S.O.W. - 1

STATEMENT OF WORK

Pond #1 and Pond #2 Water Distribution Piping Replacement at Valley City National Fish Hatchery

PART 1 - GENERAL REQUIREMENTS

1.1 SUMMARY

A. The Contractor shall furnish all labor, materials, and equipment necessary to construct the following work:

1. Furnish and install water supply piping, valves, and fittings with associated earthwork as indicated in the Project Drawings and described in the this Statement of Work.

2. Work generally includes the following activities:

a. Remove and dispose of all existing piping within new pipe alignment.

b. Install approximately 470 linear feet of 8-inch diameter C900, DR18, PVC pipe

c. Install approximately 360 linear feet of 6-inch diameter C900, DR18, PVC pipe

d. Install approximately 30 linear feet of 4-inch diameter C900, DR18, PVC pipe

e. Install approximately 30 linear feet of 6-inch diameter ductile iron pipe

f. Install approximately 30 linear feet of 6-inch schedule 40 PVC pipe

g. Install 1 each, new 8-inch gate valves with valve boxes

h. Install 2 each, new 6-inch gate valves with valve boxes

i. Install 1 each, new 4-inch gate valve with valve boxes

j. Recover and install 2 each, existing 8-inch gate valves and install new valve boxes

k. Install all ductile iron fittings at junctions as shown, inclusive of all mechanical joints.

l. Install all vertical and horizontal ductile iron fittings, inclusive of all mechanical joints, to achieve fully restrained piping network that conforms to indicated vertical and horizontal alignment requirements.

m. Install 2 each new 6-inch wafer type butterfly valves with handwheels. Match existing type.

n. Install concrete thrust blocks as required

o. Demolish and dispose of existing manhole as indicated in plans

p. Restore all disturbed areas to original condition, inclusive of all grading and re-seeding as necessary

B. Any proposed changes to the scope of the project must be approved by the Project Leader and the Contracting Officer prior to implementation.

C. The Contractor shall have all permits, certificates and licenses required by law for the execution of the work and shall comply with all Federal, State, or local laws, ordinances or rules and regulations relating to performance of the work. All work shall meet all applicable requirements of the North Dakota Plumbing Code.

1.2 PROJECT BACKGROUND

A. The Valley City National Fish Hatchery (NFH) is operated by the U.S. Fish and Wildlife Service, and consists of the main hatchery at Valley City, and a smaller subunit at Baldhill Dam. The station is located three miles northwest of Valley City, North Dakota along County Road Number 17 in the Sheyenne River Valley.

The Valley City Hatchery is one of two Federal Fish Hatcheries responsible for providing quality fishing opportunities in North Dakota and throughout the Great Plains Region.

To achieve fish rearing operations, water is pumped from a pumphouse located near the Sheyenne River to various ponds at the Hatchery. Over the past several years, Hatchery personnel have made recurring repairs to the water distribution piping that serves Ponds #1 and #2. Due to the shallow bury depth of this piping, recurring freezing events have caused the piping to separate at the joints. This project proposes to replace the existing piping serving ponds #1 and #2 with more robust materials and achieve a bury depth that protects piping from winter freezing events.

1.3 PROJECT SITE

A. Project Location: The site of the work is at Valley City National Fish Hatchery, 11515 River Road, Valley City, North Dakota.

C. Interested Contractors are encouraged to visit the site and become familiar with the existing conditions. Failure to ascertain the nature, location, and conditions that affect the work will not relieve the Contractor from the responsibility of successfully performing the work.

D. Contractor is responsible for locating all buried utilities on site and in the vicinity of the work.

Contractor shall repair any damage to utilities resulting from Contractor activities.

1.4 ACCESS TO SITE

A. All operations of the Contractor (including storage of materials) upon Government premises shall be confined to areas authorized or approved by the Contracting Officer or on site inspector.

B. Upon completion of work, Contractor shall restore all areas disturbed by construction activities to original condition, as accepted by the Contracting Officer or on site inspector.

C. Limit use of Project site areas within the Contract limits indicated. Do not disturb portions of Project site beyond areas in which the Work is indicated.

1. Limits: Confine construction operations to project site as indicated in the plans unless discussed with the Contracting Officer and Project Leader.

2. Driveways, Walkways and Entrances: Keep driveways and loading areas, and entrances serving premises clear and available to Government, Government Representatives, and emergency vehicles at all times. Do not use these areas for parking or storage of materials.

