STATEMENT OF WORK
REPLACEMENT OF WATER CONVEYANCE STRUCTURES
WITH IN DORRIS CANAL
U.S. Fish and Wildlife Service
Modoc National Wildlife Refuge (MNWR) – Alturas, California
May 28, 2024
1.0. GENERAL INFORMATION
1.1 Contractor shall provide materials and services to replace up to 13 varied, individual water control structures (WCS) along the Dorris Canal as described in this Statement of Work.
These structures are part of the infrastructure and operation of the Dorris Dam and an integral part of the Refuge’s water conveyance system which provides essential habitat for migratory birds. The Project is located at the Modoc NWR in Alturas, Modoc County, California.
1.2 Contractor’s Qualifications: Contractors shall be experienced and have demonstrated positive past performance with the installation and rehabilitation of water conveyance systems relating to high hazard dams.
1.3 Regulatory Requirements: It is the Contractor’s responsibility to construct the Project in compliance with applicable requirements of federal and state laws, codes, rules, regulations, ordinances, and standards.
2.0. WORK LOCATION AND PERIOD OF PERFORMANCE
2.1 Work Location: Modoc National Wildlife Refuge (MNWR), 5364 County Road 115, Alturas, California 96101. Two structures are located within the Refuge Right-of-Way on neighboring private property: Ewing Ranch, County Road 56, Alturas, Ca 96101.
Specific UTM Coordinates for water control structure replacement sites are noted on the attached Information Table and Location Map.
2.2 Period of Performance:
Start Date: August 15, 2024.
End Date: September 30, 2025.
The period of performance for this contract is tentative and subject to change. Actual project work window will depend on weather conditions and reservoir water levels. Contractor shall coordinate with the MNWR Refuge Manager for a proposed project work window. The final accepted work window will be mutually agreed upon between the Contractor and USFWS MNWR prior to work beginning.
3.0 DEFINITIONS
Not Used.
4.0 BACKGROUND
The Modoc National Wildlife Refuge (MNWR) is owned and operated by the U.S. Fish and Wildlife Service (USFWS). The Refuge is located approximately 3.5 miles southeast of Alturas, California and approximately 16 miles north of Likely, California. The nearest city/town is Alturas, California. The Refuge has identified a requirement for removal and replacement of 13 different water control structures including 2 squash culverts, one stop-board riser, and 10 screw gate structures of varying sizes as noted in the attached documents.
The project includes but is not limited to the following elements:
• Mobilization and de-mobilization.
• Staging of equipment and materials.
• Coordination with Refuge Manager and neighboring landowner for access to culverts located in the Right-of-Way.
• Survey of individual WCS sites to establish horizontal and vertical control points using the baseline elevation.
• Excavation and removal of existing structures.
• Placement of the new structures at existing elevations.
• Filling, backfilling, and compaction of fill and base coarse aggregate.
• Compaction testing of fill, backfill, and base coarse aggregate.
• Grading disturbed soil in work area to pre-project conditions.
• Disposal or recycling of old structures.
Please note, the above bulleted list is not intended to be comprehensive, it is simply provided as a baseline.
5.0. SCOPE OF WORK
Contractor is expected to complete the project to the specifications provided in this document.
Where specifications are not provided, the contractor shall contact the Refuge Technical Point of Contact to discuss options. At a minimum, and in the absence of any Technical Specifications, the Contractor shall perform Quality Assurance and Quality Control (QA/QC) Tests and
Inspections for work tasks performed. The QA/QC Tests and Inspections performed shall be in accordance with industry standards and consensus-based standards.
5.1 Contractor shall remove, dispose of, or recycle existing structures and replace with the corresponding water control structure listed in the attached table. Some new structures will be sized differently from existing structures and contractor may need to make adjustments during placement. Contractor will survey each structure to establish the baseline elevation as well as lateral and vertical control points to ensure the replacement structure is at the correct elevation for full function of the conveyance system. Replacement structures will be set on a base of at least 2 inches of base coarse aggregate with the bottom of the pipe section equal to the bottom of the ditch. The first layer of fill surrounding the structure and pipe will be at least 4 inches of base coarse aggregate to prevent rodent damage that can lead to “piping” of water around the structure. The remainder of fill will be local soil. All aggregate or soil brought in will be clean and weed free. Contractor will compact fill as they go to ensure secure placement of each structure. Contractor will measure and level each structure throughout the replacement process to ensure they are square and will function properly. Contractor will compaction test backfill and fill material placed to ensure it meets specifications.
5.2 Contractor is to replace no more than two structures at a time. This will ensure the dam system can be brought on-line in a timely manner in the event an emergency spill from the reservoir is required.
