Casa Blanca Community School

Phase I Environmental Site Assessment Statement of Work (SOW)

A. Introduction:

The Gila River Indian’s Tribally Controlled School, Casa Blanca Community School, has a new facility constructed at a new location. The tribe would like to terminate the existing lease with Indian Affairs of the old school and have ownership of the old school buildings leased from BIE transferred to the tribe.

Before transfer, a determination needs to be made by BIE as to the presence of hazardous materials and the potential environmental impacts associated with transfer of ownership to a tribal entity. This SOW provides the purpose and requirements of a Phase I Environmental Site Assessment (Phase I ESA) survey intended for determining the range of contaminants within the scope of the Comprehensive Environmental response, Compensation, and Liability Act (CERCLA) (42 U.S.C. § 9601) and petroleum products.

The facilities, grounds, and ground structures to be the subject of the Phase I ESA are located at 3455 W. Casa Blanca Road, Bapchule, AZ, 85121.

B. General Information

1. The purpose of this SOW is to establish the work requirements, applicable standards, performance requirements, schedule, and services needed to complete a preliminary site assessment and initial hazardous materials survey as outlined in the SCOPE section.

2. The report provided from this task order will be used and shared with the Gila River Indian Tribe to identify any hazards or concerns with the facilities to be transferred.

3. The Contractor shall meet with designated representatives of the BIE, and school officials to gather information an input for assessing the facilities to be transferred to Gila River Indian Tribe. The Contractor shall furnish sufficient technical, supervisory, and administrative personnel and all materials, supplies, equipment, investigations, studies, and travel required in connection with this work and as outlined in the SCOPE section.

4. The Contractor shall hire consultants and subcontractors that have current licenses, certifications, and registrations as required by applicable federal, state or local jurisdictions as necessary for the appropriate surveys, site inspections, and removal/transporting/disposal of hazardous material or and other regulated activity relative to the SOW.

5. The BIE is responsible for providing the Contractor with the appropriate points of contact to coordinate with for the project’s duration.

6. The Contractor is required to obtain background clearances for as outlined in BIE SOP-808: Pre-Screening Requirements for Temporary, Non-Recurring Individuals Needed to Provide Work or Services. Reference Section 7- Background Check Requirements.

C. Scope

1. The Contractor shall furnish all materials, equipment, and personnel necessary to manage and accomplish the work. The Government will rely on the Contractor’s expertise in recognizing and addressing problematic issues. It is the Government's Clear expectation that the Phase I ESA executed against the contract shall exhibit superior quality, responsiveness, and customer service.

2. The Contractor’s responsibility shall include all contractor planning, programming, administration, coordination, and management necessary to provide all work as specified. The work shall be conducted by the Contractor in strict accordance with the contract and all applicable Tribal, Federal, State, and local laws, regulations, codes, and directives. The Contractor shall ensure that all work provided meets or exceeds critical reliability rates or tolerances specified and/or included in applicable documents.

D. Task Identification

1. Preliminary Site Assessment Report

A. Section I-General Environmental Concerns The Contractor shall complete a site assessment and prepare a report.

This assessment shall identify:

a) Identification of hazards and environmental liabilities.

b) Specific needs for disposal of any identified hazardous materials.

B. Section II- Hazardous Material Survey

The Contractor shall complete a hazardous material survey of the existing building(s) and determine the extent of the presence of asbestos, lead-based paint, and other hazardous construction materials within the asset, up to but not exceeding, the point of original utility connection(s).

The survey shall identify:

a) The measured (or estimated) quantity and condition of any hazardous materials observed. In cases where quantities are estimated rather than measured, the report shall identify the impediments that made measurement impracticable. The standard for impracticability shall be high; that is, the Government desires a high quality of information about existing hazardous materials, within the upper parameters of industry standard.

b) Drawings and supporting information (e.g. photos, sketches, etc.) identifying the location of any hazardous materials.

C. Section III-Potential Historic & Cultural Significance Survey The Contractor shall contact the appropriate department or agency responsible for clearing the building of historic significance to determine if there are any potential historic or cultural concerns.

Contractor shall source and provide any cultural Resources Compliance or Clearance forms that may be available form the local authority.

The survey shall identify:

a) Any existing information on the history of the buildings, including any previously completed compliance documents associated the National Environmental Policy Act (NEPA), National Historic Preservation Act (NHPA), evaluations of eligibility for the National Register of Historic Places, or similar evaluation processes.

b) During a site visit, the Contractor shall gather site photos to support an independent determination of eligibility and/or be responsive to requests for additional information from the Gila River Indian Tribe.

c) If there is no pre-existing confirmation that the buildings are not culturally significant, the contractor shall meet with the cultural and historic authority to obtain a Preliminary Statement of Potential Historical or Cultural Impact. This finding shall be in writing, but no specific form is required.

