SECTION B – NATIONAL ENVIRONMENTAL POLICY ACT (PROJECT)

B1.0 Nesting Birds

The nesting bird season is from February 15 thru August. If the project takes place during this time period, the Contractor shall provide a person with knowledge of nesting birds to be onsite and monitoring the construction area for the presence of nesting birds.

That person will need to continuously monitor for nesting birds on a daily basis during the project work hours.

B2.0 Desert Tortoise

Contractor shall comply with the following special stipulations developed to protect the desert tortoise.

a) Should a desert tortoise enter the area of activity, all activity shall cease until the animal has left the area of its own accord.

b) Workers shall be instructed to check underneath all vehicles before moving them as tortoises often seek shade underneath parked vehicles during the active season.

c) Workers will be provided educational information on the desert tortoise including their legal protection and consequences for Endangered Species Act violations.

2.1 Tortoise Monitor: Contractor to provide a desert tortoise monitor for the project. Before any mobilization or construction activities commence, the contractor shall submit to BLM for review and approval the resume of the monitor that will be used for the project. If the project takes place during the tortoise active season (March thru October), then an Authorized Desert Tortoise Biologist will have to be on site to monitor the project. The Authorized Desert Tortoise Biologist will need to submit their resume to United States Fish and Wildlife Service for review and approval prior to their engaging in this project service.

2.2 Tortoise Fencing: Install and maintain approved temporary tortoise-proof fencing around open excavations in accordance with section 2.2 thru 2.2.4 of this Statement of Work.

2.2.1 Fencing Installation: Install fencing all at one time or in phases along portions of the entire construction site to match construction activity and to encompass active construction area including staging areas and access roads.

Install fencing without ground disturbance outside of the fence line.

2.2.2 Approved Temporary Tortoise Fencing: Approved temporary tortoise fencing consists of 1 by 2-inch mesh, 14-gauge galvanized wire fence, 3-inches wide. Extend the top 18 to 24-inches of fence, with inch opening of mesh positioned vertically, above ground and firmly attached to the Site security chain link fence or 12 gauge galvanized smooth wire. Attach fence mesh to fence posts with 12 gauge galvanized smooth wire. Use hog rings at intervals of 1 foot to attach the 1 by 2-inch mesh to fence or wire. The bottom 12 inches of fence must be either buried vertically or bent at a right angle towards the outside of the work area and covered with 3 to 6-inches of dirt, rocks, or gravel from surrounding area. Place fence posts at appropriate intervals no more than 8 to 10 feet) for visibility to not pose a safety hazard to humans. Provide adequate fence grounding to prevent electric shock to workers and other Project personnel.

2.2.3 Fence Entrance and Exits: Install gates at appropriate access points with no more than 1inch ground clearance to deter ingress by desert tortoises. If necessary, install a concrete foundation under the gate to prevent erosion and maintain less than inch of clearance between gate and ground. Keep gates closed when not actively in use to prevent tortoise entry.

In place of or in addition to gates, install tortoise proof guards.

Acceptable design consists of two parallel steel I-beams, spaced 8-inches apart. A minimum 8-inch gap will prevent tortoise entry. A trench between the I-beams at a depth of 8 to12-inches with bedding material (soft soil or sand) will catch a tortoise that falls through the gap.

2.2.4 Integrity of Tortoise Fence: Maintain integrity of tortoise proof fence throughout project construction. If the fence is damaged during work, notify Government and stop work in the area of the damaged fence until fence is repaired to a standard acceptable to Government. Regular maintenance of the fence includes removal of trash and sediment accumulations, repair of any damage, and restoration of zero clearance between ground and bottom of the fence as needed.

2.3 Inspections by Contractors Biologist: Prior to any surface disturbance and after the fence route has been flagged, Contractors biologist shall conduct a desert tortoise clearance of the flagged area before the fence is installed. The Contractors biologist shall inspect and approve completion of the tortoise-proof fencing.

Contractors biologist shall conduct desert tortoise clearance survey of area(s) enclosed by fence and along exterior perimeter before Contractor conducts any initial ground disturbing activities, including but not limited to clearing and grubbing, blading, grading, or placement of equipment inside fenced area.

