JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION (JOFOC) TEMPLATE

OJP Secure Print (Celiveo) Service Identification Number: 15PTDE-21-PR-0020/15PTDE21Q00000011

1. Identification of the agency and contracting activity (FAR 6.302-1(c)(1)).

The Department of Justice (DOJ), Office of Justice Programs (OJP) Office of Chief Information Officer (OCIO) has a requirement for secure printing services. The services would include the software and maintenance required to perform secure printing.

2. The nature and/or description of the action being approved (FAR 6.303-2(b)(2)).

OCIO intends to award a new firm fixed price contract for services that include the brand name software and maintenance required to perform secure printing. This order will include secure print renewal of the Celiveo solution. One (1) additional year includes the 81 Licenses to Celiveo Enterprise License and one plotter.

3. A description of the supplies or services required to meet the agency’s needs (including the estimated value) (FAR 6.303-2(b)(3)).

In 2016, OJP implemented the Celiveo Enterprise Solution for eight (8) HP Print Devices located throughout the agency. The Celiveo Enterprise Solution is a set of solutions designed to help mitigate security and compliance risks, prevent fraud, protect data privacy, and enhance fleet management.

This solution delivers enhanced print security through authentication and authorization. It proposes a breadth of authentication options ranging from PIN code login to card-based capabilities. It also helps mitigate security and compliance risks and reduces paper waste by allowing print jobs to be encrypted and stored on the printer (push printing), until you are ready to retrieve and print. The solution helps increase productivity and ease printing by providing print mobility for enterprise-class companies, through storage of print jobs on servers, roaming printing, and single sign-on.

The total estimated cost is for a period of one (1) year. This will allow OCIO to accomplish its mission of performing secure printing.

4. An identification of the statutory authority permitting other than full and open competition (FAR 6.303-2(b)(4)).

The statutory authority permitting other than full and open competition is 41 U.S.C. 3304(a)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1(c) entitled, Application for brand-name descriptions.

5. A statement demonstrating the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority (FAR 6.303-2(b)(5)).

The Celiveo brand name is essential to the Government's requirements, and market research indicates other companies' similar products or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency's needs. Celiveo is the only product that can provide software license to maintain the current licenses that are implemented into the HP Printers.

5. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by FAR 5.2 and, if not, which exception under FAR 5.202 applies (FAR 6.303-2(b)(6)).

A market survey was conducted and three (3) authorized resellers of the Celiveo Enterprise Solution were identified. The solicitation will be publicized to Beta.Sam as required by FAR 5.2.

6. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable (FAR 6.303-2(b)(7)).

The Contracting Officer determines that the anticipated price(s) will be fair and reasonable based on market research and historical acquisition. Prior to award of the proposed order, price information shall be obtained from the contractor and a price analysis will be performed and documented to sufficiently determine that the cost to the Government of the proposed acquisition will be fair and reasonable.

7. A description of the market research conducted (see FAR Part 10) and the results or a statement of the reason market research was not conducted (FAR 6.303-2(b)(8)).

Market research was conducted by OCIO and OJP to identify available sources and to evaluate the availability of the marketplace to meet the requirement as follows. Based on the results of market research, the government determined that vendors are available to provide the brand name product.

8. Any other facts supporting the use of other than full and open competition (FAR 6.303-2(b)(9)).

At this time, another software brand would not be compatible with the current printer devices that will sufficiently meet the needs of the Agency. Additionally, a change would require a possible impact such as printer network interruptions or downtime to implement the new solution.

9. A listing of any sources that expressed a written interest in the acquisition (FAR 6.303-2(b)(10)).

One source indicated an interest as a result of the Market Research completed by OCIO.

10. A statement of any actions the agency may take to remove or overcome any barriers to competition, if subsequent acquisitions are anticipated (FAR 6.303-2(b)(11)).

The Government will continue to conduct thorough market research to gauge the marketplace capabilities for future requirements. The Government will seek competition of future acquisitions for these products.
