About this file

This document is a Justification for Other Than Full and Open Competition (JOFOC) for a sole-source contract to procure Kubota tractors and Gearmore dump trailers for the Punchbowl Cemetery in Oahu, Hawaii.

The document explains that Punchbowl Cemetery already utilizes a fleet of Kubota and Gearmore equipment, and interoperability between equipment is essential for effective, efficient, and safe operations. The cemetery does not have a training program for equipment operators to safely use equipment from other manufacturers. Therefore, the Contracting Officer has determined that competition must be limited to the specified Kubota and Gearmore makes/models to maintain safety and efficiency. The Contracting Officer has conducted market research and found only one supplier, Bacon Universal, that can provide both Kubota and Gearmore equipment in Oahu. A combined synopsis/solicitation will be publicly posted on SAM.gov, but award will be made on a sole-source basis to Bacon Universal.

Text version

“Acquisitions conducted under simplified acquisition procedures are exempt from the requirements in part 6. However, contracting officers must- (i) Conduct sole source acquisitions, as defined in 2.101, (including brand name) under this subpart only if the need to do so is justified in writing and approved…” Punchbowl cemetery already utilizes a fleet of Kubota and Gearmore equipment.

Interoperability between equipment is essential to effective, efficient, and safe operations.

Punchbowl cemetery equipment operators are trained and efficient on the use of Kubota and Gearmore equipment within the tight confines of the cemetery, between graves, and amongst headstones. Keeping consistent manufacturer of equipment is essential to safe and effective operations. Punchbowl Cemetery does not have a training program for equipment operators to be trained and gain experience for safe operation of equipment by other manufacturers. Purchase of other equipment to be operated alongside existing Kubota and Gearmore equipment will introduce risk to already relatively dangerous work. Competition is not limited amongst vendors or supplier, only to the Make/Model of manufacturer.

Alternative equipment will not be accepted by Punchbowl Cemetery due to safety and efficiency reasons stated above. As such, if not approved, Punchbowl Cemetery disinterment operations will be negatively impacted, reducing capacity of exhumations.

This will negatively impact Defense POW/MIA Accountability Agency mission.

6. EFFORTS TO OBTAIN COMPETITION: A combined synopsis/solicitation will be publicized in SAM.gov as required by FAR Subpart 5.102(a)(6) and authorized by FAR Subpart 12.603.

7. FAIR AND REASONABLE COST DETERMINATION: The Contracting Officer determines that the anticipated prices will be fair and reasonable by using the techniques identified at FAR 15.404-1(b) to ensure award will be at fair and reasonable prices.

There is only one supplier of Kubota equipment in Oahu, Hawaii: Bacon Universal. Gearmore has several dealer representations in Hawaii, however the prices quoted during market research among dealers showed insignificant differences in pricing.