B3.0 Landscape Preservation

Preserve natural landscape and protect existing vegetation not authorized to be removed. Conduct operations to prevent injury to natural surroundings in vicinity of

Work. Move crews and equipment within rights-of-way and over routes provided for access to Work in manner to prevent damage to grazing land, crops, or property.

3.1 Protect Vegetation: Protect vegetation from damage or injury caused by construction operations, personnel, or equipment by use of protective barriers or other methods approved by Government. Provide access routes as approved by Government.

3.2 Tree Anchorages: Do not use trees for anchorages.

3.3 Damaged Vegetation: Repair or treat damaged vegetation; replace trees or shrubs as directed by Government. Contractor shall be responsible for injuries to vegetation caused by Contractor operations, personnel, or equipment. Repair or treat damaged vegetation, without delay as recommended by and under direction of experienced horticulturalist or licensed tree surgeon.

B4.0 Temporary Roads

Restore temporary roads to original landscape contours and make impassable to vehicular traffic when no longer required. Scarify and regrade Government land used for construction purposes and not required for completed installation so that surfaces blend with natural terrain and are in a condition that will provide proper drainage and prevent erosion.

B5.0 Transplanted Flora

This work consists of transplanting cacti and yucca which includes salvaging protected/sensitive cacti and yucca species within the area of the project limits, transporting, stockpiling, replanting and maintenance which includes temporary protection fences, barriers, and signs as required for protection.

5.1 Qualifications: Company shall have minimum of 5 years of experience working regularly with salvage of native and protected/sensitive plant species including collection, transplanting, non- irrigated revegetation and maintenance operations within the Mojave Desert. Prior to the preconstruction conference, the company shall submit a detailed description of a minimum of 5 previous native plant salvage/revegetation projects (with reference contact information) where this work was successfully completed by members of this company. The work individuals completed while with a different company will not be considered.

5.2 Action Submittals: All submitted deliverables must be approved by the Government. The following submittal items will be required at the Preliminary Review Meeting, Pre-Final Review Meeting, and Final Review and Submittal:

a. Work plan for cactus survey;

b. Before and after photos of cacti and yucca;

c. Work plan for transplanting;

d. Schedule for cactus and yucca survey and transplanting;

e. Shipping permit from BLM (if transfer offsite is required); and

f. Maintenance plan.

5.3 Survey and Evaluation of Cacti and Yucca: Prior to any disturbance, the project site must be surveyed for cacti and yucca by a qualified biologist paid for by the contractor. The surveyor must provide a list of numbers of cacti and yucca by species. If hundreds of plants are known to occur, an estimate may be provided based on counting plants within a specific area (e.g., 0.12 mile) and then calculating the entire area to be disturbed. A copy of the evaluation shall be forwarded to the BLM forestry staff.

5.4 Salvaging Cacti and Yucca: Prior to any disturbance, cacti and yucca that will be impacted will be appropriately salvaged. The following pants require salvaging:

a) Joshua trees;

b) barrel cactus;

c) cottontop cactus;

d) hedgehog cactus;

e) all yucca over 1-foot tall;

f) all other cacti over 1-foot tall or 1-foot wide including prickly pear and cholla; and

g) cacti and yucca less than 1-foot tall and cholla cacti do not need to be salvaged.

Cooler months are best for salvage, but removal can occur at any time of the year.

Cacti and yucca are very shallow rooted and thus easy to remove. Cacti and yucca do not require being planted immediately. One or two weeks of drying time will decrease the chance for root infection, especially if the roots become damaged during digging.

Yuccas do require immediate transplanting. Joshua trees are sensitive to being moved.

Barrels and Joshua trees require that the north side of the plant be identified and marked, using flagging or other marking. These two species need to be planted in the same orientation as they were originally growing in to survive. Other succulents don't seem to care about orientation. A front end loader or other heavy equipment is necessary for the larger plants. Clonal (clumped) yucca can be salvaged as separate plants with great success (each has its own root system).

5.5 Compliance: The Government will evaluate whether proper salvage has been done for the project. Cost recovery charges for lost or destroyed cacti and yucca will be applied at fair market value. In addition, staff time and vehicle costs for non-compliance will be added.

5.6 Establishment Period: During the plant establishment period, a minimum of 80 percent survival rate per plant species shall be maintained at the end of 1 year. Payment will be directly tied to the survival rate. A payment of 100 percent will be made for a survival rate of 80 percent or greater. Payment will be reduced by 5 percent for each 5 percent drop-in survival rate.

