PERFORMANCE WORK STATEMENT (PWS)
Servicing of Wastewater Tanks and Systems with Emergency Service
CAPE COD NATIONAL SEASHORE
Various Locations
Scope The Cape Cod National Seashore located at 99 Marconi Site Road, Wellfleet, Ma has wastewater tanks and wastewater systems that consist of residential and small commercial private sewers systems at various locations within the Cape Cod National Seashore. This PWS is a non-personal service contract for a base year and two (2) option years. Under this PWS, the Contractor shall provide all supervision, labor, materials, tools, equipment, plant, inspection, quality control necessary to complete service of the tanks and systems listed in attachment A and in accordance with this PWS. As part of its service the contractor shall plan, schedule, coordinate its work and assure effective performance in the servicing of wastewater tanks and systems.
Services shall include visual inspection, scheduled tank pumping, emergency tank pumping, emergency clearing of wastewater lines, emergency repair of septic manhole subsidence, emergency repair of sewer dosing tank pumps and emergency repair of dosing pumps at the CACO and as described herein.
The Contractor shall perform to the standards in this contract.
The inspection and pumping requirements shall include all mobilization, transport, disposal, barriers, flag personnel and personal protective equipment.
The tanks and access manholes are at residential leased park properties, park business occupancies and in parking areas at the seashore beaches. Some manholes are in beach parking lots. The contractor shall coordinate the inspection and pumping services with the park to minimize disturbance to the site, its employees, and the public.
All work shall be accomplished with the best standard practices, and by workmen thoroughly experienced in the required trades. The work shall be supervised by experienced personnel and shall be satisfactory to the Contracting Officer (CO) or the Contracting Officers Representative (COR).
The contractor shall without additional expense to the government, obtain all appointments, licenses, and permits required for the prosecution of the work. The contractor shall comply with all applicable Federal, State and Local laws.
Place and Performance of Services The Contractor shall provide services at the Cape Cod National Seashore (CACO), locations as shown in Attachment A, between the hours of 0700 to 1530, during normal government duty hours, unless otherwise specified by the Contracting Officer or his/her representative, on Monday through Friday, except on recognized US holidays or when the Government facility/installation is closed due to local or national emergencies, administrative closings, or similar government-directed facility/installation closings. The Contractor may be required to perform routine operations outside the normal hours. An on-site project manager may be required for work outside normal hours.
The Government, depending on workload will adjust the work hours. The Contractor shall be notified if an area is closed or does not need service. Any work that is performed on the weekend will be approved by the Contracting Officer before the work is done and notification will be made by email from the
Contractor to the Contracting Officer and COR. Please allow up to 3 business days for the decision to be made.
Measurements Estimated dimensions and quantities shown in Attachment A are provided for pricing purposes only.
The contractor is responsible for verifying all measurements, quantities and ensuring it has the proper equipment to perform its work. The contractor shall take all measurements and note existing conditions for the performance of the work. All ancillary effort, digging, cutting and /or removal of existing materials necessary for the performance of the work of this contract shall be performed as part of this contract.
Where the contract line item requires a residence tank be pumped, CLIN 10 and 30, payment will be per facility pumped and not per gallon. CLIN 20, Operational building pumping service, payments shall be made on a not to exceed 2,500-gallon basis cumulative for multiple locations.
Invoice Invoices for payment shall be no more than 30 days once service has been completed and itemized by CLIN. Supporting documentation for the tank address, quantity scheduled, quantity pumped with detail for unit cost, labor, and equipment.
Period of Performance (PoP) The period of performance shall begin at time of award.
The Period of Performance shall be one Base Year of 12 months and two 12-month option years. The Period of Performance reads as follows:

Work Elements Contract Line Item Number 10 Septic inspection at nineteen (19) permanent residences, twenty-nine (29) seasonal residences and seven (7) leased residences per Attachment A. Based on inspections, Pump Eight (8) tanks.
Contract Line Item Number 20 Provide dosing tanks, alarms, and Septic inspection. Based on inspection pump up to 2500 gallons cumulative at tanks located at the operational buildings, per Attachment A.
Contract Line Item Number 30 Pump vault toilets and sealed tanks per Attachment A and frequency as specified in the performance work statement.
