B.2 SCHEDULE NOTES

1. Pay item 31401 Stockpiled Aggregate is to be measured as an in place/compacted in place quantity according to FP-14 section 314. This pay item includes development of pit plan, rock excavation, blasting, crushing, stockpiling material, construction access roads within the quarry, clearing and grubbing, stripping topsoil, removing overburden, any temporary erosion control measures, restoration activities, and performing any other incidental work necessary for quarry development. Grading categories for stockpiled aggregate can be found in FSSS Table 703-2.

2. AQ = Actual Quantities, CQ = Design (Contract) Quantities, LSQ = Lump Sum Quantities.

3. Traffic Control section 156 & 635 incidental to pay item 15101.

4. Pay items 62201A and 62201B for Alec Creek must be used for the re-work of existing overburden stockpile. This is to create space for the stockpiling of developed aggregates.

Description of Requirement The project consists of creating stockpiled aggregate at the following quarries: Soda Peak Quarry, Big Creek Quarry and Alec Creek Quarry.

Soda Peak Quarry

1. Drilling, blasting, ripping rock, crushing, screening rock.

2. Stockpiling rock of two different gradation sizes.

3. Completing linear grading operations along entire route of Road 5400307 into rock pit.

Big Creek Quarry

1. Drilling, blasting, ripping rock, crushing, screening rock.

2. Stockpiling rock of one gradation size.

Alec Creek Quarry

1. Drilling, blasting, ripping rock, crushing, screening rock.

2. Stockpiling rock of two different gradation sizes.

3. Moving and re-piling of existing overburden stockpile to make room for developed aggregates stockpile. Tree removal near stockpile location is required and will be marked by Contracting Officer.

4. Perform comprehensive and safe professional geotechnical drilling services at Alec Peak Rock Quarry. Contractor will drill two base bid and potentially two optional drill sites; at separate locations. The two base bid drill locations will be within the Development Area and the two optional sites will be within 1000’ of the North and East sides of the same Development Area displayed on page 3 of the 2024 GP Rock Crushing - Alec Creek Quarry drawings. Drilling site locations are to be proposed by drilling contractor, and approved by government, based on site conditions and expertise. Provide qualified labor, supervision, transportation, equipment, drill rig, hoses, pumps, and any necessary equipment and supplies to perform core drilling and hollow stem auguring. Drilling services are to include all mobilization, moving, setting up, loading, providing samples and core for at the site, and providing cardboard containers for core and auger samples. HQ or NQ core drilling is required a minimum of 60 feet. A minimum of 70% core recovery is required.

5. This quarry has known invasive weeds present in existing stockpiles and in the quarry development area. The Contractor must coordinate with US Forest Service on an invasive weeds remediation plan (which must be a part of the quarry development plan). All equipment is required to have additional equipment washing after remediation and stockpiling of invasive weeds. There is a current stockpile location of invasive weed contaminated soil, which is marked.

Development of quarry and other incidental work must be in accordance with FP-14 section 314 and 205, and with US Mine Safety & Health Administration (MSHA) 30 CFR, part 56 https://www.ecfr.gov/current/title-30/chapter-I/subchapter-K/part-56. Conduct all blasting operations and activities in accordance with warnings and instructions adopted by the Institute of Makers of Explosives (IME) contained in box of explosives and blasting caps.

Location The project is located on the Gifford Pinchot National Forest, on the Mt Adams Ranger

District, and Cowlitz Valley Ranger Districts in the State of Washington.

Period of Performance

July 15, 2024 - Jan 15, 2025

Technical Specifications

(a) General:

The Contractor will conduct activities so that interference with the public is kept to a minimum.

(b) Timing Restrictions:

No work will start prior to July 15th due to wildlife restrictions with exception of any invasive weeds remediation necessary in quarries or stockpiles prior to quarry development activities. Coordinate with the COR.

(c) Transport & Delivery – Use of Roads by Contractor:

The Contractor is authorized to use roads that are part of the construction project and those Forest Service Roads designated below for performance of work under this contract.

Forest Roads 5400000, 5400307, 2500000, 2500201, 9000000, 9055000, and 9055040.

*Of note: Heavy rains are inherent to the region over the winter and can cause road damage. Current known degredations are on Forest Road 2500000 east of Mount St. Helens (South of the 9900000 junction) as well as the ever shifting Crab Creek segment of Forest Road 9000000 just southwest of Lower Lewis Falls. Contact the COR to obtain accurate road restrictions at anytime between bid creation and contract closeout.

Coordinate planned transport and delivery dates with the Contracting Officer and Contracting Officers Representative. The Contractor must notify the Contracting Officer a minimum of 3 working days before transporting any material.

Traffic Control Plan – Contractor is responsible for submitting a Traffic Control Plan. See C.5 (e) for review requirements. Contractor will perform no work that interferes or conflicts with traffic or existing access to the roadway surface until the required traffic control management plan is submitted and approved. Contractor must not to proceed with work on the project until all required signs and safety devices are in place and approved. During transport on USFS roads, Contractor must provide sufficient traffic control in compliance with MUTCD standards and standard specification sections 156 & 635 in order to control and protect public traffic. Contractor is responsible for traffic control during the equipment & material transport on Forest Service land. Quarry roads must be signed during construction activities, sign with “Trucks Entering and Leaving” signs when hauling material.

