This is a combined synopsis/solicitation for commercial services prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. The solicitation number for this requirement is W912P8-20-Q-0033 and is hereby issued as a Request for Quote (RFQ) for Pest Control Services. This requirement is being solicited as a set aside for Woman Own Small Business (WOSB). The North American Industry Classification System Code (NAICS) is 561710, Exterminating & Pest Control Services with a Small Business Size Standard of $12,000,000.00.

The basis of award will be Lowest Priced Offeror. Additionally, offerors must quote on all items to be eligible for award. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation.

The work consists of the contractor shall provide all management, labor, tools, supplies, equipment, materials, transportation, fuel, chemical solutions/toxic gases, poisonous paste, bait and mechanical traps to eliminate pest that infest buildings and surrounding areas within the New Orleans District Headquarters Reservation. The service to be provided by the contractor shall eradicate such pests as roaches, spiders, fleas, lice, mice, rats, ants, wasps, and flying insects and termites. Complete control of pests must be maintained during the entire period of performance of the contract.

Offerors please provide requested pricing to include monthly and yearly total.

52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days (insert the period of time within which the Contracting Officer may exercise the option). 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 15 days ; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 31 May 2025. (End of clause)

52.222-42 STATEMENT OF EQUIVALENT RATES FOR FEDERAL HIRES (MAY

2014)

In compliance with the Service Contract Labor Standards statute and the regulations of the Secretary of Labor (29 CFR part 4), this clause identifies the classes of service employees expected to be employed under the contract and states the wages and fringe benefits payable to each if they were employed by the contracting agency subject to the provisions of 5 U.S.C. 5341 or 5332.

52.243-1 CHANGES--FIXED-PRICE (AUG 1987) - ALTERNATE I (APR 1984)

(a) The Contracting Officer may at any time, by written order, and without notice to the sureties, if any, make changes within the general scope of this contract in any one or more of the following:

(1) Description of services to be performed.

(2) Time of performance (i.e., hours of the day, days of the week, etc.).

(3) Place of performance of the services.

(b) If any such change causes an increase or decrease in the cost of, or the time required for, performance of any part of the work under this contract, whether or not changed by the order, the Contracting Officer shall make an equitable adjustment in the contract price, the delivery schedule, or both, and shall modify the contract.

(c) The Contractor must assert its right to an adjustment under this clause within 30 days from the date of receipt of the written order. However, if the Contracting Officer decides that the facts justify it, the Contracting Officer may receive and act upon a proposal submitted before final payment of the contract.

(d) If the Contractor’s proposal includes the cost of property made obsolete or excess by the change, the Contracting Officer shall have the right to prescribe the manner of the disposition of the property.

(e) Failure to agree to any adjustment shall be a dispute under the Disputes clause. However, nothing in this clause shall excuse the Contractor from proceeding with the contract as changed.

PERFORMANCE BASED WORK STATEMENT

USACE New Orleans District

Description of Services:

The contractor shall provide all management, labor, tools, supplies, equipment, materials, transportation, fuel, chemical solutions/toxic gases, poisonous paste, bait and mechanical traps to eliminate pest that infest buildings and surrounding areas within the New Orleans District Headquarters Reservation. The service to be provided by the contractor shall eradicate such pest as roaches, spiders, fleas, lice, mice, rats, ants, wasps, and flying insects and termites. Complete control of pests must be maintained during the period of contract.

1. Area to be serviced:

a. Pest control services will be performed in and around all buildings on the district reservation.

b. District Headquarters Building #830; 382,3347 sq ft

c. Building #788m, electronics repair building 1,536 sq ft

d. Building #748, Survey warehouse and mail room 2,825 sq ft

e. Building #816, district warehouse, 33,889 sq ft

f. Building #817, District Shops building 33,776 sq ft

g. Child Develop Center 7,972 sq ft

h. Special Areas in building #830 and CDC – Cafeterias

i. Special area outside of building – Child Development Center Pay Yards

j. Included in the areas, for the purpose of ant, spiders, roaches, mice, rats, and flea control are the grounds immediately adjacent to the buildings.

