Limited-Source/Brand Name Justification United States Department of Agriculture 13.106-1(b)(1) – Simplified Acquisitions

1. Identification of the agency and the contracting activity.

United States Department of Agriculture, Departmental Administration, Office of Contracting and Procurement, Procurement Operations Division, 301 S. Howes Street, Suite 321, Fort Collins, CO 80521.

2. Description of supplies or services required to meet the agency’s needs.

Database with CalFire wildfire boundaries delineated, parcel numbers within the damaged area (fire and flood disaster response); operator and ownership data for each parcel number; location of wells/irrigation sources (drought disaster response); pesticide use reports (for production loss claims); other beneficial land use information for establishing agricultural use and program eligibility.

Estimated cost is $5,000.00 per subscription/license. Requesting 4 licenses for use in California ($20,000.00 total cost).

3. The circumstances and rationale for limiting competition.

Only one responsible source is available for this acquisition. B3 Poderosa is the only known data source for all FSA California needs to respond to significant disaster events in the state. No special software or equipment needed; no download to USDA computers; access to the database is on a subscription/ licensing basis.

We would support open competition if we could find another company providing same data.

4. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

Market Research was conducted to ensure the program is a commercial item and to determine its availability. Other companies, such as Aquaoso, were researched to see if a similar product was available.