5.3 Staging of equipment and materials will be needed for this project. Specific staging areas will be discussed and agreed upon between the contractor and the Refuge Technical POC prior to mobilization. Contractor may use their own lock in conjunction with a Refuge lock to secure equipment and materials while construction activities are not being conducted.
5.4 Contractor will be responsible to return the project area back to pre-project conditions upon completion of the project. This will include replacing any fencing needed to be taken down for access, grading of roads and/or road edges, and removal of locks.
Compaction - Soils.
• Place backfill and fill soil materials in layers not more than 8 inches in loose depth for material compacted by heavy compaction equipment and not more than 4 inches in loose depth for material compacted by hand-operated tampers.
• Place backfill and fill soil materials evenly on all sides of structures to required elevations and uniformly the full length of each structure.
• Compact soil materials to not less than the following percentages of maximum dry unit weight according to ASTM D 1557:
For utility trenches, culverts, and water control structures, compact each layer of initial and final backfill soil material at 95 percent for soil materials located directly under structures and driving surfaces.
Field Quality Control - Soils.
• Special Inspections: Contractor will engage a qualified geotechnical engineering testing agency to perform the following special inspections:
• Determine prior to placement of fill that site has been prepared in compliance with requirements.
• Determine that fill material classification and maximum lift thickness comply with requirements.
• Determine, during placement and compaction, that in-place density of compacted fill complies with requirements.
• Testing Agency: Contractor will engage a qualified geotechnical engineering testing agency to perform tests and inspections.
• Allow testing agency to inspect and test subgrades and each fill or backfill layer. Proceed with subsequent earth moving only after test results for previously completed work comply with requirements.
• Testing agency will test compaction of soils in place according to ASTM D 1556, ASTM D 2167, ASTM D 2937, and ASTM D 6938, as applicable. Tests will be performed at the following locations and frequencies:
Foundation Wall Backfill (Water control structures): For compacted backfill layers placed, perform no fewer than two (2) tests for the project / contract.
Trench Backfill, Culvert Backfill, Water Control Structure Backfill: For compacted initial and final backfill layers placed, perform no fewer than four (4) tests for the project / contract.
When testing agency reports that subgrades, fills, or backfills have not achieved degree of compaction specified, scarify, and moisten or aerate, or remove and replace soil materials to depth required; recompact and retest until specified compaction is obtained.
6.0. GENERAL REQUIREMENTS.
Contractor shall provide supervision, labor, materials, equipment, tools, and services necessary for proper execution and completion of this project.
6.1 Quality Assurance: Contractor shall implement a Quality Assurance/Quality Control
(QA/QC) Plan to verify products and services are free of errors or omissions.
6.2 Communications: Contractor shall direct contract related inquiries in writing or electronically to the CO during the pre-solicitation, solicitation, and contract period of performance. Contractor shall direct technical-related inquiries in writing or electronically to the Refuge Manager or COR.
6.3 Pre-construction Meeting: After contract award and prior to commencement of work, the
Refuge and COR will arrange for a pre-construction meeting at the Modoc NWR Office.
Contractor shall attend the face-to-face meeting. Meeting is expected to take place within fourteen (14) days after issuance of the contract award and take no longer than two (2) hours.
Meeting will address the contract requirements and identify and resolve any ambiguities or discrepancies. Other topics include matters of significant interest, including who has authority to decide matters such as contractual, administrative (e.g., security, safety, and fire and environmental protection) and construction responsibilities. This meeting will also address area access, staging areas for equipment and materials, and any other questions or concerns that may arise.
6.4 Diligence: Contractor shall perform all project activities efficiently and with the requisite expertise, skill, and competence to satisfy the requirements of the contract documents.
Contractor shall, at all times, exercise complete and exclusive control over the means, methods, sequences and techniques used for this project.
6.5 Supervision: Contractor shall provide a Project Supervisor on-site at all times while work is underway. Supervisor shall have a good working knowledge of the project work.
6.6 USFWS Operations: USFWS operations have precedence over construction activities.
Contractor shall work with the Refuge Manager to schedule and coordinate all project activities so as not to unduly impact ongoing facility operations.
6.7 Security: Contractor shall effectively secure the worksite, staging areas, and materials storage areas. The Government shall be held harmless from any liability resulting from the contractor’s negligence to provide effective security.