Recognized Holidays The Contractor shall not be providing service on Federal holidays. The following are recognized US holidays and the date for each can be found at the following website:
http://www.opm.gov/Operating_Status_Schedules/fedhol/Index.asp. The Contractor shall not perform services on these days:
New Year’s Day; Martin Luther King, Jr.’s Birthday; President’s Day; Memorial Day; Juneteenth;
Independence Day; Labor Day; Columbus Day; Veteran’s Day; Thanksgiving Day; and Christmas Day.
When an observed holiday falls on a Tuesday or Thursday, the Depot regularly schedules a closure on the corresponding Monday or Friday.
Public Disclosures The Contractor shall make no public announcement or disclosure relative to information contained or developed under this contract, except as authorized by the CO or the COR.
Hazardous Waste A waste as defined in title 40, CFR, Part 261.3.
Quality Control (QC) The Contractor is responsible for contract performance quality control and shall develop and maintain an effective QC program to ensure services are performed in accordance with this PWS. The Contractor shall be required to establish an inspection system that develops and implements procedures to identify, prevent, and ensure non-recurrence of defective services. The Contractor’s QC program is the means by which it assures itself that its work complies with the requirements of the contract. As a minimum, the Contractor shall develop QC procedures that address the areas identified in Attachment B, Performance Requirements Summary. After acceptance of the QC Plan, the Contractor shall obtain the Contracting Officer’s acceptance in writing of any proposed changes to its QC system. The program will be submitted to the CO/COR by email within 60 days of contract award.
The plan will include but not limited to:
An inspection system covering the services stated in this PWS. It must specify areas to be inspected on either a scheduled basis, how often inspections will be accomplished and the title of the individuals who will perform the inspections.
Include provisions for working in and around the public. The operational buildings are public facing buildings. During the peak visitor season of Memorial Day through Labor Day, the park can have over million visits. The inspection and pumping plan will accommodate the park schedule, public visitations, and its associated vehicle traffic.
A file of all inspections conducted by the Contractor and the corrective actions taken. This documentation will be made available to the Government during the term of the contract.
The Contractor is solely responsible for the quality of all contract deliverables and shall perform services and develop products by referring to their QAQC to assure service and product quality.
The Government will monitor the Contractor's performance. The Government reserves the option to implement whatever surveillance plan it considers appropriate, and to modify that plan as applicable.
Government personnel will record all surveillance observations. The Contracting Officer's Representative will maintain a file of all inspection results. Government surveillance of tasks not listed in the performance requirements summary or by methods other than those listed in the performance requirements summary may occur during the performance period of this contract. Such surveillance will http://www.opm.gov/Operating_Status_Schedules/fedhol/Index.asp be done according to standard inspection procedures or other contract provisions. If the services are found to be defective in workmanship or otherwise not in conformity with the specifications and requirements, the Government will have the right to reject such service and the work will then be performed in an efficient and workmanlike manner without additional cost to the Government.
Reoccurring incidences of unsatisfactory performance of any required service may result in appropriate action by the CO in accordance with the Inspection of Services clause(s). Quality control under this section will apply to all task orders awarded under this contract. The verbiage of the task order may require additional quality control requirements above and beyond those mentioned in the base contract.
Government inspection personnel will monitor the Contractor's performance by physical inspection, review of reports/documentation and validated customer complaints.
Quality Assurance (QA) The Government will evaluate the Contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan (QASP). This plan is primarily focused on what the Government must do to ensure that the Contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and acceptable quality level(s) (defect rate(s)).
Each phase of the services rendered is subject to Government inspection during the Contractor's operation and/or after the completion of the task. Any defective or unaccomplished work will be brought to the attention of the Contractor by the Contracting Officer, the contracting officer representative, or the authorized representative. The Contractor must re-perform all defective work before payment is submitted.
The Contractor shall be allowed twenty-four (24) hours from time of notification to correct the deficiency (customer complaint) without deduction. If the Contractor does not respond within the time limit or does not re-perform the service satisfactorily, these discrepancies will be considered as omitted or unsatisfactorily performed.
