About this file
This document provides a justification for a sole source procurement by the Centers for Disease Control and Prevention. The CDC's Office of Emergency Management within the Agency for Toxic Substances and Disease Registry is seeking to procure expertise from Grady Memorial Hospital Corporation, doing business as the Georgia Poison Center, for $199,824. The justification cites an urgency and need for continuity given that the Georgia Poison Center previously conducted a workshop with local stakeholders in Atlanta on developing an Antidote Response Network pilot, and is the only organization capable of housing and utilizing an antidote inventory system for chemical incidents. No other potential offerors were considered given the specialized expertise required regarding antidote inventory data and the CHEMPACK program held by the Georgia Poison Center.

1. The justification for this non-competitive action is:
☒ In accordance with FAR 13.106-1(b)(1), “only one source [is] reasonably available” which states that, “For purchases not exceeding the simplified acquisition threshold. (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). (ii) Where a single source is identified to provide a portion of a purchase because that portion of the purchase specifies a particular brand-name item, the documentation in paragraph (b)(1)(i) of this section only applies to the portion of the purchase requiring brand-name item. The documentation should state it is covering only the portion of the acquisition which is brand- name.”
· Urgency
· Exclusive licensing agreements/Proprietary data
· Brand name required
· Industrial mobilization ☒ Other (e.g., compatibility, space issues, continuity, compatibility, etc.)
· In accordance with FAR 8.405-6 “Limiting Sources” which states that, “the only circumstances that may justify the action are – (A) An urgent and compelling need exists, and following the procedures would result in unacceptable delays; (B) Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; or (C) In the interest of economy and efficiency, the new work is a logical follow-up to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original BPA must not have been previously issued under sole-source or limited-sources procedures.”
· Urgency
· Only One Source
· Logical Follow Up
· Brand name required
2. Other facts supporting sole source procurement:
a. What can this product/service do that other products/services cannot do?
Through a previously funded project, CDC/ATSDR conducted a workshop with potential stakeholders local to Atlanta, Georgia on March 13, 2020. Stakeholders included management and/or directors from Grady Hospital Pharmacy, Piedmont Hospital Pharmacy, Wellstar Hospital Pharmacy, Emory Hospital Pharmacy, Walmart Pharmacy. Kroger Pharmacy, Dekalb Department of Public Health, and Georgia Poison Control Center. These stakeholders committed to piloting the first Antidote Response Network.
This is why the pilot must be conducted in Georgia with the Georgia Poison Center; otherwise, we would need to develop relationships with stakeholders in another state and spend additional time, money, and resources to repeat the workshop process.
The Georgia Poison Center is a professional, non-profit association housed at the Grady Health System and operates under the supervision of Emory University School of Medicine. The GPC is accredited as a Regional Poison Center by the American Association of Poison Control Centers (AAPCC). Georgia Poison Center manages the CHEMPACK program for situations in GA where the local entity does not have ready
Rev. 5/14/19 access to CHEMPACKs and has been doing this in partnership with the Georgia’s Department of Public Health Division of Emergency Preparedness for more than 25 years. The CHEMPACK program is an initiative of the Strategic National Stockpile program that provides antidotes to nerve agents for pre-positioning by State, local, and/or tribal officials throughout the United States. Information about and a similar process to the CHEMPACK program is required for development of an Antidote Response Network. Fire Departments, EMTs and HAZMAT teams, who do not have ready access to CHEMPACKs, consult with Georgia Poison Center, and they coordinate movement of the assets to the area of need.
This is very similar to how the Antidote Response Network will work for other antidotes of critical need. Therefore, GA Poison Center is the only organization that can house and utilize a system with antidote inventory information and utilize it in a chemical incident where antidotes need to be urgently moved from the pharmacy to the area of need.
b. What other products/services were considered and why did they not meet the need? No other products were considered because this software data system requires the expertise and knowledge of the GA Poison Center.
3. Program Office efforts to seek potential offerors:
This is the premier entity for this subject area. Therefore, there isn’t a need to seek other potential offerors. CDC would like to ensure that antidote inventory data is handled by only the agency that uses this information and has the expertise to understand the content. Seeking other offerors could risk security of antidote inventory and location information. As a result, other offerors were not sought.