6.8 Construction Safety: Contractor shall be ultimately responsible for health and safety on the worksite at all times.
a. Contractor shall provide barricades and warning devices as necessary to safeguard the public, workers, and Government personnel. Where project work affects public roads, Contractor shall provide signage in accordance with the current edition of the Manual on Uniform Traffic Control Devices (MUTCD), as published by the U.S. Department of Transportation (USDOT) Federal Highway Administration (FHWA).
b. Contractor shall initiate and maintain, throughout the performance of this contract, an effective health and safety program that provides adequate policies, procedures, and practices to protect workers from (and allow them to recognize) job-related health and safety hazards.
c. Each employee (Contractor or subcontractor) must be instructed in the recognition and avoidance of unsafe conditions and the regulations applicable to the work environment.
d. The contractor shall adopt the USACE Safety and Occupational Health (SOH) Program as a starting point for Safety Program requirements. In the event a more stringent Safety Program exists, the more stringent Safety Program shall be applied to the Contract / Project by the Contractor.
6.9 Site Cleanup: Contractor shall remove trash and debris from the worksite daily. Before completing the contracted work, Contractor shall remove any rubbish, tools, equipment, and materials that are not the property of the Government. Upon completion of work, Contractor shall leave the work area in a clean, neat, and in the same condition as prior to the project.

6.10 Material, Equipment, Transportation, Handling and Storage:
a. Government-owned equipment will not be made available to the Contractor for use within this contract. Government buildings and other facilities are not available for storage of the Contractor’s materials, equipment, and tools. The Government will designate areas for use during the project for materials and equipment. These areas will be discussed at the pre-bid site visit and during the pre-project meeting.
b. Contractor shall have a representative onsite to receive material deliveries. Contractor shall be responsible for all material deliveries, whether or not their representative is on-site at the time of delivery or not.
c. Contractor shall transport, handle and store materials and equipment in a secure manner and in accordance with the manufacturer’s written instructions.
d. Contractor shall promptly remove from the worksite any material(s) and equipment which are damaged or are otherwise unsuitable. This includes disposal or recycle of all WCSs removed from the project area.
7.0. GOVERNMENT FURNISHED ITEMS.
No Government Furnished Material or Government Furnished Equipment will be provided.
7.1. General: The Contractor shall furnish all supplies, equipment, facilities, and services required to perform work under this contract.
7.2. Materials: The Contractor shall furnish all materials, supplies, and equipment necessary to meet the requirements of this contract.
7.3. Equipment: The Contractor shall furnish all required equipment to meet the requirements to perform work under this contract.
7.4 Government Furnished Information: Government will supply a list of all needed water control structures including the type, size, and location specifications. In addition, a map with a corresponding table including UTM coordinates will be provided.
8.0. CODES AND STANDARDS.
8.1 Safety Standards: Contractor shall adhere to Occupational Safety and Health Administration
(OSHA) 29 CFR 1910 and 1926, as well as other applicable DOI, USFWS, State and local regulations. In the event of a conflict, the most stringent laws, codes, regulations, standards, and provisions shall apply.
9.0. INSPECTION AND ACCEPTANCE.
9.1 Inspection and acceptance will be determined by the USFWS.
9.2 Acceptance of the work is contingent on compliance with the requirements set forth in the specifications, and other documents awarded with (or referenced by) the contract for this project.
10.0. FINAL WALK THROUGH.
10.1 The USFWS will perform the final walk through as promptly as practicable.
10.2 The time required for such walk through and for making any corrections as a result thereof shall be included in the contract performance time.
10.3 The Contractor’s representative responsible for the work shall be present at the final walk through.
11.0. INVOICE AND PAYMENT.
11.1 General: Contractor shall not invoice between September 20th and October 20th, due to the seasonal financial system closure.
11.2 Progress Payments: Any monthly progress payments shall be invoiced and submitted in accordance with Clause 52.232-70. Invoices shall reflect the actual work performed at the time of submission. Prior to submitting invoices, they shall be sent to the COR for review and approval / disapproval.
11.3 Final Payment: Final payment shall be invoiced and submitted in accordance with Clause
52.232-70. Prior to submitting the final invoice, Contractor shall have submitted all closeout submittals. In addition, Contractor shall have been provided an approval by the USFWS stating any deficiencies have been corrected.
13.0. GOVERNMENT AVAILABILITY.
13.1 Government is available Monday thru Friday from 7:30 AM to 4:00 PM (Pacific Daylight
Time), excluding Federal Holidays. Availability outside those dates/hours shall be coordinated with the Refuge Manager at least two business days in advance.
• Government holidays include New Year’s Day, Martin Luther King JR’s Birthday, Memorial Day, Juneteenth, Independence Day, Labor Day, Columbus Day, Veteran’s Day, Thanksgiving Day, and Christmas Day.
14.0. WORK HOURS.
14.1 Work shall be performed between Monday and Friday, 7:30 AM to 4:00 PM (Pacific Time), excluding Federal Holidays. Work outside those dates / hours shall be coordinated with the Refuge Manager at least two business days in advance.
14.2 Weekend work shall be approved by the Refuge Manager.
14.3 USFWS escort required unless previously arranged with the Refuge Manager.
