LSJ No.: XXX
This acquisition is conducted under the authority of the Multiple-Award Schedule Program, 41 U.S.C. 152(3), Competitive Procedures, and 40 U.S.C. 501, Services for Executive Agencies.
1. Agency and Contracting Activity.
The Department of Homeland Security (DHS), Federal Emergency Management Agency (FEMA), Federal Insurance and Mitigation Administration (FIMA) proposes to award an order pursuant to FAR 8.405-6(a), Limiting Sources.
2. Nature and/or description of the action being approved.
FEMA/FIMA intends to limit the number of sources solicited pursuant to FAR Part 8.405- 6(a) for the procurement of services to deliver a high quality, FIMA-specific mentoring program to The Training Connection, 4004 Genesee Place, Suite 109, Prince William, VA 22192.
3. Description of Supplies/Services
This requirement is to provide program and project management activities to deliver a high-quality, FIMA-specific mentoring program. The Training Connection will provide expertise and program management support for a FIMA-wide, formal mentoring program to provide resources for employees at all organizational levels to connect with seasoned mentors, achieve their professional goals, build stronger networks, and enhance their skills and knowledge.

4. Authority and supporting rationale.
8.405-6(a)(1)(i)(C) In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order must not have been previously issued under sole-source or limited-sources procedures.

This acquisition is being conducted under the authority of the Multiple-Award Schedule Program, 41 U.S.C. 152(3), Competitive Procedures, and 40 U.S.C. 501, Services for Executive Agencies, in accordance with FAR 8.405-6(a), Limiting Sources. An award will be made in the interest of economy and efficiency as a logical follow-on to an original Federal Supply Schedule order, #GS-02F-0120R 70FA6019F00000049, pursuant to FAR 8.405-6(a)(1)(i)(C). The original award was competitively solicited on GSA and awarded using the ordering procedures at FAR 8.405. It is necessary to limit competition for new work because The Training Connection is currently supporting the FEMA/FIMA pilot mentoring program contract. All elements of this program are customized to FEMA’s requirement including the mentoring program’s web-based software platform. The web-based software is proprietary. Therefore, issuing this contract to The Training Connection is in the best interest of the Government to prevent any potential adverse impact to the FIMA-wide mentoring program, including duplication of costs or disruption of the work presently being performed. The Training Connection is uniquely qualified to provide the necessary support without extensive transition to manage the ongoing services.
5. Determination by the ordering activity contracting officer that the anticipated order represents the best value consistent with FAR 8.404(d).
The Contracting Officer has determined that issuing the proposed Task Order to The Training Connection to deliver a high quality, FIMA-specific mentoring program represents the best value and will result in the lowest overall cost, considering price and administrative costs, to meet the Government’s needs. This order will be placed in accordance with FAR 8.404, “Use of Federal Supply Schedules.” The General Services Administration (GSA) has already negotiated fair and reasonable pricing rates. Discounts to these GSA schedule rates will be requested. Additionally, prior to issuing the task order, the ordering activity will consider the proposed level of effort and labor mix required for performing the specific tasks needed in order to determine the total price is reasonable. The contractor’s labor mix and level of effort will also be compared to the Independent Government Cost Estimate (IGCE).
6. A description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted.
Market research was conducted with several schedule holders; however, none of the vendors available under the FSS for SIN 70 can provide a mentoring program comparable to The Training Connection pilot and using the same software and materials. FEMA/FIMA would have to use a new vendor, which would not have the same proprietary software, and pay for a second mentoring program pilot.
7. Any other facts supporting the limited-sources justification. N/A http://uscode.house.gov/

8. A statement of actions, if any, the agency may take to remove or overcome any barriers that led to restricted consideration (i.e., limited sources) before any subsequent acquisition for the supplies or services is made. Include a statement of actions taken or that will be taken to increase competition for future acquisitions of the same item/service (e.g., the government intends to revise overly restrictive technical specifications, acquire data rights, or pursue some other means to increase future competition).
The Government will continue to monitor the market to determine if there are other potential sources that can meet this requirement and any advances in methodology, delivery and approach to mentoring programs. This will prompt the Government to seek competition in future acquisitions, thus eliminating the barriers to competition.
9. DHS intends to post this requirement on beta.SAM.gov pursuant to FAR 8.405-6(a)(2)(i).
10. Technical/Requirements Personnel Certification.
Pursuant to FAR 8.405-6(c)(2)(x), I certify that this requirement meets the Government’s minimum need and that the supporting data, which form a basis for the Limited-Sources Justification, are accurate and complete.
