. Any statements received will be reviewed to determine if a competitive action is plausible and if it would result in a better value to the Government.
7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable, and the basis for that determination:
Trimble Inc has an established five-year Blanket Purchase Agreement (BPA) (140D0420A0005) with our parent agency, the Department of the Interior (DOl), Interior Business Center that was competed and the pricing was determined fair and reasonable prior to award in March 2020. Based on March 2024 market research, a Trimble authorized dealer offered pricing outside of the use of the BPA which was approximately 40% higher than the current BPA price for the identical services. An award to Trimble Inc. using the DOl BPA is anticipated to result in prices that will be fair and reasonable.
8. A description of the market research conducted (FAR part 10) and the results or a statement of the reason market research was not conducted:
Market research consisted of prices gathered from a Trimble authorized dealer.
9. Any other facts supporting the use of other than full and open competition FAR 6.303-2(a) (9)):
N/A
1 0. A listing of sources, if any, that expressed, in writing, an interest in the acquisition:
N/A
11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required:
Cadastral Field Survey has been trained on and used Trimble Inc. GNSS equipment for approximately 10 years. To compete this requirement, a new line of equipment would need to be invested in under a different brand. At that point, any follow-on purchases for that brand would need to be brand named and sole sourced to the new brand because all known technological field survey equipment on the current market requires their own brand specific warranty restrictions, system updates, peripheral supplies, prescribed authorized dealers permitted to perform maintenance, etc. Currently, there are no immediate plans to overhaul the current brand of equipment and systems in place.
