About this file

This document is a Justification for Sole Source Procurement under $250,000 for the HL7 Gravity Project Membership. The Centers for Disease Control and Prevention (CDC) Office of Public Health Data, Surveillance, and Technology plans to award a sole source order to Health Level Seven International for approximately $25,000 to sponsor the HL7 Gravity Project, which develops consensus-based data standards to improve the use and sharing of social determinants of health information using HL7's FHIR standards. The justification cites the project's uniqueness and ability to support CDC's health equity and interoperability initiatives as the reasons for sole source procurement under FAR 13.106-1(b) and FAR 8.405-6. The CDC will review any responses from interested vendors for their capability to meet the requirement before making a final decision on a competitive procurement. Responses are due by July 16, 2024.

☒ In accordance with FAR 13.106-1(b)(1), “only one source [is] reasonably available” which states that, “For purchases not exceeding the simplified acquisition threshold. (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). (ii) Where a single source is identified to provide a portion of a purchase because that portion of the purchase specifies a particular brand-name item, the documentation in paragraph (b)(1)(i) of this section only applies to the portion of the purchase requiring brand-name item. The documentation should state it is covering only the portion of the acquisition which is brand- name.”

☐ Urgency ☐ Exclusive licensing agreements/Proprietary data ☒ Brand name required ☐ Industrial mobilization ☐ Other (e.g., compatibility, space issues, continuity, compatibility, etc.)

☐ In accordance with FAR 8.405-6 “Limiting Sources” which states that, “the only circumstances that may justify the action are – (A) An urgent and compelling need exists, and following the procedures would result in unacceptable delays; (B) Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; or (C) In the interest of economy and efficiency, the new work is a logical follow-up to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original BPA must not have been previously issued under sole-source or limited-sources procedures.”

☐ Urgency ☐ Only One Source ☐ Logical Follow Up ☐ Brand name required

2. Other facts supporting sole source procurement:

a. What can this product/service do that other products/services cannot do?

The HL7 Gravity Project is the only known national public collaborative of multisector organizations created to develop consensus-based data standards to improve how health information on social determinants of health (SDOH) are used use and shared using HL7’s FHIR standards. FHIR standards are anticipated to be the accepted and nationally shared health information exchange mechanism. The project’s goal is to advance health and social data standardization to improve health equity. As a sponsoring member of this Project, OPDHST will provide input and guidance on health equity and interoperability strategy that support SDOH through FHIR standards and determinants. The SDOH and health-related social needs focused FHIR coding/terminology standards and implementation guides developed and implemented by the HL7 Gravity Project will impact CDC programs by directly guiding the collection and reporting of Social Determinants of Health (SDOH) data across the United States. This includes CDC prioritized and critical public health modernization initiatives and projects aimed at enabling health record exchange, such as TEFCA.

For this reason, multiple federal agencies are already involved in the Gravity Project.

b. What other products/services were considered and why did they not meet the need?

Rev. 5/14/19

No other products were considered since no other vendors provide a health information data exchange suite of standards that are as widely accepted as a secure means to exchanged health information, nor are there similar projects related to HL7 FHIR standards and social determinants of health (SDOH) with other vendors.
