SECTION B -- SUPPLIES OR SERVICES AND PRICES
B.1 Notice to all Offerors: This procurement is a Total Small Business Set-Aside, FAR 52.219-6.
B.2 Site Visit: The offeror is strongly encouraged to visit the sites before submitting their offer. Each individual Task Order issued under this procurement will have a site location and require a site visit. The offeror is strongly encouraged to visit the sites before submitting their offer for the Task Orders. Details visible at the site but not shown explicitly on the contract document shall be included as they affect cost, in the offeror’s total offer amount. Refer to Section L, FAR Clause 52.236-27, Site Visit.
B.3 Instruction to Offeror: The offeror shall provide labor per hour rates and consider all costs factors listed as follows:
1. Direct cost elements, (e.g., labor, materials, equipment, travel, and subcontracts, etc.);
2. Indirect cost elements, (e.g., overhead, general and administrative expense, etc.), and profit;
3. Inclusive of any Federal, State, and Local taxes, in accordance with, FAR 52.229-01, FAR 52.229-04 and FAR 52.229-10;
4. Tribal Employment Rights Office Fee; and
5. Bonds, insurance; all permits and fees required by BIA, State, Tribal, and Local municipalities.
6. Offeror may fill in the other costs, as appropriate, to align with the standard business practices.
7. Offerors are responsible for complying with FAR 52.222-6, Davis-Bacon Act. The Offeror has public access at http://www.wdol.gov to locate the prevailing wage rates for their area.

SECTION C1 - GENERAL
C1.a Background.
The Bureau of Indian Affairs (BIA) Branch of Water Resources (BWR), as part of its task of gathering information in support of water right claims, constructs observation, monitoring, exploratory test and production wells. The need for accurate and informative hydrologic data continues to increase due to environmental and litigation requirements.
The BWR is currently involved in gathering data for water right claims in the following cases:

The BWR is additionally involved in environmental issues in and near Indian lands in New Mexico.
C1.b Scope of Work.
The work covered under this contract consists of well drilling services to include, but not be limited to, well construction, well reconstruction, development, well head completion, daily logs, driller’s reports for each site, test pumping, pump repairs and furnishing and installation of well monitoring equipment and related supplies.
The purpose of the drilling service is to gather information and data on the hydrologic characteristics of aquifers, their water level fluctuations and the quality of groundwater resources on Indian lands. Additionally, environmental data will be developed from the drilling service contract.
All of the data generated will provide evidentiary support of Indian water rights claims, thereby requiring a confidentiality commitment from the contractor.
The work covered herein consists of the procurement of all plant, labor, equipment, appliances, and materials and the performance of operations involving the drilling, casing, developing, completion, long term monitoring and test pumping of observation wells, monitoring wells, test production wells and exploratory test bores, including work-over of existing wells, in accordance with the specifications and terms of the contract.
C1.c Period of Performance.
This is a Base Year with 4 option periods.
C1.d Tribal Culture and Tradition The Contractor should be aware that the tribes are often closed during their feasts and ceremonial events that occur throughout the year. The contractor will be notified of the ceremonial days prior to the work and should be announced by the Governor 1-2 weeks in advance.
SECTION C2 – DEFINITIONS
C2.a Calendar Day (CD): Each day of the calendar year including workdays (WD), holidays, and weekends (including Saturdays and Sundays).
C2.b Contracting Officer’s Technical Representative (COTR): Government representative designated by the Contracting Officer authorized to act within the limitations imposed under the terms of the contract and by the Contracting Officer.
C2.c Government Furnished Items: Items (e.g., equipment, facilities, materials services, etc.) provided by the Government to the Contractor for use in performance of this contract, including issued task orders.
C2.d Inspection: The examination of the Contractor’s work by the Government to verify work requirements shall be accomplished by the Contractor Officer’s Technical Representative (COTR).
C2.e Non-Standard Working Hours: The period from 5:00 PM to 8:00 AM, Monday through Friday, and any time on Saturdays, Sundays, and Federal Holidays. Non-Standard Working Hours will be considered the Overtime Rate for estimating and payment purposes
C2.f Preconstruction Conference: A meeting attended by designated representatives of the Government and the Contractor shall be held within 10 days following contract award but before the start of work to discuss all aspects of the required work.
C2.g Standard Workday: Monday through Friday, excluding Saturdays, Sundays, and Federal Holidays. Federal Holidays include New Year’s Day, Birthday of Martin Luther King, Jr, Presidents Day, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving Day and Christmas Day.
