JUSTIFICATION FOR SOLE SOURCE PROCUREMENT (OPEN MARKET OR GSA)
UNDER $250,000
Sole source acquisitions may be used on a limited basis and only when the Representative (COR)/Program Official has provided sufficient justification and the Contracting Officer has determined that the circumstances warrant such action. The content for a justification must contain detailed facts and rationale to justify the sole source acquisition. Soliciting from a single source must be done in accordance with FAR 13.106-1(b) or 8.405-6. At a minimum, the following information must be included:

Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). (ii) Where a single source is identified to provide a portion of a purchase because that portion of the purchase specifies a particular brand-name item, the documentation in paragraph (b)(1)(i) of this section only applies to the portion of the purchase requiring brand-name item. 2. Other facts supporting sole source procurement:
a. What can this product/service do that other products/services cannot do?
The Agilent Oligo Pro II system delivers accurate purity assessments of ssDNA and ssRNA oligonucleotides without the use of dyes. Oligo Pro operation simplifies the measurement of oligonucleotide purity. This instrument features: a) Fast separations - Complete 12, 24, or 96 samples in about 1 hour Improve product quality b) Monitor synthesis performance to demonstrate purity of ssDNA. Wide sizing range c) Achieve single base resolution through 60-mers Throughput for all labs d) Variable throughput with the option of 12, 24, or 96 capillary arrays e) Direct detection of oligos - No dye labeling needed, uses UV detection f) Simplified report generation - Advanced peak integration software and data reporting capabilities.
b. What other products/services were considered and why did they not meet the need?
We also considered Sierra Biosystems Shasta 96/192 and Promega. Though they detect oligo purity in the sample separations as Oligo Pro II. Their software is not user friendly as Oligo Pro II. The Agilent Oligo Pro II is a known system with a strong track record of producing high quality separation of

This vendor has a unique understanding of the instrument, and its setup needs and operations and provides excellent and fast support for their instruments.
3. Program Office efforts to seek potential offerors:
We did thorough research on google.com and examining company websites and brochures.
There are other companies in market like Sierra Biosystems and Promega, that measure oligonucleotide purity. As mentioned earlier, preparing the samples is easy on Agilent Oligo Pro II compared to other vendors and software is user friendly. In addition, there are already several units of an older model in the lab, which means the lab staff already knows how to operate the instrument so no further training of personnel is required and there will be no delay in getting the new instrument operating.