Overload Limit & Overwidth Permits (As required)- All vehicles and equipment will not exceed State legal highway loads and widths or posted limits without valid State and Forest Service overload, overwidth permits. Forest Service overload permits for this project may be obtained by contacting the the Gifford Pinchot National Forest Bridge Program Manager located at Forest Headquarters. See C.5

(e) for review requirements.

Please allow for 3 weeks processing time, overload and overwidth vehicle will not travel on Forest Service roads until the permit has been issued. Permit may be applied for in advance of the post-award or pre-work conference.

(d) Road Closure Contractor may close the quarry access road, and may temporarily close other roads necessary, for blasting and crushing operations. The Contractor must keep all other Forest Roads open to all traffic.

Unexpected road closures must be reported to the CO immediately.

C.5 APPLICABLE SPECIFICATIONS AND MATERIAL CERTIFICATIONS LISTED

SPECIFICATIONS FOR CONSTRUCTION OF ROADS AND BRIDGES ON FEDERAL

HIGHWAY PROJECTS, FP-14.

Sections 100 through 149, and other Standard Specifications, listed on the Specification List, are included in this solicitation by reference only. Specifications not on the list but referenced by other Standard Specifications, are also applicable to this document.

The project Supplemental Specifications are also given on the Specification List but are physically attached in Section J. All requirements contained on the Specification List are hereby made a part of this solicitation and any resultant contract.

Product Substitution:

Any modification of other items, designs, materials, products or equipment (including Government- Furnished Property), made necessary because of a substitution, will be the responsibility of the Contractor without adjustment in contract price or time. The Contracting Officer's approval of any substitute will not affect the Contractor's responsibility for such modification. Any and all substitutions will be requested by the Contractor after award of the contract has been made. No approvals will be made prior to award.

(b) General Guidelines for Submittals:

Submittals are required by the following specifications:

Samples:

Physical examples must illustrate materials, equipment, or workmanship, and establish standards by which completed work is judged. Samples must be of sufficient size and quantity to illustrate the functional characteristics of product or material, with integrally related parts and devices.

Manufacturer's requirements:

Supply manufacturer's catalog sheets or brochures with diagrams, schedules, or performance charts.

Illustrations must be clearly marked to identify pertinent materials or models, dimensions, and clearances required. Supplement standard drawings to provide information unique to this project.

Approval or Rejection Time Allowance:

Submittals will be reviewed and either approved or rejected within the number of calendar days specified in Table C5.(e). Review time begins from date of receipt by Contracting Officer.

(d) Shop Drawing Submittals:

Shop drawings, where required, are to be submitted to the CO. See C.5 (e) for review requirements.

(e) Material Certifications, Testing Reports & Other Submittals:

* Contractor is required to notify CO five working days prior to first quality control testing. Contractor sampling and testing is incidental to aggregate development. A CO representative must be onsite for each initial site testing unless contractor receives written documentation stating otherwise.

BIO PREFERRED PRODUCTS

A. The Contractor must comply with Section 9002 of the Farm Security and Rural Investment Act of 2002 (FSRIA), Executive Order (EO) 13423, “Strengthening Federal Environmental, Energy, and Transportation Management,” and the Federal Acquisition Regulation to provide biobased products.

B. The Contractor will utilize products and material made from biobased materials (e.g., biobased greases, biobased hydraulic fluids, biobased absorbents) to the maximum extent possible without jeopardizing the intended end use or detracting from the overall quality delivered to the end user. All supplies and materials will be of a type and quality that conform to applicable Federal specifications and standards. All supplies and materials to be used in the performance of work described herein are subject to the approval of the Contracting Officer (CO).

C. The following are examples of products that may be used in this contract for which biobased products are available. The list is not all inclusive. It is desirable that vendors be able to supply the greatest number of biobased products listed meeting the health and environmental specifications.

D. Biobased products that are designated for preferred procurement under USDA’s BioPreferred program must meet the required minimum biobased content as stated in the USDA Final Rule available at www.biopreferred.gov. The Contractor will provide data for their biobased products such as biobased content.

E. In addition to the biobased products designated by the U.S. Department of Agriculture in the BioPreferred Program, the Contractor is encouraged to use other biobased products.

F. The Contractor will comply with the provision at FAR 52.223-1, Biobased Product Certification.

a. As required by the Farm Security and Rural Investment Act of 2002 and the Energy Policy Act of 2005 (7 U.S.C. 8102(c) (3)), the Offeror certifies, by signing this offer, that biobased products (within categories of products listed by the United States Department of Agriculture in 7 CFR part 3201, subpart B) to be used or delivered in the performance of the contract, other than biobased products that are not purchased by the Offeror as a direct result of this contract, will comply with the applicable specifications or other contractual requirements.