5.7 Transplanting Flora: The work of transplant flora shall consist of salvaging cacti and yucca within the area of the Project limits, transporting, stockpiling and replanting salvaged cactus and yucca in approved area(s). Salvaged cacti and yucca are the property of the Government.

a) Replant each temporarily removed cacti and yucca only after construction activities are completed and applicable grading is completed in its vicinity.

Replant cacti and yucca in locations shown or approved.

b) Excavate cactus and remove in a manner that preserves the root system.

c) Transport cactus to designated nursery locations(s) minimizing damage to any of the roots, stems or any part of the plants.

d) Replant cacti and yucca.

e) Maintain transplanted materials.

5.8 Salvage/Extraction: Coordinate all plant salvage/extraction work with the Government. Reuse top 4-inches of native soil which has been stockpiled.

a) Do not begin cactus salvage activities until areas are enclosed with tortoise proof fencing and cleared of desert tortoise.

b) When not planted in new location directly, transfer the salvaged plants to prepared trenches, 3-foot wide, 12 inches deep of any desired length. If using multiple, parallel trenches, trenches shall be spaced far enough apart to allow heavy equipment access to each trench. Thoroughly water trenches prior to transplanting material.

c) Plant stockpiled plants in trench with native soil. Properly tamp down and compact all soil around roots of plant to remove air pockets. After planting, thoroughly water one time, be sure to remove or minimize any air pockets and assure proper soil compaction.

d) For water harvesting purposes provide depressed basins with channel formed on the uphill/grade side to bring water to the transplanted cacti and yucca. The center of basin at plant base shall be slightly mounded so that water drains away from the base of the plant into the depression.

e) Plants, especially the cacti and yucca shall be planted at the same depth that they were growing in their native environment. Plants shall be planted so that they are slightly mounded and water drains away from the base of the plant, but into the depression. Water should not be allowed to persist or stand at the base of the plant. All plants shall be regularly monitored (every other day for the first 2 weeks, every 15th day thereafter) for soil moisture and thoroughly watered before "dry". In addition, regular watering is to be scheduled at a minimum of every 30 days after replanting plants in stockpiling trenches.

f) Support cacti and yucca immediately after planting to maintain plumb position if necessary. Do not prune cacti and yucca. All cacti and yucca that expire shall be left in place as habitat and mulch. Protect transplant areas against damage for duration of maintenance period.

g) Guying and staking material shall follow standard practice for cacti and yucca.

h) Pesticide and herbicide will not be allowed on project unless specifically approved by BLM during the maintenance period. Fertilizer will not be allowed on transplanted cacti or yucca.

5.9 Watering: There is no irrigation system. All plants shall be watered through the end of the plant establishment period using clean potable water from a portable or temporary source to hand apply water to plants. Individually water all plants. Manually check plants at a minimum of every 2 weeks with a 9-inch spoil moisture probe. If readings indicate "dry" soil conditions, adjust watering frequency as needed. The Contractor shall document probe results and locations where measurements were taken with description of actions taken on a spreadsheet report. Submit probe report every 2 weeks with the water report to the Government. Watering frequency shall be based on probe reading results.

Furnish a watering schedule spreadsheet for the plant establishment period that includes the date and time of day work to be performed. Submit schedule for review and approval prior to the plant establishment period. During plant establishment period, submit a signed watering report every 2 weeks to the Government.

5.10 Maintenance: Commence to maintain plant life immediately after transplanting.

The plant establishment maintained period shall run for a period of 12 months beginning from the date of Substantial Completion.

Maintain cacti and yucca as follows:

a) Cacti and yucca shall be maintained in a manner to retain the vigor and appearance of native plants of the same species growing nearby.

b) Maintain the cacti and yucca species in a manner to avoid rot and so they do not appear wrinkled or shriveled.

c) Maintain by watering, cultivating and weeding as required for healthy growth. Restore planting saucers.

d) Tighten and repair stake and guy support and reset to poorer grades or vertical position as required.

e) Spray as required and approved by the Government to keep cacti free of insects and disease.

f) Remove guys, stakes, and other supports at end of maintenance service.
