About this file

This document is a Justification for Sole Source Procurement under $150,000 for the publication of a Supplement Issue of Pediatrics in the Journal of Pediatrics published by the American Academy of Pediatrics.

The Centers for Disease Control and Prevention intends to award a sole source firm fixed price purchase order to the American Academy of Pediatrics for the copy editing, review/approval, and online publishing of pediatric scientific manuscripts related to lead exposure and prevention. The justification states that Pediatrics is the only journal capable of providing the required level of scientific quality and broad dissemination to pediatricians, clinical staff, and public health departments. The total estimated procurement amount is not provided. The government is soliciting and negotiating with only one source under FAR 13.106-1(b) and 10 U.S.C. 2304(c)(1) authorities. Interested parties may respond within 5 days to potentially compete the requirement, but the government has sole discretion in determining whether to conduct a competitive procurement.

Justification:

1. The justification for this non-competitive action is: (NOTE: Must select only ONE of the listed justifications for other than full and open competition and fully support the justification in the following paragraphs. Please delete this note prior to submitting the justification.)

☒ In accordance with FAR 13.106-1(b)(1), “only one source [is] reasonably available” which states that, “For purchases not exceeding the simplified acquisition threshold. (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). (ii) Where a single source is identified to provide a portion of a purchase because that portion of the purchase specifies a particular brand-name item, the documentation in paragraph (b)(1)(i) of this section only applies to the portion of the purchase requiring brand-name item. The documentation should state it is covering only the portion of the acquisition which is brand- name.”

☐ Urgency ☐ Exclusive licensing agreements/Proprietary data ☐ Brand name required ☐ Industrial mobilization ☒ Other (e.g., compatibility, space issues, continuity, compatibility, etc.)

☐ In accordance with FAR 8.405-6 “Limiting Sources” which states that, “the only circumstances that may justify the action are – (A) An urgent and compelling need exists, and following the procedures would result in unacceptable delays; (B) Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; or (C) In the interest of economy and efficiency, the new work is a logical follow-up to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original BPA must not have been previously issued under sole-source or limited-sources procedures.”

☐ Urgency ☐ Only One Source ☐ Logical Follow Up

2. Other facts supporting sole source procurement:

a. What can this product/service do that other products/services cannot do?

Pediatrics is an official peer-reviewed journal of the American Academy of Pediatrics (AAP). It has been continuously published by the AAP since January 1948. Only AAP (the publisher of the journal) is capable of providing access to pediatricians, clinical staff and public health departments to acquire research and program manuscripts at the level of scientific quality and for the level of broad dissemination required. Evidence includes Pediatrics perspectives covers the needs of the whole child, including physiology, mental health, emotional needs and social structure. Pediatrics has one of the highest impact factors (7.124) in the 2021 Journal Citation Report (from Thomson Reuters). The journal is one of the top 100 most-cited journals in all of science and medicine. Pediatrics is indexed by major biomedical and scientific indices, including Medline/PubMed, and ISI (Thompson). It is also a leading pediatric journal in Eigenfactor (.0.09206) and Cite Score (9.6) studies. Circulation: 67,000Current Impact Factor: 8.0 Citations:90,117. The journal is specifically suited for covering topics related to lead

Rev. 1/6/14 exposure and lead exposure prevention and has a history of publishing timely research, case reports and policy manuscripts regarding lead exposure in children desired for the content of the supplement.

b. What other products/services were considered and why did they not meet the need?

We considered other journals such as the Journal of Pediatrics and Pediatrics Research but the Pediatrics has greater visibility, impact and reach for our important topic. Neither journal has the impact factor we sought for this important project.

Journal of Pediatrics impact factor is 5.2 and Pediatric Research impact factor is 3.7.

Publication in these journal would not have the public health impact we desired for lead exposure prevention in children.

3. Program Office efforts to seek potential offerors:

We explored the possibility of publishing our supplement in the Journal of Pediatrics but their approval processes for producing supplements did not work for our time frame, cost limitations and logistical concerns. We could not locate information regarding producing supplements in Pediatrics Research.

D. Program Office Certification:

I have reviewed this sole source justification and certify the justification is true and accurate to the best of my knowledge and adequate to support other than full and open competition.