The review of potential historic or cultural concerns called for in this section will be limited to research of existing materials, reports, compliance records, and other information, aka Class I research (no on-site archeological review). However, it is possible that additional resource review (e.g. a Class III review) will be recommended and will need to be performed to provide sufficient information to develop the Assessment of Effect (AoE) and thus conclude compliance with the National Historic Preservation Act.

D. Section IIII- Facilities Information This information shall be generally but accurately portrayed. Quantities shall be provided at plus/minus 10% accuracy.

E. Section V- Supplemental Information

a) Provide digital exterior photos of the building and surrounding areas.

b) Identify the utility providers of utilities serving the building.

F. Section VI- Buildings to be transferred to and the subject of this Phase I

ESA

In the provided map (below), the lease boundaries are identified with a yellow outline. The tribe requests 100% of all buildings within the lease boundaries be transferred to them. BIE has agreed to pursue transferring the buildings on the current lease. The Phase I ESA will be completed to identify all hazards and BIE will remediate the hazards before facilities, grounds, and ground structures are transferred to the Gila River Indian Tribe.

E. Time Frames and Deliverables

1. Background investigations are required in connection with this project. The documentation required to initiate any background investigations required shall be completed and submitted to the BIE within 10 days after contract award. The Government may take up to 40 days to adjudicate background investigations.

This 40-day timeframe has been included in calculations of the period of performance. The Government will grant one day of time extension to the period of performance for each day of delay in adjudication of the background investigation beyond the anticipated 40 days ONLY for investigations where documentation was submitted within 10 days of contract award. For all documentation submitted after the 10-day window, regardless of reason for late submission, the contractor will be solely responsible for all delays related to background investigations. For example, contractor personnel whose background investigations are negatively adjudicated may require the contractor to submit documentation for replacement personnel or routine personnel changes that occur during contract execution may require additional background investigations. It is solely the contractor’s responsibility to submit documentation for background investigations in a timeframe that allows for completion within the contract period of performance. The project shall be completed within 150 days of project award.

2. Phase I ESA Deliverable A. Phase I ESA Report. The Report submitted by the contractor shall include the following:

1. Scope of Services- The report shall describe all services performed in sufficient detail to permit another party to reconstruct the work performed.

2. Findings – The report shall have a findings section which summarizes known or suspect environmental conditions associated with the facilities to be transferred.

3. Opinion – The reports shall include the environmental professional’s opinion(s) of the impact on the facilities of known or suspect environmental conditions Identified in the findings section.

4. Conclusions – The report shall include a conclusions section that summarizes all recognized environmental conditions connected with the facilities and the impact of these recognized environmental conditions.

5. Deviations – All deletions and deviations from the ASTM E1527-00 practice (if any) shall be listed individually and in detail and all additions should be listed.

6. References – The report shall include a references section to identify published referenced sources relied upon in the preparing the Phase I ESA report.

7. Signature – The environmental professional(s) responsible for the Phase I ESA shall sign the report.

8. Qualifications – The report shall include a qualifications statement of the environmental professional(s) responsible for conducting the Phase I ESA and preparation of the report.

a) Environmental Professional means:

A person who possesses sufficient specific education, training, and experience necessary to exercise professional judgment to develop opinions and conclusions regarding conditions indicative of releases or threatened releases on, at, in, or to a property, sufficient to meet the objectives and performance factors in §§ 312.20(e) and (f).

b) Such a person must: (i) hold a current Professional Engineer’s or Professional Geologist’s license or registration from a state, tribe, or U.S. territory (or the Commonwealth of Puerto Rico) and have the equivalent of three (3) years of full-time relevant experience; or (ii) be licensed or certified by the federal government, a state, tribe, or U.S. territory (or the Commonwealth of Puerto Rico) to perform environmental inquiries as defined in §

312.21 and have the equivalent of three (3) years of full-time relevant experience; or (iii) have a Baccalaureate or higher degree from an accredited institution of higher education in a discipline of engineering or science and the equivalent of five (5) years of full-time relevant experience;

or (iv) have the equivalent of ten (10) years of full-time relevant experience.

9. Appendices- The report shall include an Appendix section containing supporting documentation.

3. The Contractor shall furnish the following to the BIE. A copy of the transmittal letter shall be provided to the CO:

F. Codes and Standards

1. The Contractor shall provide a multi-disciplined team to furnish services required to complete the work. Each responsible team member must be knowledgeable of and provide work in compliance with the most current editions of all applicable Federal, State, Tribal, and Local codes, standards, and guidelines as adopted by BIA/BIE including but not limited to:

2. Where applicable, the Contractor shall adhere to all Federal and State statutes pertaining to archaeological, historical, and environmental clearances which may affect this project. Strict adherence to the National Environmental Protection Act (NEPA) and the National Historic Preservation Act (NHPA), Section 106, shall be mandatory.

3. The Contractor shall follow all applicable environmental laws.
