About this file
This document is a Justification for Other Than Full and Open Competition for the Bureau of Land Management (BLM) Alaska State Office, Law Enforcement (OLES) to acquire Winchester branded ammunition. The BLM has a policy requiring the use of Winchester brand ammunition for law enforcement officers, which is the basis for the limited competition. The estimated value of the annual ammunition purchase is $10,834.36, based on the DOI pricing agreement with Winchester. The contracting officer has determined that the pricing is fair and reasonable compared to market prices. No other sources have expressed interest in this requirement, and the BLM has not indicated any plans to change the authorized brand of ammunition. The justification provides the statutory authority, demonstration of unique qualifications, market research, and other details supporting the limited competition.

JUSTIFICATION FOR OTHER THAN
FULL AND OPEN COMPETITION
In accordance with the authority granted under 41 U.S.C. 253(c), this request for award under other than full and open competition is hereby submitted.
1. Identification of the agency and the contracting activity:
Bureau of Land Management, Alaska State Office, Law Enforcement (OLES)
2. Nature and/or description of the action being approved:
Due to the circumstances described below, the BLM Alaska State Office, Law Enforcement (OLES) request the following be acquired using other than full and open competition in support of BLM for Winchester branded ammunition.
3. A description of the supplies or services required to meet the agency’s needs (including the estimated value):
The BLM Instruction Memorandum (IM) Number 2020-021 mandates per Law Enforcement General Order 15 V.A. 4 that Law Enforcement Officers are limited to Winchester brand name only ammunition for duty carry. This policy is in conformance with 446 DM 10.
This requirement is for the annual ammunition purchase for Statewide Law Enforcement
(LE).
The estimated value of this order is $10,834.36. This estimate is based on the published list pricing from the DOI pricing agreement with Winchester Ammunition, Reference #
DOI-27-2023.
4. An identification of the Statutory Authority permitting other than full and open competition:
FAR 6.302-1(c), Only one responsible source and no other suppliers or service will satisfy agency requirements (41 USC 253.c.1), Brand Name
5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited:
We must purchase Winchester Brand Ammunition and no other manufacture’s because we are mandated by agency policy. Winchester Brand Ammunition is the only ammunition allowed for use in our weapons by agency policy.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Federal Acquisition Regulation (FAR) Subpart 5.2, and, if not, which exception under 5.202 applies:
Solicitation is issued as brand name only and many offerors of that brand may submit quotes.
7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable, and the basis for that determination:
The Department of Interior has negotiated a reduced price list with Winchester Ammunition. This pricing is fair and reasonable based on market prices at higher cost.

Local market research and effforts have consistently verified the "national" pricing is the best value and lower prices are not available through alternate sources.
9. Any other facts supporting the use of other than full and open competition FAR 6.303-2(a) (9):
Winchester brand name ammunition, as required by bureau policy, is the only brand authorized by BLM. Until the national bureau alters the authorized price list, only Winchester ammunition can be purchased.