1.5 PROJECT CONDITIONS

A. Partial Government Occupancy: Government will occupy the premises during entire construction period, with the exception of areas under construction. Cooperate with Station Manager during construction operations to minimize conflicts and facilitate usage. Perform the Work so as not to interfere with Government operations. Maintain existing exits unless otherwise indicated.

1. Provide minimum 48 hour notice to Government of activities that will affect Government's operations.

B. Coordinate all project work to facilitate orderly progress and proper sequence of work at all times.

C. Coordinate work closely with the Hatchery Manager to ensure there are no unforeseen impacts to wildlife, or the operation of the Hatchery.

D. In the event that other contracts are in progress concurrently with this contract, the Contractor shall coordinate their work so as not to disrupt progress of other work, and shall cooperate to facilitate orderly progress of all work.

1.6 PERFORMANCE

A. The project shall be completed and functioning within 90 calendar days from the date the Notice to Proceed (NTP) is issued.

B. On-Site Work Hours: Limit work to normal business working hours of 7:00 a.m. to 4:00 p.m., Monday through Friday, unless otherwise indicated during construction.

1. Work on weekends will be restricted to Contracting Officers approval and at the Hatchery Managers discretion.

2. No work will take place over Federally observed holidays.

C. Existing Utility Interruptions: Do not interrupt utilities serving facilities occupied unless permitted under the following conditions and then only after providing temporary utility services according to requirements indicated:

1. Notify Hatchery Manager not less than 48 hours in advance of proposed utility interruptions.

D. Noise, Vibration, and Odors: Coordinate operations that may result in high levels of noise and vibration, odors, or other disruptions to the Government.

1. Notify Station Manager not less than 48 hours in advance of proposed disruptive operations.

E. Nonsmoking Building: Smoking is not permitted within the building or within 25 feet (8 m) of entrances, operable windows, or outdoor-air intakes.

F. Work restrictions vary by well as indicated on the plans.

1.7 PERMITS AND FEES

A. The Contractor shall be responsible for obtaining all necessary local, State, and Federal permits and licenses, and payment of related fees, per the Contract Clauses.

B. The Contractor is responsible for implementing the terms and requirements for a National Pollution Discharge Elimination System (NPDES) permit, as required by the Environmental Protection Agency (EPA). The Government and the Contractor will be co-permittees. The Contractor shall prepare and submit all permit application documents for the US Fish and Wildlife Service to sign as Government, except that the Government will prepare and sign a separate Notice of Intent (NOI) to discharge for the Contractor to include with the permit application. The Contractor is solely responsible for executing the terms and conditions of the permit as issued by the EPA. The Contractor shall submit to the Contracting Officer a copy of all permit applications and a copy of all approvals from the EPA. Allow the Government 10 days for review of the application package prior to submission.

1.8 APPLICABLE CODES, STANDARDS AND SPECIFICATIONS

A. All work shall comply with the codes and standards applicable to each type of work as listed in individual Sections of this Statement of Work and the Project Drawings.

B. Where a conflict occurs between a referenced document and the Project Specifications, the Project Specifications govern.

C. Where a conflict occurs between referenced documents, the document containing the most stringent requirements governs.

D. Where referenced documents are not specified by date, the document current at the bid opening applies.

E. Materials, applications, and tests specified by reference to published standards of society, association, code, or other published standards are included in the specifications as if written in their entirety.

F. Conform to all regulations and statutes of the State of North Dakota and to all Federal Regulations which apply.

1.9 MEANS AND METHODS

A. Means and methods of construction shall be such as the Contractor or subcontractors may choose;

subject, however, to the Contracting Officer's right to reject means and methods proposed which:

1. Constitute a hazard to the work, persons, or property.

2. Will not produce finished work in accordance with terms of the contract.

3. Are contrary to specified means or methods included in the contract.

B. The right to reject means and methods of the Contractor or subcontractor shall not be construed or interpreted as acceptance of control of means and methods by the Contracting Officer.

C. The Contracting Officer's approval of means and methods or failure to exercise right to reject means and methods shall not relieve the Contractor of the obligation to complete the work required by the contract.