2. Safety:

a. The contract shall comply with all federal, state, and local laws pertaining to the storage, use, and disposal of chemicals use in the execution of this contract. All chemicals are to be used only in accordance with the manufacturer's instructions. The contractor must also abide by the provisions of EM 386-1-l, "Corps of Engineers Safety and Health Requirements Manual" latest addition, during the contract period.

b. Prior to commencing work on this contract, the contractor will provide the Corps of engineers' Safety and Occupational Office and the Facilities Office with a complete binder containing all MSDS information sheets on all chemicals to be used. The information on the chemicals must include, but not limited to, application methods, precautions to be taken, effects of exposure, treatment, and phone number to use to obtain more information on the chemical.

i. The contractor must maintain these binders and update as required any time a new chemical is used or a data sheet is revised. At a minimum the binders are to be reviewed by the contractor once bi-annually for possible updates and corrections.

c. All mechanical traps must be of the type to insure the safety of personnel in the area from coming in contract with the working portions of the trap.

d. The contractor shall be licensed and bonded by the State of Louisiana, and shall provide a copy of the current license and bond as required by State of Louisiana to the contracting officer upon contract award.

e. The contractor will, without additional cost to the government, be responsible for obtaining any and all necessary licenses and permits and for complying with all applicable federal, state or local laws, codes or ordinances, in connection with the performance of the service under of this contract.

3. Time of Service:

a. Pest control services, in all specified buildings and adjacent grounds, will be rendered both weekly and monthly. Weekly (Friday except if district is close) areas of concern will be specified by the facilities department and they will provide a list of infested areas and pest sightings. All buildings and adjacent grounds will be treated regardless of pest infestations on a monthly basis. All pest control services must be coordinated with the COR to alleviate any inconvenience within the employee's work environment and to assure the safety, health & sensitivity of employees are respected.

i. Mechanical stations for rats and mice must be cleaned and checked during each visit of a contractor's representative.

b. Hours of Work: The Corps Hours are Monday through Friday from 0700 until 1600 hours. Contractor can extend his hours of work beyond the daily Corps hours to include Saturday and Sunday work in order to meet the time requirements to complete work. Actual hours of work must have the approval of the US Army Corps of Engineers Representative to whom will be designated to the awardee with notice to proceed.

c. Anytime a contractor’s representative is on the district they must report to facilities office when they arrive and before they leave the district.

d. The cafeteria will be treated weekly (Friday) for pest to include the placement of pest hotels, etc., when and where required. The cafeteria will be totally treated for pest control every

3 months.

i. If fogging is used in the process the contractor will seal all air return vents to prevent the chemical fog from entering the air return system.

4. Payment:

Payments will be made on a monthly basis at a constant rate after completion of pest control service for that month. Along with the finance center the contractor should supply one copy of the invoice to the COR of the contract each month. 5. On-Premises Requirements:

Contractor employees are required to adhere to all Corps' rules in regards to working at our Facility. They must stop at the gate and identify themselves, and tell the guard the specific location they will be working. A temporary badge maybe issued by the Security Officer if deemed necessary by the Security office.

6. Access and General Protection/Security Policy and Procedures.

This standard language text is for contractor employees with an area of performance within an Army controlled installation, facility or area. Per Homeland Security Presidential Directive-12 (HSPD-12), Access Cards are required for contractors working six months or more; background investigations are required prior to access card issuance. Un-cleared contractors working less than six months must submit to a background check, via the Security Office, and must abide by applicable identification and access control requirements. Proposed language: "All contractor and all associated sub-contractors employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks or background investigation and to meet installation/facility access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any installation or facility change, the Government may require changes in contractor security matters or processes."

7. Suspicious Activity Reporting Training

(e.g. iWATCH, Corps Watch, or See Something, Say Something). This standard language is for contractor employees with an area of performance within an Army controlled installation, facility or area. Proposed language: "The contractor and all associated sub- contractors shall receive a brief/training (provided by the RA) on the local suspicious activity reporting program.

This locally developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the project manager, security representative or law enforcement entity. This training shall be completed within 30 calendar days of contract award and within 30 calendar days of new employees commencing performance with the results reported to the COR NLT 5 calendar days after the completion of the training."

8. Pre-screen candidates using E-Verify Program. Proposed language:

"The Contractor must pre-screen Candidates using the E-verify Program (http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible Candidates must be provided to the COR no later than 3 business days after the initial contract award." *When contracts are with individuals, the individuals will be required to complete a Form I-9, Employment Eligibility Verification, with the designated Government representative. This Form will be provided to the Contracting Officer and shall become part of the official contract file.

9. Supervision of Work:

The Contractor shall provide all management, supervision, and labor to effectively fulfill the requirements of this contract. The Contractor will ensure that all contract work is satisfactorily supervised, either by his personal presence, by the on-site supervisor, or a combination of these alternatives. Neither US Army Corps of Engineer employees nor other Government employees are authorized to exercise either direct or indirect supervision over, or provide direction to, the Contractor's employees. Contractor should refer all to the assigned government representative.