C2.h Standard Working Hours: The period from 8:00 AM to 5:00 PM, Monday through Friday, excluding Saturdays, Sundays and Federal Holidays. Standard Working Hours will be considered the Hourly Rate for estimating and payment purposes.
SECTION C3 – GOVERNMENT FURNISHED PROPERTY AND SERVICES
C3.a The Government shall provide a contact for communications between the Contractor and the Pueblos. The contact will be the Bureau of Indian Affairs (BIA) Contracting Officer’s Technical Representative (COTR). The COTR can be contacted on weekdays between 8:00 AM and 5:00 PM at government office phone (505) 563-3418 and on the government cell phone (505) 228-3453.
C3.b The Government shall provide maps of the proposed locations following contract award.
C3.c In the event the Government provides property or equipment to be used specifically for the work, the Contractor shall be notified of equipment and the intended use.
SECTION C4 – CONTRACTOR FURNISHED ITEMS
C4.a The Contractor shall be responsible for providing all equipment, materials, labor, plant, tools, transportation, supervision, management, and other services, items, and incidentals necessary for the successful completion of the contract and task orders.
C4.b The Contractor shall be responsible for obtaining all permits, licenses, or other requirements for the transportation of equipment necessary for execution of the work. Copies of each document shall be submitted to the Government.
C4.c The Contractor shall be required to submit a cost proposal and brief proposed work plan to address each Task Order. The Task Order shall be developed jointly with the contracting officers’ representative, the technical representative and the Contractors superintendent, so as to ensure, in so much as is possible, a representative submission of costs and work plan by the Contractor.
C4.d The Contractor shall furnish a list of all equipment proposed to accomplish the tasks of completion for the specified work plan; proposed methods determined for the completion of the operation; keep equipment in good condition and the work site shall be kept clean.
C4.e The Contractor shall furnish copies of the standard time sheet, daily work report, and any other documents used for the purpose of determining billing charges or operation costs for each Task Order.
C4.f The Contractor shall complete and execute a Work Plan with a Proposed Schedule, Traffic Management Plan, Safety Plan, Quality Assurance Plan, Discharge Plan and any other required documents with all Task Orders prior to commencement of the work.
SECTION C5 - REQUIREMENTS
C5.a General Conditions
C5.a.1 Compliance The contractor shall comply with the provisions of the Workman's Compensation Act, the Subsequent Inquiry Act and all New Mexico and Federal Occupational Health Laws. The contractor will be required to submit a cost proposal and brief proposed work plan to address each Task Order. The Task Order will be developed jointly with the contracting officer’s technical representative and the contractors drilling superintendent, so as to ensure, in so much as is possible, a representative submission of costs and work plan by the contractor. The contractor shall procure and maintain throughout the life of this contract, complete workman's and employers liability insurance in accordance with New Mexico State and Federal regulations. Insurance shall include coverage for safety devices under Section 52-1-10 NMSA 1978. The contractor shall save harmless the United States Department of Interior, Bureau of Indian Affairs, it's officers, agents and employees from any claims or actions performed by the contractor that fail to meet the provisions of this paragraph.
C5.a.2 Licenses and Bonding Contractor shall maintain a current and approved New Mexico well drilling license. A copy of the license will be displayed on each site and will be provided to the Government at the time of the contract award.
C5.a.3 Equipment The contractor will furnish a list of all equipment proposed to accomplish the tasks of completion for the specified work plan. Proposed construction methods will be determined by existing site conditions at each location. Equipment will be kept in good condition and the drilling site will be kept clean and policed at all times. The contractor will furnish copies of the standard time sheet, daily construction log, and any other documents used for the purpose of determining billing charges or operation cost controls with the proposal package.
C5.a.4 Payment Payments will be made in accordance with accepted government standards and regulations after completion of work at each site. The total costs per site will be paid in full upon acceptance by the CO/COTR. Contract duration will be for one year from the date of the signed contract and will have an option for renewal yearly for five years.
C5.a.5 Confidentiality The well drilling and related services for exploratory bore and potential production wells will be performed for evidentiary support for the water rights cases previously identified. All information furnished or produced under this contract, including but not limited to, driller's log books, daily report, documents, and correspondence will be and remain confidential to the BIA. The contractor shall not release information to any person, group of persons, firm or organization other than the BIA, information that relates to work performed, or research or information derived from work performed under this contract.
Breach of this confidentiality shall be deemed a substantial breach of this contract and may be grounds for rescission.