D. Total responsibility for control of all means and methods lies with the Contractor for all work.

1.10 SAFETY

A. The Contractor shall provide, erect and maintain all necessary barricades, suitable and sufficient flasher lights, flagmen, danger signals and signs, and shall take all necessary precautions for the protection of the work and the safety of the public. All ponds and water control structures shall remain accessible by vehicle. Roads closed to traffic shall be protected by effective barricades and shall be placed with acceptable warning signs. All barricades and obstructions shall be illuminated at night and all lights shall be kept burning from sunset until sunrise. Install appropriate traffic signs at crossroads and approaches to site as needed to direct affected public traffic. Specific signs and barricade requirements are detailed in the U.S. Department of Transportation, "Manual on Uniform Traffic Control Devices".

B. The Contractor shall assume full responsibility and liability for compliance with all applicable Federal, State, and local regulations pertaining to the protection of workers, visitors to the site, and persons occupying areas adjacent to the site, including the provisions of 29CFR1910 and 29CFR1926 of the Code of Federal Regulations. The Contractor shall hold harmless the Government for failure to comply with any applicable safety or health regulation on the part of himself, his employees, or his subcontractors.

C. Provide personal safety equipment and training commensurate with the hazards which may exist at the work site. The personal safety equipment and training shall be determined by a thorough hazard analysis of all work site areas. The safety program available at all work sites shall include a minimum of:

1. One nonfreezing-type fire extinguisher in each workshop and shed used for storage of materials at the work site. Place in location readily accessible to construction personnel.

2. A first aid kit for use of construction personnel commensurate with size of project with items necessary for first aid treatment of all injuries.

3. The Contractor shall conduct regular onsite safety inspections and all construction personnel shall receive a safety orientation.

4. Post telephone numbers of nearest hospital, ambulance service or flight for life, and fire station in conspicuous location. Advise all workers of location of telephone numbers.

1.11 ENVIRONMENTAL PROTECTION

A. The Contractor shall abate and control all environmental pollution arising from construction

S.O.W. - 6 activities by complying with all applicable Federal, State, and local laws and regulations concerning environmental pollution control and abatement, as well as the specified requirements in this contract. Compliance with this requirement by subcontractors will be the responsibility of the Contractor.

B. Fossils and Artifacts

1. Should the Contractor discover any fossils or artifacts during construction operations, such objects shall become the property of the Government. The Contractor shall cease construction operations in the area of the "find," and immediately notify the station manager of such discovery. Construction operations may proceed in other areas not affected by this clause. Care shall be exercised by the Contractor not to damage fossils or artifacts uncovered during excavation operations.

2. Failure to comply with this requirement may be considered a violation of the Archeological Resources Protection Act of 1979 as amended. Destruction of historic and prehistoric sites and/or unauthorized collection of cultural materials can result in criminal and/or civil penalties. Penalties can include fines, prison sentences, and/or confiscation of equipment.

3. If the Contractor uses fill from a nongovernmental source to perform work that is required under this project, and a new borrow site is opened or an existing borrow area is expanded in order to obtain such materials, the Contractor shall assure that any new borrow area disturbance meet the requirements of Section 106 of the National Historic Preservation Act.

C. Abatement of Air Pollution

1. The Contractor shall comply with applicable Federal, State, and local laws and regulations concerning the prevention and control of air pollution.

2. Construction activities shall be performed in such a manner that air pollution will be held to a minimum.

3. Burning of materials, trees and brush, combustible construction materials, and rubbish will not be permitted. Construction debris shall be disposed of at a location designated by the Contracting Officer or hauled off the Station to an approved disposal site.

D. Prevention of Water Pollution

1. During construction the Contractor shall comply with all applicable Federal, State, and local laws and regulations concerning the control and abatement of water pollution.

2. The Contractor's construction activities shall be performed by methods that will prevent entrance or accidental spillage of solid matter, contaminants, debris, and other objectionable pollutants and wastes into streams, flowing or dry water-courses, lakes, ponds, and underground water sources. The Contractor shall dispose of all pollutants such as petroleum products, rubbish, cement, concrete, etc., and objectionable material shall be hauled away in tanks or barrels or buried in an approved landfill.

3. Sanitary facilities, such as chemical toilets shall be located far enough from wells, live streams, or ponds to prevent pollution of the water.

4. Dewatering work for structure foundations or earthwork operations adjacent to, or encroaching on, streams or watercourses shall be conducted in a manner which prevents muddy water and eroded materials from entering the streams or water courses. This shall be accomplished by construction of intercepting ditches, bypass channels, barriers, settling ponds, or other approved means. Excavated material shall not be placed in, or adjacent to, watercourses where it can be washed away by high water or storm runoff.