NOTE: Contractor shall not perform any work outside the SOW without prior approval from the Contracting Officer.

10. Inspection:

a. The government shall inspect the contractors’ work for contract compliance, during and after completion of work. The contractor shall not be paid for any work until an inspection has been performed by a Government inspector to assure work meets specifications contained in contract.

b. The Government has the right to inspect and test all work called for by this contract to the extent practicable at all times and places during the contract. The government shall perform inspections and tests in a manner that will not unduly delay the work.

c. If any of the work does not conform to contract requirements, the Government may require the Contractor to redo work at no increase in contract amount. When defects in workmanship cannot be corrected by re-performance, the Government may reduce the contract price to reflect the reduced value of work accomplished.

d. If the Contractor fails to promptly fulfill his contract responsibilities, the Government may

(1) by contract or otherwise, perform the work and charge to the Contractor for any cost incurred the Government that is directly related to the performance of such work or

(2) Terminate the contract for default.

11. Treatment For:

Native Subterranean termites-Reticulitermes and Formosan Termites-Coptotermes Native Subterranean Termites-Reticulitermes and Formosan Termites-Coptotermes Other (Specify) Drywood Termites-Kalotermes and Cryptotermes Powder Post Beetles-Lyctidae, Bostrichidae, Anobiidae.

12. THE COMPANY AND CUSTOMER AGREE TO THE FOLLOWING TERMS

AND CONDITIONS:

a. PERFORMING THE WORK

The Company agrees to treat the building(s) yearly in complete compliance with applicable laws, rules and regulations of the Louisiana Structural Pest Control Commission and to inspect the property annually prior to the expiration of this agreement. The Company will exercise care while performing any work hereunder to try to avoid damaging any part of the property, plants or animals. Under no circumstances or conditions shall the Company be responsible for damage caused by the Company at the time the work is performed except those damages resulting from gross negligence on the part of the Company.

b. INFESTATION

Should an active infestation (meaning the presence of live insects) of the wood destroying insects covered by this agreement occur in any portion of the building(s) covered by this agreement, the Company agrees to treat such infested portions within thirty (15) days of discovery of such infestation at the Customer’s request at no additional charge to the Customer, except as otherwise noted within this agreement.

c. COPTOTERMES (FORMOSAN TERMITES)

To obtain control of Formosan termites it may be necessary to have walls, ceilings, and other parts of the structure dismantled in order to locate and destroy the infestation. Fumigation may be necessary to obtain control where the removal of the infestation is not possible or aerial infestation is probable. The Customer warrants full cooperation and is responsible for any additional costs associated with dismantling and/or fumigation, which may be necessary should soil treatment alone be ineffective.

d. DRY-WOOD TERMITES: (Kalotermes and Cryptotermes), POWDER POST BEETLES (Lyctidae, Bostrichidae, Anobiidae) or OTHER WOOD-BORING INSECTS. If these insects are covered by this agreement, the Company cannot be held liable for any damage to the structure or its contents caused by these insects since fumigants used to treat a property for control of these insects are non-residual and any liquid treatments which may be applied are only spot treatments.

e. CONDITIONS CONDUCTIVE TO INFESTATION

The Customer warrants full cooperation with the Company during the term of this agreement, and agrees to maintain

f. MATERIALS & SUPPLIES: The contractor is responsible for providing all equipment, materials, supplies and labor to complete this work.

13. SAFETY:

Before contractor start work, he must provide an accident prevention plan to have on file. MVN Form 10-1, MVN Form 10, and MVN Form 10-3 will be given to the COR. During the service process the contractor shall abide, at all times, by the US Army Corps of Engineers, current Safety and Health Requirements Manual EM 385-1-1. The contractor, will during the service process, be inspected by the District’s Safety Officer or members from his office for compliance with the Safety Manual. The Contractor shall coordinate all work and notify the government of any adverse impacts to the environment of the area under construction. Contractor shall protect our employees who may visit the area from being exposed to safety hazards. Contractor shall place protective barriers around the service are.

14. FEDERAL, STATE AND CITY BUILDING CODE REQUIREMENTS: The contractor will follow the guidelines of standard building and mechanical codes including the current National Electrical code. Any materials and supplies purchased for this service must meet current commercial standards for type of work being accomplished.

15. QUALITY AND WORKMENSHIP: All work shall meet acceptable building standards for of our building, and meet all Federal and State safety codes for this type work.

16. INSPECTION AND ACCEPTANCE:

Government Representatives, to be appointed at award, will inspect work for compliance to specifications.
