JUSTIFICATION FOR OTHER THAN

FULL AND OPEN COMPETITION

In accordance with the authority granted under 41 U.S.C. 253(c), this request for award under other than full and open competition is hereby submitted.

1. Identification of the agency and the contracting activity:

Department of the Interior (DOI) Bureau of Land Management (BLM), Alaska State Office 910 Law Enforcement Division (FDO and OLES)

2. Nature and/or description of the action being approved:

This justification supports a procurement action to acquire Yamaha Grizzly 700 EPS XT-R All-Terrain Vehicles (ATVs) through other than full and open competition, under the authority of FAR 6.302-1. The acquisition will supplement the Bureau’s statewide fleet of law enforcement patrol vehicles and support operations such as search and rescue, public land law enforcement, and off-road field duties in remote terrain.

3. A description of the supplies or services required to meet the agency’s needs (including the estimated value):

The supplies to be procured consist of two (2) Yamaha Grizzly 700 EPS XT-R ATVs, including all standard safety and operational features required for federal law enforcement missions. Estimated unit cost is $_____, with pricing based on quotes from local authorized vendors.

4. An identification of the Statutory Authority permitting other than full and open competition:

The referenced model above is the only machine that meets all required specifications, satisfies safety and operational performance standards, and falls within the acceptable price range.

This determination is made in accordance with 41 U.S.C. 253(c)(1), as implemented by 41 USC 3304(a)(1) and FAR 6.302-1, “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”

5. A demonstration that the proposed brand name possesses unique qualifications, or the nature of the acquisition requires use of the authority cited:

Extensive market research was conducted to evaluate available ATV models based on mission-specific criteria, including size, power, safety, load/tow capacity, reliability, and compatibility with existing infrastructure. The Yamaha Grizzly 700 EPS XT-R is uniquely suited to the agency’s operational needs for the following reasons:

• Fleet Compatibility: This model is currently in use across the BLM Alaska Law Enforcement Division, supporting uniformity in training, operation, and maintenance.

• Storage and Transport Efficiency: Existing storage facilities and transport trailers are specifically configured to the dimensions of this ATV, avoiding costly infrastructure changes.

• Enhanced Safety Features: Includes 4-wheel hydraulic disc brakes, advanced suspension, and lighter weight for improved maneuverability and braking performance.

• Operational Capability: The machine is equipped with a 686cc engine, power steering, locking differential, high ground clearance, factory-installed winch, and towing capability, thus making it ideal for law enforcement patrol, rescues, and rugged terrain use.

• Mission-Critical Design: Proven effective in law enforcement, field evidence handling, tactical gear transport, and immediate response scenarios.

• Repair and Service Facilities: The state has multiple vendors and shops available that are authorized to service and repair the specific ATV model, where other similar machines may not be serviceable in the local area.

While pricing is competitive with less capable models, this ATV provides greater value due to its integrated features and reduced need for aftermarket modifications.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Federal Acquisition Regulation (FAR) Subpart 5.2, and, if not, which exception under

5.202 applies:

Although this action is for a brand-name product, vendor quotations were requested from multiple authorized Yamaha dealers in the local area to ensure best pricing. In addition, the following steps were taken to promote broader competition:

• Conducted market research through manufacturer websites, GSA Advantage, and industry publications.

• Reviewed specifications of comparable models from multiple manufacturers.

• Evaluated past purchase records and performance data from previous field deployments.

Vendors remain eligible to submit bids, provided they are authorized to sell the specified model and can meet delivery and service requirements.

7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable, and the basis for that determination:

Pricing for the Yamaha Grizzly 700 EPS XT-R was evaluated against similar models and prior purchases. The estimated unit price of $______ is consistent with previous acquisitions and falls within the expected market range for ATVs of comparable capability and performance. The built-in features of this model, such as winch, EPS, and 4WD system, make it more cost-effective than upgrading lower-tier models through aftermarket modifications.

8. A description of the market research conducted (FAR Part 10) and the results or a statement of the reason market research was not conducted:

Market research included a review of specifications, pricing, and availability from various ATV manufacturers, such as Polaris, Can-Am, and Honda. These models were evaluated against BLM’s operational requirements, but no alternative matched the full combination of:

• Dimensions compatible with agency trailers and storage units

• Necessary safety and drivetrain features

• Field-tested durability in Alaska terrain

• Operator familiarity for mission-critical response

Only the Yamaha Grizzly 700 EPS XT-R met all evaluation criteria.

9. Any other facts supporting the use of other than full and open competition FAR 6.303-2(a) (9):

The use of this specific model supports operational consistency across the OHV fleet, reducing training time and enabling seamless vehicle sharing between districts and officers during emergency operations. This ATV is also widely supported by local service providers throughout the state, minimizing downtime and maintenance delays.

The Yamaha Grizzly 700 EPS XT-R is uniquely qualified to meet the operational requirements of the Bureau of Land Management and law enforcement missions due to its combination of technical specifications, safety features, and field-proven reliability. The vehicle’s capabilities make it especially well-suited for demanding environments such as those encountered by the Bureau of Land Management (BLM), particularly in remote, rugged, or otherwise inaccessible terrain.

10. A listing of sources, if any, that expressed an interest in the acquisition:

None listed or noted.

11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required:

To promote competition in future acquisitions, the agency will:

• Continue market surveillance to assess emerging ATV models and capabilities

• Re-evaluate technical specifications to identify opportunities for broader competition

• Issue Requests for Information (RFIs) or sources sought notices ahead of future procurements

• Engage with a broader vendor base and industry representatives through outreach and forums

• Review the long-term cost-benefit of fleet standardization vs. introducing multiple models

These efforts will help ensure future purchases are aligned with competition requirements wherever practicable.