E. Prevention of site contamination

1. The purpose of this section is to prevent invasive species from being introduced to the project work sites. This includes both plant and animal species. Invasive species can have long last detrimental effects at project sites at US Fish and Wildlife Service lands.

2. Prior to entrance to the work site, all equipment brought on site will be thoroughly washed to remove dirt, seeds, and plant parts. Any equipment that has been any body of water within the past 30 days will be thoroughly cleaned with hot water greater than 140 degree F (typically the temperature found at commercial truck washes) and dried for a minimum of five days before being used at this project site. In addition, before transport-ing equipment from the project site all visible mud, plants and fish/animals will be re-moved, all water will be eliminated, and the equipment will be thoroughly cleaned. Any-thing that came in contact with water will be cleaned and dried following the above pro-cedure.

F. Environmental Litigation: Time lost due to work stoppage because of failure of the Contractor to comply with these requirements may not be the subject of a claim for extension of time, for additional costs, or damages.

1.12 PAYMENT PROCEDURE

A. Coordination: Coordinate preparation of the schedule of values with preparation of Contractor's construction schedule.

1. Submit the schedule of values to Contracting Officer at earliest possible date but no later than seven days before the date scheduled for submittal of initial Applications for Payment.

B. Each Application for Payment shall be consistent with previous applications and payments as certified by Contracting Officer and paid for by Government.

C. Payment Application Times: The date for each progress payment is indicated in the Agreement between Government and Contractor.

D. Initial Application for Payment: Administrative actions and submittals that must precede or coincide with submittal of first Application for Payment include the following:

1. Schedule of values.

2. Contractor's updated construction schedule (preliminary if not final).

E. Final Payment Application: After completing Project closeout requirements, submit final Application for Payment with releases and supporting documentation not previously submitted and accepted, including, but not limited, to the following:

1. Evidence of completion of Project closeout requirements.

2. Written guarantees, warranties, and certificates.

3. Record (As-Built) Drawings

4. All test reports.

1.13 PROJECT MANAGEMENT AND COORDINATION

A. Submittal Administrative Requirements and Procedures

1. Coordinate each submittal with fabrication, purchasing, testing, delivery, other submittals, and related activities that require sequential activity.

2. Processing Time: Allow time for submittal review, including time for resubmittals. Time for review shall commence on Contracting Officer receipt of submittal. No extension of the Contract Time will be authorized because of failure to transmit submittals enough in advance of the Work to permit processing, including resubmittals.

a. Initial Review: Allow 10 days for initial review of each submittal.

b. Resubmittal Review: Allow 10 days for review of each resubmittal.

3. Identify options requiring selection by Contracting Officer.

4. Identify deviations from the Contract Documents on submittals.

5. General Submittal Procedure Requirements:

a. Electronic Submittals: Contracting Officer’s Representative through the Contracting Officer will return annotated file by e-mail.

6. Product Data: Collect information into a single submittal for each element of construction and type of product or equipment.

a. Mark each submittal to show which products and options are applicable.

b. Include the Manufacturer's product specifications, as applicable.

7. Test and Inspection Reports: Comply with requirements specified in the Statement of

Work, Section 1.13 “Quality Requirements.”

8. Closeout Submittals: Comply with requirements specified in Section 1.15 "Closeout Procedures."

9. Review each submittal and check for coordination with other Work of the Contract and for compliance with the Contract Documents. Note corrections and field dimensions.

10. Government’s Action

a. Contracting Officer’s Representative will review each submittal, make marks to indicate corrections or revisions required, and return it. Contracting Officer’s Representative marks will indicate action as follows:

1) Approved as submitted.

2) Approved, except as noted. Resubmission not required.

3) Approved, except as noted. Resubmission required.

4) No action taken. See comments on reverse. Resubmission required.

5) Disapproved.

6) Other: (comments as noted)

b. Incomplete submittals are unacceptable, will be considered nonresponsive, and will be returned for resubmittal without review.

B. Requests for Information (RFIs)

1. General: Immediately on discovery of the need for additional information or interpretation of the Contract Documents, Contractor shall prepare and submit an RFI in the form specified.

a. The Government will return RFIs as submitted to the Government by other entities controlled by Contractor with no response. RFI’s must come directly from the Contractor.

b. Coordinate and submit RFIs in a prompt manner so as to avoid delays in Contractor's work or work of subcontractors.

2. Content of the RFI: Include a detailed, legible description of item needing information or interpretation and the following:

1) Project name.

