4. Authority:
FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold (SAT), only one source reasonably available, urgency, exclusive licensing agreements, brand name, or industrial mobilization.
5. Reasons for Authority Cited:
L3Harris (L-3 and Harris merged on 1 July) is the only manufacturer of the subject capability. The reason is that the modem is part of the RF chain of components (everything from the antenna to the data output of the modem), and therefore it is part of the ARSTRAT certification that is required to operate satellite terminals on the government WGS satellite system. Any change in any component of that RF chain of components invalidates the ARSTRAT certification.
The newly obtained equipment will be fully compatible with existing equipment; not included as part of this sole source justification, but necessary to the SATCOM system as a whole. To ensure future Satellite mission success, we must acquire items that are compatible with the distant end. Specifically, EBEM with ESIM module and iDirect9350.
The reason for the sole source justification is that the SATCOM Modems (iDirect and EBEM) on the distant end at the DISA STEP site are the same brand/models. The user must have the same routers on both ends for them to communicate due to the specific proprietary design of the brands and how they modulate the Radio Frequency (RF) signal. If the RF modulation is not the exact same on both ends, the signal cannot be de-modulated properly, and the data cannot be retrieved.
The action should be completed for sole source only for iDirect 9350 and EBEM w/ESIM in a ruggedized case. Unique features include: selectable adaptive coding and modulation mode, AES-256 bulk encryption of all over-the-air data eliminating the need for a separate inline network encryptor, automated session key generation and distribution/seamless session key rollover and self-synchronization, seamless and low-delay antenna handover capabilities in tactical configuration, performance in Ka-band shipboard Doppler environments, monitor status of distant/remote EBEM modem, and adaptive equalization. All of these features are required for any satellite modem to be able to maintain a satellite communications lock with the DISA teleport site, which serves as the sole access point through which US joint forces connect to receive network services.
6. Publicizing Contract Actions: For FAR Part 13 actions, the public display and synopsis requirements of FAR 5.101 and FAR 5.203 do not apply due to the $ threshold, apply and will be followed, or do not apply due to an exception at FAR 5.202(13)(i).
Requirement to post justification in accordance with FAR 8.405-6(b)(3), FAR 13.105(c), or FAR 16.505(a)(4)(iii)(A)
Action is NOT a brand name restriction and is under $150K, no posting required Action is a brand name restriction, under $25K, no posting required Action is a brand name restriction, over $25K. It will be redacted and posted with the solicitation.
Action is a brand name restriction over $25K but will not be posted due to exception:
FAR 6.305(f) FAR 8.405-6(b)(3)(iii)(A)
FAR 8.405-6(b)(3)(iii)(B) FAR 8.405-6(b)(3)(iii)(C) FAR 16.505(a)(4)(iii(C)
7. Market Research: Obtained source lists of similar items from other contracting activities or agencies, trade associations or other sources, but none of them meet targeted SATCOM requirements. Equipment and logical/physical features were researched for product literature availability, feature availability, and service availability, and can only be fulfill by L3Harris.
8. Other Facts: N/A
9. Technical/Requirements Certification: I certify that the supporting data under my cognizance which are included in the justification are accurate and complete to the best of my knowledge and belief.
I hereby determine that the anticipated cost or price to the Government for this contract action will be fair and reasonable based upon comparison of previously proposed Government contract (W91QVN-19-P-0140).
I certify that this justification is accurate and complete to the best of my knowledge and belief, and that completing this purchase as a sole source is in the best interest of the Government. Additionally, I approve this justification to limit competition subject to the availability of funds and provided that the services or supplies herein described have otherwise been authorized for acquisition.