The contractor may not use any product produced or knowledge gained from the work done under and during the life of this contract, and before, during or after the determination of any legal action in which Indian water rights are at issue, directly or indirectly, without the specific written permission of the Regional Director, Bureau of Indian Affairs, Southwest Regional Office as well as the governing officials of the Indian lands upon which the work was performed.
C5.a.6 Cooperation with Others The Government, Tribes and/or the Pueblos may have other personnel in the same area in which the work is being performed. The Contractor, in the best interest of the Government, shall provide all necessary cooperation so that work by others or of this Contract does not disrupt the concurrent work of other Contractors. The Government will determine the cooperation among others, and as such the decision of the Government will prevail.
C5.b Description
C5.b.1 Equipment
The work covered herein consists of the procurement of all plant, labor, equipment, appliances, and materials for the performance of the following operations: drilling of bore holes by conventional mud hydraulic rotary methods, by bottom-hole percussion tool with air rotary method, by reverse circulation rotary, by augering and installing well casing, well development procedures, well completion, well monitoring installations, well work-over and pumping for aquifer tests. The work shall be completed and in accordance with the following technical specifications and are subject to the terms of the contract.
C5.b.2 Location Observation and monitoring wells may be drilled at locations determined by the CO/COTR. These locations may require a wide range of effort, dependent upon the development, right of entry, environmental or other issue being addressed.
Abandonment of bores or wells may be required services as a part of this contract. Abandonment procedures will be site specific and will ensure confident closure of all potential contaminant issues at each site.
C5.b.3 Borehole Diameters
Each service shall be performed using a Task Order Format, whereby a project is identified by the Bureau and a Task Order is then issued. Boreholes will be of no required minimum depth but varying to a maximum depth of 2500'. Borehole diameters will be a minimum of 6-5/8" to a maximum of 30". Specifically, 6-5/8", 7-7/8", 8-3/4", 9-7/8" and 12-1/4" diameter bore holes may be drilled to 2500' bgl (below ground level). Also, 14-3/4", 17-1/2" and 20" bores may go to depths of 2000' bgl and 24", 26" and 30" bores may go to depths of 1000'.
C5.b.4 Drilling and Workover Methods
Several drilling methods may be required as there are a variety of locations requiring exploration. The method and work plan for each drilling and workover project will be determined by the Contracting Officer (CO), the Contracting Officer's Technical Representative (COTR) and the Contractor. A Task Order will then be developed and the contractor will submit a cost proposal and work plan in accordance with specifications contained here-in. It is envisioned that most drilling will be by conventional mud hydraulic rotary drilling methods. Reverse mud hydraulic rotary drilling methods may be required for some sites. Other sites may require a bottom-hole percussion tool with air rotary drilling methods.
C5.b.5 Casing Holes
Exploratory bores will be assessed for potential production when the "total depth" (TD) of the bore has been reached. If it is determined by the CO/COTR to be potentially productive, a casing schedule and completion program will be initiated.
Casing and screens may be slotted steel or PVC slotted dependent upon site specifics and may range in diameter from 2" to 18".
C5.b.6 Well Development and Rehabilitation
Development and rehabilitation techniques shall require equipment consistent with the size of the casing and screen to be developed. Development may be by air-lift through the casing or an eductor, or by pumping.
C5.b7 Aquifer Testing Aquifer testing may be required on these completions and will be done in accordance with the specifications detailed in sections C5.c.12, C5.c.13 and C5.c.14.
C5.c WELL DRILLING AND RELATED SERVICES
C5.c.1 Mobilization and Demobilization A lump sum payment as negotiated will be made for mobilization and demobilization for each piece of equipment requested for each location. This includes costs related to rig transportation, excepting mileage costs, to and from as yet unidentified locations, rigging up and down, setting up all related equipment such as mud pumps, de-sanders, sampling areas and so forth, site preparation, site restoration and clean up.
C5.c.2 Mileage
A cost per mile shall be paid at the unit rate price for mileage for the equipment and support vehicle on work projects and on all other projects for each piece of equipment requested. The mileage allowed shall be calculated as:
1) The distance of one round trip from the intersection of Indian School Road and 12th St. in downtown Albuquerque, New Mexico to the work location.
2) Or the actual round trip mileage from the Contractors place of business to the work location, whichever is less.
3) Or the actual distance between multiple work locations. A "location" is an area that may include more than one well "site".