2) Project number.

3) Date.

4) Name of Contractor.

5) RFI number, numbered sequentially.

6) RFI subject.

7) Specification Section number and title and related paragraphs, as appropriate.

8) Drawing number and detail references, as appropriate.

9) Field dimensions and conditions, as appropriate.

10) Contractor's suggested resolution. If Contractor's solution(s) impacts the

Contract Time or the Contract Sum, Contractor shall state impact in the RFI.

11) Contractor's signature.

12) Attachments: Include sketches, descriptions, measurements, photos, Product

Data, Shop Drawings, coordination drawings, and other information necessary to fully describe items needing interpretation.

3. RFI Forms: AIA Document G716, or Software-generated form with substantially the same content as indicated above, acceptable to the Government.

4. The Governments Action: The Government will review each RFI, determine action required, and respond. Allow seven working days for the Government’s response for each RFI. RFIs received after 1:00 p.m. will be considered as received the following working day.

a. The following RFIs will be returned without action:

1) Requests for approval of submittals.

2) Requests for approval of substitutions.

3) Requests for coordination information already indicated in the Contract

Documents.

4) Requests for adjustments in the Contract Time or the Contract Sum.

5) Requests for interpretation of Architect's actions on submittals.

6) Incomplete RFIs or inaccurately prepared RFIs.

7) Request For Information submitted by a sub-contractor to the Contractor.

b. The Government’s action may include a request for additional information, in which case the time for response will date from time of receipt of additional information.

c. The Government’s action on RFIs that may result in a change to the Contract Time or the Contract Sum may be eligible for Contractor to submit Change Proposal.

1) If Contractor believes the RFI response warrants change in the Contract Time or the Contract Sum, notify Contacting Officer and COR in writing within 10 days of receipt of the RFI response.

5. RFI Log: Prepare, maintain, and submit a tabular log of RFIs organized by the RFI number.

Submit log weekly with not less than the following information:

a. Project name.

b. Name and address of Contractor.

c. Name and address of Contacting Officer and COR.

d. RFI number including RFIs that were dropped and not submitted.

e. RFI description.

f. Date the RFI was submitted.

g. Date the Contacting Officer’s response was received.

6. On receipt of the Government’s action, update the RFI log and immediately distribute the

RFI response to affected parties. Review response and notify the Government within seven days if Contractor disagrees with response.

a. Identification of related Minor Change in the Work, Construction Change Directive, and Proposal Request, as appropriate.

b. Identification of related Field Order, Work Change Directive, and Proposal Request, as appropriate.

C. Project Meetings

1. General: Schedule and conduct meetings and conferences at Project site unless otherwise indicated.

a. Attendees: Inform participants and others involved, and individuals whose presence is required, of date and time of each meeting. Notify the Facility Director, the Contracting officer and the COR of scheduled meeting dates and times.

b. Agenda: Prepare the meeting agenda. Distribute the agenda to all invited attendees.

c. Minutes: Entity responsible for conducting meeting will record significant discussions and agreements achieved. Distribute the meeting minutes to everyone concerned, including the Contracting Officer and the COR, Construction Manager, and Architect, within three days of the meeting.

2. Preconstruction Conference: The Contracting Officer will schedule a preconstruction conference before starting construction, at a time convenient to the Contracting Officer, COR, Facility Director, On-Site Government Inspector and Contractor.

a. Attendees: Authorized representatives of the Contracting Officer, Government

Project Manager, Owner's Commissioning Authority, Construction Manager, Engineer, and their consultants; Contractor and its superintendent; major subcontractors; suppliers; and other concerned parties shall attend the conference.

Participants at the conference shall be familiar with Project and authorized to conclude matters relating to the Work.

b. Agenda: Discuss items of significance that could affect progress, including the following:

1) Tentative construction schedule.

2) Phasing.

3) Critical work sequencing and long-lead items.

4) Designation of key personnel and their duties.

5) Procedures for processing field decisions and Change Orders.

6) Procedures for RFIs.

7) Procedures for testing and inspecting.

8) Procedures for processing Applications for Payment.

9) Distribution of the Contract Documents.

10) Submittal procedures.

11) Retain first subparagraph below for projects with LEED or other sustainable design documentation requirements.

12) Preparation of record documents.

13) Use of the premises and existing building.

14) Work restrictions.

15) Working hours.

16) Owner's occupancy requirements.

