About this file
This is a Competition Restriction Justification (CRJ) document for a sole source procurement by the Drug Enforcement Administration's Office of Acquisition on behalf of the Louisville Division. The procurement covers recurring cable television and internet services for DEA offices located in Lexington, London, Louisville, Clarksburg, and Johnson City. The proposed contractor is Charter Communications Operating, LLC, with a period of performance from September 30, 2026 through September 29, 2027. The estimated contract amount is redacted in the document.
The justification cites FAR 6.103-1 (Only One Responsible Source) as the authority for restricting competition. The contracting officer determined that Charter Communications Operating, LLC is the only viable provider because it is the main cable TV provider in these areas, and the only alternative satellite provider is prohibited by property restrictions. In cities with multiple internet providers like Louisville and Lexington, Charter has demonstrated superior service performance. Market research confirmed limited provider options, with Spectrum being the only internet provider in most cities and satellite service unavailable due to building restrictions. A notice of intent to award sole source will be posted to SAM.gov. The agency committed to conducting additional market research to avoid continued noncompetitive acquisitions for this requirement in the future.
