About this file
This document is a Limited Source Justification (LSJ) for a sole source contract award to SAIC to continue providing technical support services to the Department of Defense (DoD) Office of the General Counsel (IA). The current contractor, SAIC, has extensive experience and knowledge supporting this requirement, and a new contractor would require a steep learning curve to provide the same level of service without disrupting the mission. The Government intends to competitively solicit a long-term contract in the future but needs to extend the current contract with SAIC in the interim to ensure continuity of services. The Government will use historical pricing from the current contract to determine fair and reasonable pricing for the sole source award. The contract will be awarded on March 26, 2024 for an unknown amount under solicitation number WHS_LSJ.

IV. To compete at this time would present a gap in contractor support because a new vendor would undergo a steep learning curve in addition to meeting the staff requiremt for supporting OGC (IA) in. A new vendor would have to become acclimated with the the DoD General Counsel; the Under Secretary of Defense (Policy); the Assistant Secretaries for International Security Affairs (ISA), Asian and Pacific Security Affairs (APSA), Homeland Defense and Global Security Affairs (D&GS), Strategy, Plans, and Capabilities (SP&C), and Special Operations/Low-Intensity Conflict (SO/LIC). While multiple vendors can provide the services, only SAIC can provide those services beginning on the required date.
A gap in support will threaten the DoD mission and national security. This extension of services will allow work to continue while proposals are evaluated and a new contract is awarded. This extension will also allow for a phase-in of a new vendor if necessary when the new contract is awarded.
5. BEST VALUE DETERMINATION: The techniques identified at FAR 15.404-1(b) will be used to ensure award will be at fair and reasonable prices. Since this requirement will be solicited to the incumbent vendor, historical prices paid from the current contract were used to develop the Government estimate and will be utilized to determine fair and reasonable pricing.
6. MARKET RESEARCH: The Government intends to competitively issue a long-term contract. However, market research for the re-compete is still being conducted. Therefore, in the interim, the Government intends to award a sole source award to SAIC so that it may continue to provide technical Support Services FAR 8.405-6(a)(1)(i)(C).
7. OTHER SUPPORTING FACTS This sole source action will support a continuity of services while the OGC is defining its new requirement (see Section 6 above.) Market research will be conducted prior to any subsequent acquisition for these services to best determine long-term needs and appropriate procurement method.
8. ACTIONS TO REMOVE OR OVERCOME ANY BARRIERS THAT LEAD TO THE
RESTRICTED CONSIDERATION BEFORE ANY SUBSEQUENT ACQUISITION FOR THE
SUPPLIES OR SERVICES IS MADE:
(a) Efforts to obtain competition: On February 16, 2024, WHS/AD issued a “Notice of Intent to Sole Source,” on SAM.gov. The Notice of Intent closed on February 23, 2024. Based on the Notice of Intent, no vendor challenged the bridge contract to SAIC.
(b) Actions to increase competition: This sole source action will support a continuity of services while this effort undergoes the recompete process. Market research determined that at least one other firm is capable of providing these services. This sole source serves as a stop-gap measure to allow for a competition to fully vet any other potential sources for this requirement.
9. If this acquisition is for new work as a logical follow-on to on original Federal Supply Schedule (FSS), was the original order was placed under the FSS ordering procedures?
Yes, the original acquisition was issued on a competitive basis.
No, a copy of the previous justification is attached. The actions to remove any barriers to competition cited on the previous justification were were not completed