17) Responsibility for temporary facilities and controls.

18) Procedures for moisture and mold control.

19) Procedures for disruptions and shutdowns.

20) Construction waste management and recycling.

21) Parking availability.

22) Office, work, and storage areas.

23) Equipment deliveries and priorities.

24) First aid.

25) Security.

26) Progress cleaning.

c. Minutes: Entity responsible for conducting meeting will record and distribute meeting minutes.

3. Progress Meetings: Conduct progress meetings at regular intervals as directed by the Contracting officer and/or the COR.

a. Attendees: In addition to representatives of the Government, Construction Manager, and Engineer (as applicable), each contractor, subcontractor, supplier, and other entity concerned with current progress or involved in planning, coordination, or performance of future activities shall be represented at these meetings. All participants at the meeting shall be familiar with Project and authorized to conclude matters relating to the Work.

b. Agenda: Review and correct or approve minutes of previous progress meeting.

Review other items of significance that could affect progress. Include topics for discussion as appropriate to status of Project.

1) Contractor's Construction Schedule: Review progress since the last meeting.

Determine whether each activity is on time, ahead of schedule, or behind

S.O.W. - 12 schedule, in relation to Contractor's construction schedule. Determine how construction behind schedule will be expedited; secure commitments from parties involved to do so. Discuss whether schedule revisions are required to ensure that current and subsequent activities will be completed within the Contract Time.

a) Review schedule for next period.

2) Review present and future needs of each entity present, including the following:

a) Interface requirements.

b) Sequence of operations.

c) Status of submittals.

d) Retain first subparagraph below for projects with LEED or other sustainable design documentation requirements.

e) Deliveries.

f) Off-site fabrication.

g) Access.

h) Site utilization.

i) Temporary facilities and controls.

j) Progress cleaning.

k) Quality and work standards.

l) Status of correction of deficient items.

m) Field observations.

n) Status of RFIs.

o) Status of proposal requests.

p) Pending changes.

q) Status of Change Orders.

r) Pending claims and disputes.

s) Documentation of information for payment requests.

c. Minutes: Entity responsible for conducting the meeting will record and distribute the meeting minutes to each party present and to parties requiring information.

1) Schedule Updating: Revise Contractor's construction schedule after each progress meeting where revisions to the schedule have been made or recognized. Issue revised schedule concurrently with the report of each meeting.

1.14 GENERAL QUALITY REQUIREMENTS

A. Testing and inspecting services are required to verify compliance with requirements specified or indicated. These services do not relieve Contractor of responsibility for compliance with the Contract Document requirements.

1. Specified tests, inspections, and related actions do not limit Contractor's other quality assurance and quality control procedures that facilitate compliance with the Contract Document requirements.

2. Requirements for Contractor to provide quality assurance and quality control services required by Contracting Officer or authorities having jurisdiction are not limited by provisions of this Section.

3. Specific test and inspection requirements are specified in Part 2 “Execution of Work”.

B. Reports and Documents: Test and Inspection Reports: Prepare and submit certified written reports specified in other Sections.

C. Permits, Licenses, and Certificates: For Government's records, submit copies of permits, licenses, certifications, inspection reports, releases, jurisdictional settlements, notices, receipts for fee payments, judgments, correspondence, records, and similar documents, established for compliance with standards and regulations bearing on performance of the Work.

D. Quality Assurance

1. General: Qualifications paragraphs in this article establish the minimum qualification levels required; individual Specification Sections specify additional requirements.

2. Specialists: Certain Sections require that specific construction activities shall be performed by entities who are recognized experts in those operations. Specialists shall satisfy qualification requirements indicated and shall be engaged for the activities indicated.

E. Quality Control

1. Contractor Responsibilities: Tests and inspections not explicitly assigned to Government are Contractor's responsibility. Perform additional quality control activities required to verify that the Work complies with requirements, whether specified or not.

a. Where services are indicated as Contractor's responsibility, engage a qualified, independent testing agency to perform these quality-control services.

b. Testing and inspecting requested by Contractor and not required by the Contract Documents are Contractor's responsibility.

2. Retesting/Reinspecting: Regardless of whether original tests or inspections were Contractor's responsibility, provide quality-control services, including retesting and reinspecting, for construction that replaced Work that failed to comply with the Contract Documents.