The Contractor's invoice will be reduced by 5% of the final service invoice price for every 5 days the task is not complete for any or all areas that work was not properly re-performed. This may also be reason for default. This will be monitored by the COR or Contracting Officer. Deductions to invoiced amounts due to lack of contract compliance on behalf of the Contractor shall require approval by the CO. Invoiced amounts for services that have not been rendered or have been rendered but are not in compliance with the standards set forth within this PWS will not be paid.
Accident Reporting The Contractor shall report accidents and incidents incurred while performing work under this contract immediately by the most expeditious means possible, but not more than one hour following the accident or incident to the COR, Chief Facilities Management and Contracting Officer. Contractor shall immediately report all incidents involving property damage, fires causing major damage to structures, equipment, or vehicles, and HAZMAT, hazardous substances, and HAZWASTE incidents. Immediately after a job-connected injury, the Contractor shall prepare a record of the incident/accident and forward it by email to the COR. The COR will forward the incident/accident report to the facility safety specialist and the Chief Facility Management. If more information is required, the Safety specialist will coordinate with the COR for the required information. If the Contracting Officer notifies the Contractor of any noncompliance with foregoing provisions and the action to be taken, the Contractor shall, after receipt of notice, immediately correct the deficiencies. Such notice when delivered to the Contractor or his representative at the site of work will be deemed sufficient for this purpose. If the Contractor fails or refuses to comply promptly, the Contracting Officer may issue an order stopping payment on work performed under this contract until satisfactory corrective action has been taken.
Utilities and Services Many of the sites are residential leased properties and seasonal use properties. The use of sanitary facilities for the contractor will not be available.
Contractor shall drive on only marked and established roadways and driveways. Do not drive on or over sidewalks, curbs, lawns, etc. The contractor shall locate and prevent damage to known utilities. If damage occurs, repair utility at no additional expense to the Government. Notify Contracting Officer and utility companies of proposed locations and times for excavation. If damage occurs to an unknown utility, repair utility. An equitable adjustment will be made in accordance with the Changes clause of the contract.
Permits and Approvals The Contractor is responsible for contacting Dig Safe (#811) or other approved utility marking entity for pre-marking of all underground utility locations within project area prior to any ground disturbance.
Prior to commencement of any on-site work, provide Contracting Office with copies of proof of pre-marking from utility marking entity.
Contractor shall obtain all required permits for the performance of the work specified in Contract Documents at no additional cost to the contract. Please see attachment C, Deliverable Schedule.
Written approval from the park is required prior to blocking or obstructing parking areas, roadways, or egress routes.
There are subterranean dosing pumps associated with several of the large septic systems (Nauset Light Beach, Head Quarters Building, Salt March Visitor Center, Highland Center, and Herring Cove). The pumps and associated equipment are located within a confined space. Access requires an approved confined space plan, written approval prior to entry and contractor retained onsite confined space attendant.
Submittals and Deliverables Submittals and deliverables are shown on Attachment C, Deliverables scheduled.
Please note Contractor shall submit a copy of its site-specific safety and health plan no later than 30 business days after award. The safety plan shall meet all OSHA requirements.
Contractor shall provide the following: 1. detailed project schedule with calendar dates; 2. the septic disposal facility; 3. A list of contractor driver names, company, and a copy their commercial driver’s license (CDL); and 4. Vehicle list with corresponding vehicle registration and photo of annual state safety inspection documentation. Provide documents including two (2) weeks for government review prior to commencing any work on site.
Commercial vehicles that are not registered in the State of Massachusetts must provide vehicle safety inspection documentation equivalent to the annual Federal Motor Carrier Safety Administration (FMSA) United States Department of Transportation (DOT) inspection.
Payment will be made for the facilities pumped and for the actual gallons pumped. In order to receive payment for services, the contractor shall submit with their invoice all copies of valid disposal ticket(s) from the approved facility with the total price and unitized cost per gallon. The invoice shall be apportioned where the quantity pumped is less than the base.
Safety and Environmental Protection Requirement Maintain project area in a neat, orderly, and safe condition at all times. All work areas shall be made secure and safe after hours, on weekends and holidays.
Copies of the following must be provided to the COR and facility safety specialist prior to starting work in the affected areas: Confined space entry plan; hot work permit with contractor fire watch; Lock/Out Tag out Plan; Lock/Out Tag out signed acknowledgment; and dig safe clearance with excavation notification.