C5.c.3 Conventional Hydraulic Rotary Mud Drilling Services may be required to complete 6-5/8" to 30" bore holes to depths previously specified. The contractor shall drill bore holes by conventional hydraulic mud rotary methods at locations designated by the CO/COTR. The depth of the bore will be determined by the CO/COTR, but will not exceed 2500'. Drilling fluids shall contain a weight of 8.9 to 9.3 pounds per cubic foot, a funnel viscosity maximum of 40 seconds, Filter Cake Thickness < 3/32-inch and Sand content of drilling fluid not more than 5%.
Payment for the bore hole will be at the negotiated price per foot of bore hole successfully completed. This price per foot shall include, but is not limited to, costs for labor, fuel, mud maintenance and any tasks required for standard hydraulic rotary mud drilling operations. Drilling operations may also be paid on a negotiated hourly rate as Rig Time if deemed mutually beneficial to the Government and the contractor by the CO/COTR. The contractor shall be paid at the negotiated price for Rig Time for drilling services encountering unknown conditions, stand-by time or for any task as determined by the CO/COTR deemed necessary for a successful completion and not defined in the negotiated contract. Payment for Rig Time is at the sole discretion of the CO or COTR. The contractor must receive approval for Rig Time charges before any work so designated is performed, excepting stand-by time.
C5.c.4 Bottom-hole percussion tool with air rotary method Drilling by this method will employ the use of compressed air and a biodegradable liquid foaming agent (a mixture of anionic surfactant). The liquid will be added to water creating a mixture for injection into the air stream for carrying the drill cuttings up the annulus. The anticipated compressor requirements are 500 to 750 cfm two-stage positive-displacement and having working pressures of 250 to 350 psi. The bore diameter will be 12-1/4" or less. A total depth maximum will be 2500'. If water infiltration becomes too great, this drilling method will be halted and an assessment will be made concerning completion. If it is deemed necessary to continue drilling, the reverse circulation rotary drilling method may be employed.
Payment for bore hole will be at the negotiated price per foot of bore hole successfully completed. This price per foot shall include, but is not limited to, costs for labor, fuel, fluid and compressor maintenance and any tasks required for bottom-hole percussion tool with air rotary drilling operations. Drilling operations may also be paid on a negotiated hourly rate as Rig Time if deemed beneficial to the CO, COTR and the Contractor.
The contractor shall be paid at the negotiated price for Rig Time for services encountering unknown conditions, stand-by time or for any task as determined by the CO/COTR deemed necessary for a successful completion and not defined in the negotiated contract. Payment for Rig Time is at the sole discretion of the CO/COTR. The contractor must receive approval for Rig Time charges before any work so designated is preformed, excepting stand-by time.
C5.c.5 Reverse Circulation Rotary Services requiring this drilling method may be required if a down-hole percussion tool method encounters highly productive water bearing zones or for any other reason deemed reasonable by agreement with the CO/COTR and the Contractor.
Payment for bore hole will be at the negotiated price per foot of bore hole successfully completed. This price per foot shall include, but is not limited to, costs for labor, fuel, fluid and compressor maintenance and any tasks required for reverse-circulation rotary drilling operations. Drilling operations may also be paid on a negotiated hourly rate as Rig Time if deemed beneficial to the CO, COTR and the Contractor.
The contractor shall be paid at the negotiated price for Rig Time for reverse circulation rotary drilling as well as services encountering unknown conditions, stand-by time or for any task as determined by the CO/COTR deemed necessary for a successful completion and not defined in the negotiated contract. Payment for Rig Time is at the sole discretion of the CO/COTR. The contractor must receive approval Rig Time charges before any work so designated is preformed, excepting stand-by time.
C5.c.6 Auger Drilling Three categories of auger drilling, two depth targets and angle auger bores, will be performed by a CME 75 or comparable rig capable of delivering 280 Ft. Lbs. of torque output from a 120 Horse Power and 2800 RPM engine.
Additional requirements include, but are not limited to top head drive torque rating 13,000 Ft. Lbs. at 60 RPM. Triple hoists are required having capacities of 8,500 Lb., 3200 Lb., and 1800 Lb. The capacity to auger drill at angles up to 30 degrees from vertical are required to potentially obtain samples of material from underneath an in place underground storage tank. A 5’ to 20' of screen may be required at each location.
Quoted auger prices per hour will cover costs incurred, but are not limited to, crew wages, materials, associated equipment, and fuel to perform the below described work, excluding mileage. A one time lump sum Mob/Demob payment as negotiated will be made for transporting equipment, materials, and crews to and from and preparing as yet unidentified locations. A cost per mile will be paid at the negotiated price for the drilling rig and one support vehicle, if necessary.
