JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION – BRAND NAME
1. Identification of the Agency and the Contracting Activity: Department of Interior (DOI), National
Park Service (NPS), Interior Region 1 – National Capital Area, Division of Acquisition Management.
2. Nature and/or Description of the Action Being Approved:
The purpose of this justification is to provide an understanding of the basis for supporting a brand name requirement for radio equipment at Wolf Trap National Park for the Performing Arts (WOTR). The NPS intends to issue a delivery order against the mandatory DOI Field Communications IDIQ Contract to acquire new Motorola repeaters, Motorola base station, and replace existing Motorola brand radios with new Motorola radios and accessories.
The NPS memorandum "Mandatory Use Policy for the DOI Field Communications IDIQ Contract" dated May 11, 2018 requires the use of the DOI Field Communications IDIQ Contract FC1 for radio communication products, FC2 for services, and FC3 for design-build solutions.
When restricting consideration of items peculiar to one manufacture FAR 16.505(a)(4)(iii)(2) requires the contracting officer to provide the justification and supporting documentation along with the solicitation to all contract awardees.
3. A Description of the Supplies or Services Required to Meet the Agency’s Needs:
(2) - Motorola GTR 8000 Base Radios and components
(40) - Motorola APX 1000 UHFR1 model 2 Portable Radios and accessories
(1) – Motorola APX All Band Consolette and accessories
(20) - Motorola Battery Pack, MAH, BATT IMP STD IP67
(3) - Motorola Charger Desktop Multi-unit Impres 2
(22) - Motorola CHGR Desktop Single Unit Impres, US
The estimated value for this procurement is $123,950.53
4. Authority Permitting Other Than Full and Open Competition:
In accordance with FAR 16.505(b)(2)(B), Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.
Procuring Motorola brand radios will allow for the new equipment to fit into existing equipment racks and mounts. The switchover work will be kept to a minimum, since the wiring and software programs are already compatible. All these factors limit downtime and minimize installation issues, which can have an adverse impact on safety withing NPS property throughout the National Capital Area.
Opening competition to other brands would increase communications downtime; it is unknown if it would be days or weeks. The entire National Capital Area, including WOTR, use Motorola equipment exclusively. There would be potential for compatibility issues that cannot be accounted for until the installation phase if the park went with another make and model. WOTR cannot experience more than

15 minutes of downtime during the conversion to the new equipment. Any more time than that would result in risk to life safety of visitors and employees, which is unacceptable and could result in liability for the NPS.
5. A Determination by the Contracting Officer That the Anticipated Cost to the Government will be fair and reasonable:
Price competition is expected among the multiple DOI FieldCom IDIQ contractors that provide Motorola products. Various parks throughout the National Capital Area have recently purchased similar Motorola equipment the last 18 months, and pricing will be compared to those procurements.
6. Any Other Facts Supporting the Justification:
Any other manufacture's radio equipment, other than these Motorola makes and models, is anticipated to disrupt P25 emergency communications as well as interoperability with other federal and local agencies.
In addition, the new radio equipment must work with existing radios, equipment, and mounting racks.
In short, WOTR requires to procure already proven compatible radios. Due to interoperability, partners and NPS partners having all Motorola equipment – Motorola radios are needed due to the encryption equipment and Advanced Encryption Standards (AES) 256 standards. Buying different brand radio equipment would create a longer than allowable downtime, risk non-interoperability issues, and add an additional $30,000 in costs for mounts, wiring, and software, which would increase the overall risk, scope, and cost of the project.
7. A Statement of the Actions, If Any, the Agency May Take to Remove or Overcome Any Barriers to Competition Before Any Subsequent Acquisition for the Supplies or Services Required:
The expected life cycle of the equipment is 15 years. WOTR will perform market research before the next procurement cycle to investigate new regulations, requirement for interoperability, and industry advances in order to increase competition and meet compatibility requirement.
