About this file

This document is a Sole Source Justification (SSJ) for the Drug Enforcement Administration (DEA) to procure laboratory consumables from Agilent Technologies Inc. The procurement is for follow-on acquisition of laboratory consumables specific to Agilent equipment used across all DEA laboratories, with a period of performance through 09/30/2025. The solicitation will be posted to SAM.gov as a set-aside for small businesses, with the contract to be awarded as a single firm-fixed price (FFP) purchase order to the eligible, responsible offeror based on Lowest Price Technically Acceptable (LPTA) criteria.

Market research was conducted on GSA ebuy, where not all required items were available from a single vendor. Two items were not listed on GSA ebuy, so the program office contacted two small businesses and obtained quotes. Three sources (NETA SCIENTIFIC INC, AGILENT TECHNOLOGIES INC, and GOVERNMENT SCIENTIFIC SOURCE INC) expressed written interest in the acquisition. The justification notes that replacing all DEA labs' special equipment would be cost-prohibitive, and the consumable supplies are specific to the existing Agilent equipment, which supports the sole source determination.

FAR 13.501

Sole source procurements should only be used when competitive solicitation procedures are not applicable to the requirement or are impracticable. Please remember, that contracting without promoting competition to the maximum extent practicable cannot be justified due to a lack of advance planning by the requiring activity or concerns related to the amount of funds available.

This document shall not be used for Federal Supply Schedule acquisitions.

The simplified acquisition threshold is defined in FAR 2.101. Per FAR 6.001, acquisitions of certain commercial items exceeding the simplified acquisition threshold and conducted using simplified acquisition procedures as authorized by FAR 13.501 are exempt from the requirement to promote full and open competition. Such acquisitions must promote competition to the maximum extent practicable as required by 41 U.S.C. 1901 and FAR 13.104. Because this acquisition will be conducted without promoting competition to the maximum extent practicable, this justification is prepared for review and approval in accordance with FAR 13.106-1(b)(2) and 13.501(a).