Augers having a minimum of 4-1/4” I.D. to 12-1/4" I.D. may be required to drill bore holes and obtain continuous samples from alluvial materials to a maximum depth of 200' below ground level. Samples from this size bore will be retrieved using either a continuous sampler or a split spoon driven by a 140 Lb. automatic hammer having at least a 30" drop.
Completions generally will be to 20' below the first encounter of ground water. Screened sections generally will be set through the vadose zone and into the water at sufficient depth so as to ensure, in so much as is possible, adequate sampling ports for water quality assessment and the accurate measurement of water level fluctuations or declines.
C5.c.7 Rock Core Drilling and Sampling The Contractor will furnish all plant, labor, equipment and materials, and perform all operations at the locations specified to be accomplished by rock coring drilling and sampling in accordance with these requirements and applicable drawings.
Drilling of cores will be by any approved standard accepted method of rotary drilling using carbide or diamond set coring bits. The bits will provide good recovery of hard and soft rocks, and partly consolidated materials by means of N size diameter core.
Equipment to be furnished by the Contractor for core drilling will include drilling machinery approved by the Government complete with all accessories for taking continuous rock cores of a diameter consistent with bit size to the depths specified. All supplies for core drilling will be furnished by the Contractor and shall include, but not be limited to, all casing, drill rods, core barrels, coring bits, piping, pumps, water, tools, and power required for drilling and all boxes and containers required for core samples. Bits will be set with the proper size stones and matrix for the kind of rock being drilled.
All borings will be drilled vertically to the bottom elevations or depths specified unless otherwise indicated in the schedule of borings. Offsetting of borings from the locations specified will not be permitted. Casing through the overburden will be seated tightly in the rock at the elevation where rock is encountered prior to commencement of rock coring. The Contractor shall operate the drills at such hydraulic pressures, speeds and with such water pressures as will ensure maximum core recovery in whatever kind of rock is being drilled. When drilling rock, the Contractor shall reduce the length of runs to 2 ½ feet or less whenever core recovery is unacceptable as determined by the Government. Failure to comply with procedures will constitute justification for the Government to require redrilling at the Contractor's expense of any boring from which the core recovery is unsatisfactory. The Contractor shall record water losses, rod jerks, and other unusual core experiences that will identify the extent of fracturing and other characteristics of the materials being sampled. All borings or wells that are not to be used as piezometer locations, observation wells or that are otherwise required to remain open will be sealed.
The Contractor shall exercise special care to preserve the rock cores in their natural state. The core will be carefully fitted together in a core trough 1 ½ times the length of the run for measurement before being placed in the core boxes. The core will be carefully placed in the core box in the order which it is retrieved from the core barrel. Each box will be labeled completely, inside and out, and with depths, boring number, project, elevations, and other pertinent data. Cores from different borings will not be placed in the same core box.
C5.c.8 Casing Advancement Drilling The Contractor will furnish all plant, labor, equipment and materials, and perform all operations at the locations specified to be accomplished by casing advancement system with a swing out under-reaming bit (ODEX) in accordance with these requirements and applicable drawings. Drilling through unstable formations and overburden will be by any approved standard accepted method to advance a cased hole. The system operates with the use of a pilot bit with an eccentric reamer bit, a down-the-hole-hammer, a specialized drive shoe and mild steel casing.
Equipment to be furnished by the Contractor for drilling will include basic drilling machinery approved by the Government complete with a drive head assembly which will accommodate an air supply, independent, reversible rotation with sufficient torque to match the hole diameter and depth requirement, air compressor and all accessories for advancing continuous casing to the depths specified. All supplies for drilling will be furnished by the Contractor and shall include, but not be limited to the discharge head, casing tubes, drill pipe, guide sleeves, top hole or down-the-hole-drill hammer, casing shoe, air supply, reamer, pilot bit, auxiliary tools and power required for drilling and all containers required for sampling. Bits will be set with the proper carbide buttons capable of drilling and casing a 6-inch diameter borehole to a maximum depth of 100 feet or limit of the equipment.
All borings will be drilled vertically to the bottom elevations or depths specified unless otherwise indicated in the schedule of borings. Offsetting of borings from the locations specified will not be permitted. The casing is advanced through the overburden or to the soil/rock interface. At the required depth, the rotation is reversed and the drill bit assembly is pulled up through the casing. The casing tubes are left in the hole and either a monitoring well is installed or the hole is advanced using conventional drilling methods. The Contractor shall operate the drills at such hydraulic pressures, speeds and with air pressures that will ensure maximum flushing action of the cuttings up the hole. Failure to comply with procedures will constitute justification for the Government to require redrilling at the Contractor's expense of any boring from which the hole depth is unsatisfactory. The Contractor shall record air losses, rod jerks, and other unusual drilling experiences that will assist in identifying the nature and extent of the character of the materials being drilled. All borings or wells that are not to be used as piezometer locations, observation wells or that are otherwise required to remain open will be sealed.