G. The Contractor will comply with the provision at FAR 52.223-2, Affirmative Procurement of Biobased ProductsUnder Service and Construction Contracts.

(a). In the performance of this contract, the contractor will make maximum use of bio-based products that are United States Department of Agriculture (USDA) designated items unless--

(1) The product cannot be acquired--

(i) Competitively within a time frame providing for compliance with the contract performance schedule;

(ii) Meeting contract performance requirements; or

(iii) At a reasonable price.

(2) The product is to be used in an application covered by a USDA categorical exemption (see 7 CFR 3201.3(e)). For example, all USDA-designated items are exempt from the preferred procurement requirement for the following:

(i) Spacecraft system and launch support equipment.

(ii) Military equipment, i.e., a product or system designed or procured for combat or combat-related missions.

(b). Information about this requirement and these products is available at http://www.biopreferred.gov.

(c). In the performance of this contract, the Contractor will--

(i) Report to http://www.sam.gov, with a copy to the Contracting Officer, on the product types and dollar value of any USDA-designated biobased products purchased by the Contractor during the previous Government fiscal year, between October 1 and September 30; and

(ii) Submit this report no later than

(iii) October 31 of each year during contract performance.

A Contractor may propose more than one product within a product category and/or propose a product or products addressing more than one product category.

(d) Comptroller General Examination of Record. 52.217-8 Option to Extend Services (Nov 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. Upon contract closeout for contracts utilizing Simplified Acquisition Procedures (SAP) according to

(a) If unobligated funds in the amount of $1000 or less remain on the contract, the Contracting Officer (CO) shall issue a unilateral modification for deobligation. The contractor will receive a copy of the modification but will not be required to provide a signature. The CO shall immediately proceed with contract closeout upon completion of the period of performance, receipt and acceptance of supplies or services, and final payment.

(b) If unobligated funds of more than $1000 remain on the contract, the CO shall issue a bilateral modification for deobligation. If workers are hired under the H-2B program, (8 CFR Section 274A provisions of the Immigration and Nationality Act (INA) for the admission of nonimmigrants to the U.S.

to perform temporary labor or services) a Temporary Employment Certification issued by the Office of Foreign Labor Certification (OFLC) in the Department of Labor Employment and Training Administration is required. Compliance with MSPA and the INA is a material condition of this contract. If the contractor employs any unauthorized worker(s) during the performance of this contract that violates section 274A of the INA, the Government may terminate the contract, in addition to other remedies or penalties prescribed by law.

2. Definitions

1. H-2B worker: as used in this part means a nonimmigrant holding a visa authorizing the individual to legally work in the US to perform temporary labor or services. A worker with an H-2B visa (H-2B worker) may also be considered a migrant agricultural worker under MSPA depending on the type and nature of work performed.

2. Migrant Agricultural Worker and Seasonal Agricultural Worker: as used in this part means individuals employed for agricultural (including forestry) work on a seasonal or temporary basis.

A worker, moving from one seasonal activity to another, is employed on a seasonal basis even though the worker may continue to be employed during a major portion of the year.

An overnight absence from the migrant workers permanent place of residence is required.

Members of the contractor's immediate family are not considered migrant or seasonal workers. Immediate family includes:

1. Spouse

2. Children, stepchildren, or foster children

3. Parents, stepparents, or foster parents, or

4. Brothers and sisters

3. Farm Labor Contractor (FLC). As used in this part means a person including an individual, partnership, association, joint stock company or a corporation, who, for any money or other valuable consideration, paid or promised to be paid, performs any recruiting, soliciting, hiring, employing, furnishing, or transporting of any migrant or seasonal agricultural worker.

3. Registration Requirements

1. Any contractor providing or hiring H-2B nonimmigrants for work under this contract shall provide a copy of their Temporary Employment Certificate.

Contractors can apply for the certificate through the US DOL Employment & Training Administration's on line iCERT Visa Portal System at https://icert.doleta.gov/ or by paper application.

2. Any contractor who meets the definition in (2.c.) above providing or hiring migrant or seasonal workers to perform agricultural or manual forestry work shall first obtain a Federal DOL Farm Labor Contractor Certificate of Registration (http://www.dol.gov/whd/forms/fts_wh530.htm). The contractor shall carry the certificate at all times while engaged in contract performance and shall display it upon request. Any of the contractor's employees who perform any one or more of the activities defined as an FLC in paragraph (2.c.) must have their own FLC Employee Certificate. 4. Certifications

The Contractor shall provide applicable H-2B Temporary Employment Certificate and/or Farm Labor Contractor Certificate as part of their representations, certifications, and acknowledgements. Subcontractor(s) meeting the definitions above shall follow the same requirements as the Prime Contractor. It is the Prime Contractor's responsibility to ensure the Subcontractor's information is provided to the Contracting Officer.

5. Worker Protections

A contractor who uses the H-2B program to meet its temporary employment needs must post and maintain the H-2B poster (WH-1505) in a conspicuous location accessible to workers at the job site.

The contractor shall display and maintain the MSPA poster (WH-1376) on the job site in a conspicuous location accessible to workers during the contract performance period.