3. Testing Agency Responsibilities: Cooperate with Contracting Officer and Contractor in performance of duties. Provide qualified personnel to perform required tests and inspections.

a. Notify Contracting Officer and Contractor promptly of irregularities or deficiencies observed in the Work during performance of services.

b. Determine the location from which test samples will be taken and in which in-situ tests are conducted.

c. Conduct and interpret tests and inspections and state in each report whether tested and inspected work complies with or deviates from requirements.

d. Submit a certified written report, in duplicate, of each test, inspection, and similar quality control service through Contractor.

e. Do not release, revoke, alter, or increase the Contract Document requirements or approve or accept any portion of the Work.

f. Do not perform any duties of Contractor.

4. Associated Services: Cooperate with agencies performing required tests, inspections, and similar quality-control services, and provide reasonable auxiliary services as requested.

Notify agency sufficiently in advance of operations to permit assignment of personnel.

5. Coordination: Coordinate sequence of activities to accommodate required quality assurance and quality control services with a minimum of delay and to avoid necessity of removing and replacing construction to accommodate testing and inspecting.

a. Schedule times for tests, inspections, obtaining samples, and similar activities.

F. Special Tests and Inspections

1. Special Tests and Inspections: Conducted by a qualified testing agency or special inspector as required by authorities having jurisdiction, as indicated in individual Specification Sections and as follows:

a. Retain six subparagraphs below with one of two "Special Tests and Inspections" paragraphs above. Retain first subparagraph only with "special inspector" option retained "Special Tests and Inspections" Paragraph.

b. Verifying that manufacturer maintains detailed fabrication and quality-control procedures and reviews the completeness and adequacy of those procedures to perform the Work.

c. Notifying Contracting Officer and Contractor promptly of irregularities and deficiencies observed in the Work during performance of its services.

d. Submitting a certified written report of each test, inspection, and similar quality-control service to Contracting Officer with copy to Contractor and to authorities having jurisdiction.

e. Submitting a final report of special tests and inspections at Substantial Completion including a list of unresolved deficiencies.

f. Interpreting tests and inspections and stating in each report whether tested and inspected work complies with or deviates from the Contract Documents.

g. Retesting and reinspecting corrected work.

h. Any other tests that were performed for the project.

G. Submit the following in accordance with provisions of Section 1.13 “Project Management and Coordination”.

1. Copy of Testing Agency’s qualifications.

1.15 TEMPORARY FACILITIES AND CONTROLS

A. General: Installation and removal of and use charges for any temporary facilities shall be included in the Contract Sum unless otherwise indicated. Allow other entities to use temporary services and facilities without cost, including, but not limited to testing agencies, and authorities having jurisdiction.

B. Temporary Services and Facilities:

1. Potable and Non-potable water: Contractor shall provide potable and non-potable water without payment for uses directly related to the project.

2. Sanitary Facilities: Contractor shall provide temporary toilets and wash facilities for use of construction personnel. Comply with requirements of authorities having jurisdiction for type, number, location, operation, and maintenance of fixtures and facilities.

3. Electrical service: Contractors shall provide all temporary electrical service for the performance of the work. Provide connections and extensions of services as required for construction operations.

4. Lighting: Contractor shall provide temporary lighting with local switching that provides adequate illumination for construction operations, observations, inspections, and traffic conditions.

5. Telephone Service: Contractor shall provide temporary telephone service cellular telephone or portable two-way radio use by all construction personnel.

C. Equipment

1. Fire Extinguishers: Portable, UL rated; with class and extinguishing agent as required by locations and classes of fire exposures.

D. Waste Disposal: Fuels, lubricants, petroleum products, chemicals or other waste materials shall be disposed of in properly designated areas off Government premises.

E. Barricades, Warning Signs, and Lights: Comply with requirements of authorities having jurisdiction for erecting structurally adequate barricades, including warning signs and lighting.

F. Maintenance: Maintain operation of temporary enclosures, heating, cooling, humidity control, ventilation, and similar facilities on a 24-hour basis where required to achieve indicated results and to avoid possibility of damage until removal.

1.16 CLOSEOUT PROCEDURES

A. Submittals Prior to Completion: Complete the following a minimum of 10 days prior to requesting inspection for determining date of Substantial Completion. List items below that are incomplete at time of request.

2. Submit closeout submittals specified in individual Sections, including specific warranties, workmanship bonds, maintenance service agreements, final certifications, and similar documents.

3. Final reports of all inspection/test results

1.17 FINAL CLEANING

A. Perform final cleaning. Conduct cleaning and waste-removal operations to comply with local laws and ordinances and Federal and local environmental and antipollution regulations.