C5.c.9 Well Development Services requiring procedures for development may be done in any of three ways as determined by the CO/COTR for any site. The first method of air-lift development will be by blowing a sufficient volume and pressure of air via an air line. The depth to the bottom of the air line from the surface to the static water level must be at least three times the distance from the surface to the static water level. The second method will use the drill pipe as an eductor. The drill pipe will be fitted with a 5' to 10’ section of perforated pipe isolated by swab flanges on top and bottom. This 5' to 10’ section will be lowered to the bottom of the screen. An air line, lowered to the depth as described in the first method, will be placed inside the drill pipe and development will commence and proceed to successive screen sections allowing for the pipe column to be raised and lowered while air- lifting. The third method of development will be by pumping using a submergible pump. The pump will be lowered to the lowermost screen and pumping will begin. The configuration of the discharge shall allow for the pump to be raised and lowered during the pumping operation at least 10'. The time spent developing in each 10' interval shall be determined by the CO/COTR who shall be on-site during all development operations. Well development costs will be paid at the negotiated price per hour for equipment used to air-lift through an eductor or otherwise, or by pumping methods, successfully performed.
C5.c.10 Well Workover Operations may be required for redevelopment, reconfiguration or any operation deemed necessary by the CO/COTR on existing Indian or BIA wells. These operations shall conform to those standard practices normal to well drilling or workover. It may be necessary to abandon bores or plug existing wells and work done in preparation for such operations will be paid at the workover hourly negotiated price. Actual plugging operations shall be paid at the negotiated price for equipment used to place cement plugs. The contractor shall at all times conform to standard safety procedures for well drilling operations. Well workover costs will be paid at the negotiated price per hour for workover equipment used in operations successfully performed.
C5.c.11 Placing Bentonite Plugs The placement of seals and plugs may be required for isolating specific zones, well abandonment and/or well head protection at selected sites. Bentonite sealing material will be composed of 1/4”, 3/8“, or 1/2“pellets formed of pure bentonite and placed using tremmie pipe or by acceptable methods proposed by the Contractor, which ensure accurate and competent seals. Payment for all work required to prepare, place and clean up from plugging and sealing operations will be paid at the negotiated price per hour for equipment used in placement acceptably performed.
C5.c.12 Cementing Services will be required for various completions and down hole tasks including, but not limited to, well abandonment.
Cement services require abilities to pump Portland Type III cement slurries containing up to 5% pure bentonite through tremmie pipe at pressures up to 150 psi. The grouting materials shall conform to slurry weights of approximately 115 lbs/cu.ft. Grout shall be allowed to cure at least 8 hours. Payment for all work required to prepare, place and clean up from cementing operations will be paid at the negotiated price per hour for equipment used for cementing services acceptably performed.
C5.c.13 Welding Services will be required for setting casing and other as yet unknown reasons. All welding will be performed by experienced and qualified welders using certified materials and equipment. Welding will be paid for at the negotiated prices per hour for welding services acceptably performed.
C5.c.14 Aquifer Testing A pump of sufficient horse power and size to deliver specific rates from specific depths will be installed and removed by the contractor. Manned operation of pumps and generators will be required for the duration of some pumping and/or aquifer testing. In some cases, the contractor may be required to provide water level data collection services. In any case allowances will be made for specific periods of data gathering.
C5.c.15 Step testing Step testing will consist of three distinct periods as follows: 1) Pre-Pumping Period, 2) Continuous Pumping Period and 3) Recovery Period. Each period will be adequately documented so as to allow all interested parties to reconstruct all events occurring during each period. No pump operations will be required during the pre-pumping and recovery periods. Data acquisition requirements are described in Section C5.c.15.
C5.c.16 Constant rate testing After step testing is complete, constant rate pump testing will begin consisting of three distinct periods as follows: 1) Pre- Pumping Period, 2) Continuous Pumping Period and 3) Recovery Period. Each period will be adequately documented so as to allow all interested parties to reconstruct all events occurring during each period. No pump operations will be required during the pre-pumping and recovery periods.
