About this file

This is an Indian Health Service Buy Indian Act Indian Economic Enterprise Representation Form required for contract solicitation 75H70127Q00001 titled "Kelly Pierson OSS."

The form is a self-certification document that offerors must complete to demonstrate eligibility as an Indian Economic Enterprise under the authority of 25 U.S.C. 47 (Buy Indian Act) and HHSAR 326.601. Offerors must certify their eligibility status and meet the definition of "Indian Economic Enterprise" with "Indian Ownership" at three critical junctures: at the time an offer is submitted in response to the solicitation, at the time of contract award, and throughout the entire contract performance period. Contractors are required to provide immediate written notification to the Contracting Officer if they cease to meet eligibility requirements at any point during these periods. The form requires disclosure of the federally recognized tribal entity, the 51% owner of the Indian Economic Enterprise firm, business name, DUNS number, and a certified signature. Successful offerors must also register with the System of Award Management (SAM). The document emphasizes that false or misleading information submitted during the offer process constitutes a violation of 18 U.S.C. 1001, while false claims submitted during contract performance are subject to penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287. Contracting Officers may require supporting documentation of eligibility prior to awarding set-aside or sole source contracts, and awards may be subject to protest if the successful offeror's eligibility is questioned.