1.18 REPAIR OF THE WORK

A. Repair or remove and replace defective construction. The Contractor shall be liable for damages to roads, pavement, utilities, structures, and property, due to any act, omission, neglect, or

S.O.W. - 16 misconduct during the period of performance of the services of this contract.

PART 2 - EXECUTION OF WORK

2.1 GENERAL

B. The Contractor shall provide and pay for labor, materials, tools, construction equipment and machinery, transportation and other facilities and services necessary for proper execution and completion of Work, whether temporary or permanent, and whether or not incorporated in the Work.

C. Perform work in accordance with the approved Construction Documents.

D. Perform work in accordance with all applicable Federal, State and local regulations.

2.2 PROJECT REQUIREMENTS

A. Construct work in accordance with technical specifications incorporated into the attached Project

Drawings.

2.3 PERFORMANCE

A. The project shall be completed and available for use by the Station within 45 calendar days from the date the Notice to Proceed (NTP) is issued.

B. The Contractor shall procure all permits and licenses, pay all fees and taxes, and give notices necessary to perform the services of the contract.

C. The Contractor shall be liable for damages to roads, utilities, structures, and property, due to any act, omission, neglect, or misconduct during the period of performance of the services of this contract.

END OF STATEMENT OF WORK

PART 1 - GENERAL REQUIREMENTS
1.1 SUMMARY
A. The Contractor shall furnish all labor, materials, and equipment necessary to construct the following work:
1. Furnish and install water supply piping, valves, and fittings with associated earthwork as indicated in the Project Drawings and described in the this Statement of Work.
2. Work generally includes the following activities:
a. Remove and dispose of all existing piping within new pipe alignment.
b. Install approximately 470 linear feet of 8-inch diameter C900, DR18, PVC pipe
c. Install approximately 360 linear feet of 6-inch diameter C900, DR18, PVC pipe
d. Install approximately 30 linear feet of 4-inch diameter C900, DR18, PVC pipe
e. Install approximately 30 linear feet of 6-inch diameter ductile iron pipe
f. Install approximately 30 linear feet of 6-inch schedule 40 PVC pipe
g. Install 1 each, new 8-inch gate valves with valve boxes
h. Install 2 each, new 6-inch gate valves with valve boxes
i. Install 1 each, new 4-inch gate valve with valve boxes
j. Recover and install 2 each, existing 8-inch gate valves and install new valve boxes
k. Install all ductile iron fittings at junctions as shown, inclusive of all mechanical joints.
l. Install all vertical and horizontal ductile iron fittings, inclusive of all mechanical joints, to achieve fully restrained piping network that conforms to indicated vertical and horizontal alignment requirements.
m. Install 2 each new 6-inch wafer type butterfly valves with handwheels. Match existing type.

1.6 PERFORMANCE

D. Noise, Vibration, and Odors: Coordinate operations that may result in high levels of noise and vibration, odors, or other disruptions to the Government.

1.8 APPLICABLE CODES, STANDARDS AND SPECIFICATIONS
A. All work shall comply with the codes and standards applicable to each type of work as listed in individual Sections of this Statement of Work and the Project Drawings.
B. Where a conflict occurs between a referenced document and the Project Specifications, the Project Specifications govern.
C. Where a conflict occurs between referenced documents, the document containing the most stringent requirements governs.
D. Where referenced documents are not specified by date, the document current at the bid opening applies.
E. Materials, applications, and tests specified by reference to published standards of society, association, code, or other published standards are included in the specifications as if written in their entirety.
F. Conform to all regulations and statutes of the State of North Dakota and to all Federal Regulations which apply.
1.9 MEANS AND METHODS
A. Means and methods of construction shall be such as the Contractor or subcontractors may choose; subject, however, to the Contracting Officer's right to reject means and methods proposed which:
1. Constitute a hazard to the work, persons, or property.
2. Will not produce finished work in accordance with terms of the contract.
3. Are contrary to specified means or methods included in the contract.
B. The right to reject means and methods of the Contractor or subcontractor shall not be construed or interpreted as acceptance of control of means and methods by the Contracting Officer.
C. The Contracting Officer's approval of means and methods or failure to exercise right to reject means and methods shall not relieve the Contractor of the obligation to complete the work required by the contract.
D. Total responsibility for control of all means and methods lies with the Contractor for all work.