1) Pre-Pumping Period: The contractor must have the necessary equipment set and in place to initiate the continuous pumping test before the pre-pumping period begins. Additionally, flexible discharge line of an adequate length as determined by the CO/COTR and the contractor will be installed. The pre-pumping period will be one day (24 hours). During this period depth to water level measurements (WL) will be measured from the top of the casing taken at least once each 6 hours.
2) Continuous Pumping: The pump shall run continuously from the end of the pre-pumping period through the beginning of recovery period. If for any reason the pump stops or cannot be controlled accurately enough to maintain the desired pumping rate, the pre-pumping period will start over and the test restarted if deemed necessary by the CO or COTR. No provision is made to cover costs incurred for pumping test not acceptably performed. During pumping, water level (WL) and production (GPM) will be measured as per the following schedule:

After the second hour of the test, production water will be measured for temperature and specific conductance once each hour through the conclusion of the pumping period. The contractor will be required to have an operator on site for 8 hours a day during the continuous pumping period and may be required to perform data acquisition during this time. The COTR will provide for site security and data acquisition during the rest of the time. The operator will service the equipment and in so much as possible, ensure that the equipment will function properly while onsite. The operator shall be available for duty "on call" for emergency needs.
3) Recovery Period: The recovery period measurements will be taken according to the following schedule:

C5.c.17 Alignment All well bores shall be constructed and all casing set sufficiently round, plumb and true as to enable the free installation of a bailer or any appurtenance 2" smaller in diameter than the bore and 1/2" smaller in diameter than the I.D. of the casing.
The casing shall not deviate more than 6" per 100' from a straight plumb line beginning at the exact center of the top of the casing.
C5.c.18 Placing Gravel All gravel to be installed in any bore for the purpose of packing a screened section shall be composed of quartzose and similar durable well rounded particles, containing no silt, clay, organic materials, flat or elongate particles or deleterious materials. Under no circumstance will crushed rock be allowed as filter pack material for the well. A certificate of quality and gradation from a testing laboratory or the contractor may be required if a question as to compliance is raised by the CO/COTR. Payment for time spent placing gravel packing materials will be at the negotiated price per hour for equipment used during operation successfully performed.
C5.c.19 Geophysical Logging After completion of the drilling of each test hole, the contractor shall keep the hole filled with drilling mud to prevent caving. Geophysical logging will be commenced within three days after completion of drilling by a reliable and competent firm experienced in, but not limited to, electric resistivity, spontaneous potential, single point resistance, gamma ray, neutron, sonic and caliper logging. The contractor shall be responsible for all arrangements and schedules with the logging company and shall pay all related costs. Payment for performance of the work will be at the negotiated price per job to 1000’ and price per foot over 1000’ for work successfully performed.
C5.c.20 Video Logging Prior to video logging each test hole, the contractor may be required to treat the hole with a chemical deflocculant to clear the water. Video logging will commence within three days after being notified by the CO or COTR by a reliable and competent firm experienced in downhole and sidescan logging. The contractor shall be responsible for all arrangements and schedules with the logging company and shall pay all related costs. Payment for performance of the work will be at the negotiated price per job to 100’ and price per foot over 100’ for work successfully performed.
C5.c.21 Well Treatment The contractor will be required to treat the hole in order to clean the casing and screen. Treatment will commence within three days after being notified by the CO or COTR by chemical, mechanical or explosive methods. After treating each test hole, the contractor may be required to test the hole. The contractor shall be responsible for all arrangements, transportation and deployment of the treating material. Payment for performance of the work will be site specific for work successfully performed.
C5.c.22 Material Safety Data Sheets The Contractor shall provide a copy of the Material Safety Data Sheets (MSDS) to the Contracting Officer (CO) and Contracting Officer’s Technical Representative (COTR) for each of the products used to perform services. The MSDS must be submitted to the CO and COTR prior to use of the materials on site.
C5.d SERVICE DELIVERY SUMMARY
C5.d.1 Overview This Service Delivery Summary (SDS) identifies critical success factors for the contract. It identifies both the performance objectives for those factors and the performance threshold required for each performance objective. The Government reserves the right to survey all services called for in the contract to determine whether or not the performance objectives and goals are met. Therefore, the contractor shall submit their schedule and quality plan within 15 days of any issued task order, so the COTR can develop their surveillance plan. This SDS lists the performance objectives for the required service that the Government shall survey.

SECTION C6 – PUBLICATIONS AND FORMS
C6 PUBLICATIONS AND FORMS
There are two types of forms the Contractor is responsible for submitting to the Government; mandatory and advisory.
The mandatory and advisory forms shall be provided to the Contractor as required by the Government.