Contractor confined space clearance shall be provided by the contractor’s third party confined space attendant and the contractor’s standby confined space rescue service. (The local fire department(s) are not always staffed to provide the onsite standby confined space rescue service.)
Hot work shall only be conducted with prior written notice and approval. Contractor permission with the designated fire watch must be posted during work.
The dig safe clearance with the facility excavation notice shall be posted at the job site.
All debris and removed material are the property of the contractor and shall be removed from the site, recycled, or legally disposed of in a manner that is consistent with local and state regulations. All waste, trash and debris generated as part of this project must be secured from wind, inclement weather, and rodent action.
Contractor shall take all necessary precautions to prevent fire during construction. Contractor shall provide and maintain suitable fire protection equipment. Protection Equipment Required: one UL Class 10, Type I, 15 pound A:B:C carbon dioxide extinguisher at each work site.
No smoking (including vaping) or use of tobacco products will be allowed on the job sites.
The Contractor is responsible for securing the sites and its work. During the execution of this contract, the Contractor shall conform to the rules and regulations as set forth by OSHA Safety and Health Standards. The Contractor shall provide flag person, barriers, temporary fencing, locks, signage, etc.
wherever work could cause injury to workers, visitors, CACO staff and ensure that equipment, hoses, and openings are secured from public access during off-hours.
The Contractor shall provide and maintain environmental protection during the life of the Contract to control pollution or to correct conditions that develop during construction.
Equipment shall not be allowed to operate outside the limits of work or to disturb existing vegetation.
Construction equipment shall be kept in good repair, without leaks of hydraulic or lubricating fluids.
Contractor must visually inspect all equipment prior to commencing work every day and at the mid-point in the workday for leaks. If such leaks or drips do occur, they shall be cleaned up immediately.
Confine equipment maintenance to one location. Control runoff in this area to prevent contamination of soils and water. No equipment repair will be allowed on the site.
It is the contractor’s responsibility to ensure that any disturbance or damage done during the course of this project to the existing utilities, landscape, building or government materials, shall be repaired or restored to its original condition by the contractor at contractor’s expense prior to completion of the job.

Work to Be Performed Identified in Attachment A are the septic tanks that require inspection, pumping, cleaning, removal of their liquid and solid waste content and emergency service. The contractor will provide all Supervision, labor, material, equipment, and plant necessary to access, pump, transport, dispose of septage from the septic tanks and make emergency repair.
Some tanks are accessed by surface mounted manhole covers set at-grade and will not require digging to gain access the tanks, others shall require locating and digging to reach manholes.
The contractor will thoroughly mix, pump, and take necessary action required to remove all contents from each tank. The contractor will transport pumped material to a licensed and approved disposal location. Proof of disposal is required as part of prior to payment.
For each tank, the contractor shall note whether the inlet pipe and outlet pipe are clear or obstructed.
Immediately report an obstructed pipe condition or system deficiency to the COR.
No utilities are available at the sites. The contractor is responsible for ensuring that each site, as related to the pumping of the tank, is clean and fit for private or public use prior to departure.
Tank volumes indicated in the tables are the tank design capacities. They are provided for pricing purposes only.
All locations listed under Contract Line Item 10 and 20 shall be inspected during the base year and each option year of the contract. Locations that require pumping shall be determined by the inspection.
Locations listed under Contract Line Item 30 shall be serviced annually on the frequency listed below and, on a schedule, approved by the COR:
• Salt Pond Visitor Center – two (2) times annually (APR 1, SEP 1)
• Herring Cove North Vault Toilet – four (4) times annually (MAY 1, JUL 1, SEP 1, NOV 1)
• Herring Cove South Vault Toilet – four (4) times annually (MAY 1, JUL 1, SEP 1, NOV 1)
• North District Maintenance and Housing Area – three (3) times annually (APR 1, AUG 1, DEC 1)
• Head of the Meadow Vault Toilet 1 – four (4) times annually (MAY 1, JUL 1, SEP 1, NOV 1)
• Head of the Meadow Vault Toilet 2 – four (4) times annually (MAY 1, JUL 1, SEP 1, NOV 1)