SECTION E -- INSPECTION AND ACCEPTANCE
E.1 52.246-12 INSPECTION OF CONSTRUCTION AUGUST 1996
(a) Definition. "Work" includes, but is not limited to, materials, workmanship, and manufacture and fabrication of components.
(b) The Contractor shall maintain an adequate inspection system and perform such inspections as will ensure that the work performed under the contract conforms to contract requirements. The Contractor shall maintain complete inspection records and make them available to the Government. All work shall be conducted under the general direction of the Contracting Officer and is subject to
Government inspection and test at all places and at all reasonable times before acceptance to ensure strict compliance with the terms of the contract.
(c) Government inspections and tests are for the sole benefit of the Government and do not--
(1) Relieve the Contractor of responsibility for providing adequate quality control measures;
(2) Relieve the Contractor of responsibility for damage to or loss of the material before acceptance;
(3) Constitute or imply acceptance; or
(4) Affect the continuing rights of the Government after acceptance of the completed work under paragraph (i) of this section.
(d) The presence or absence of a Government inspector does not relieve the Contractor from any contract requirement, nor is the inspector authorized to change any term or condition of the specification without the Contracting Officer's written authorization.
(e) The Contractor shall promptly furnish, at no increase in contract price, all facilities, labor, and material reasonably needed for performing such safe and convenient inspections and tests as may be required by the Contracting Officer. The Government may charge to the Contractor any additional cost of inspection or test when work is not ready at the time specified by the Contractor for inspection or test, or when prior rejection makes reinspection or retest necessary. The Government shall perform all inspections and tests in a manner that will not unnecessarily delay the work. Special, full size, and performance tests shall be performed as described in the contract.
(f) The Contractor shall, without charge, replace or correct work found by the Government not to conform to contract requirements, unless in the public interest the Government consents to accept the work with an appropriate adjustment in contract price. The
Contractor shall promptly segregate and remove rejected material from the premises.
(g) If the Contractor does not promptly replace or correct rejected work, the Government may--
(1) by contract or otherwise, replace or correct the work and charge the cost to the Contractor; or
(2) terminate for default the Contractor's right to proceed.
(h) If, before acceptance of the entire work, the Government decides to examine already completed work by removing it or tearing it out, the Contractor, on request, shall promptly furnish all necessary facilities, labor, and material. If the work is found to be defective or nonconforming in any material respect due to the fault of the Contractor or its subcontractors, the Contractor shall defray the expenses of the examination and of satisfactory reconstruction. However, if the work is found to meet contract requirements, the
Contracting Officer shall make an equitable adjustment for the additional services involved in the examination and reconstruction, including, if completion of the work was thereby delayed, an extension of time.
(i) Unless otherwise specified in the contract, the Government shall accept, as promptly as practicable after completion and inspection, all work required by the contract or that portion of the work the Contracting Officer determines can be accepted separately.
Acceptance shall be final and conclusive except for latent defects, fraud, gross mistakes amounting to fraud, or the Government's rights under any warranty or guarantee.

(a) If the Contractor fails to complete the work within the time specified in the contract, the Contractor shall pay liquidated damages to the Government in the amount of $ Not Applicable for each calendar day of delay until the work is completed or accepted.
(a) If the Government terminates the Contractor's right to proceed, liquidated damages will continue to accrue until the work is completed. These liquidated damages are in addition to excess costs of repurchase under the Termination clause.
F.4 52.211-13 TIME EXTENSIONS SEPTEMBER 2000
Time extensions for contract changes will depend upon the extent, if any, by which the changes cause delay in the completion of the various elements of construction. The change order granting the time extension may provide that the contract completion date will be extended only for those specific elements related to the changed work and that the remaining contract completion dates for all other portions of the work will not be altered. The change order also may provide an equitable readjustment of liquidated damages under the new completion schedule.
F.5 52.242-14 SUSPENSION OF WORK APRIL 1984
(a) The Contracting Officer may order the Contractor, in writing, to suspend, delay, or interrupt all or any part of the work of this contract for the period of time that the Contracting Officer determines appropriate for the convenience of the Government.
(b) If the performance of all or any part of the work is, for an unreasonable period of time, suspended, delayed, or interrupted (1) by an act of the Contracting Officer in the administration of this contract, or (2) by the Contracting Officer's failure to act within the time specified in this contract (or within a reasonable time if not specified), an adjustment shall be made for any increase in the cost of performance of this contract (excluding profit) necessarily caused by the unreasonable suspension, delay, or interruption, and the contract modified in writing accordingly.
