About this file
This document is a Justification for Other Than Full and Open Competition (JOFOC) under FAR Subpart 6.3 for the Department of Defense, Defense Prisoner of War (POW)/Missing in Action (MIA) Accounting Agency (DPAA) to issue a sole-source contract to Midwest Storage Solutions for the purchase, shipment, and installation of Viking/Spacesaver 920 Cabinets. The estimated value of this action is $281,623.45, which will be funded by Operations and Maintenance (O&M) appropriation. The requirement is for stand-alone evidence storage cabinets to house the comparative collection of exemplar assets at the Offutt lab storage annex in Nebraska. The justification cites the need for a flexible and secure storage management solution to properly manage and preserve these assets in support of the personnel accountability mission. Midwest Storage Solutions is the only authorized distributor of Spacesaver cabinets in the region, and Spacesaver is the only manufacturer of the required Viking Preservation cabinets.

DIRECTORATE
JUSTIFICATION FOR
OTHER THAN FULL AND OPEN COMPETITION (JOFOC)
UNDER FEDERAL ACQUISITION REGULATION FAR SUBPART 6.3
1. AGENCY AND CONTRACTING ACTIVITY: The Department of Defense, Defense Prisoner of War (POW)/Missing in Action (MIA) Accounting Agency (DPAA).
2. DESCRIPTION OF ACTION: WHS/AD proposes to issue a sole-source contract to
Midwest Storage Solutions for the purchase, shipment, and installation of a brand name Viking/Spacesaver 920 Cabinets. The equipment will be used to focus efforts on laboratory processes for identifying remains while securing the remains on the lab floor, thereby facilitating the multiple comparisons required to segregate and identify the remains of a U.S. service member. The estimated value of this action is $281,623.45, which includes shipment and all required labor for installation of equipment and will be funded by Operations and Maintenance (O&M) appropriation.
3. DESCRIPTION OF SUPPLIES/SERVICES: The requirement will be to purchase stand-alone evidence storage cabinets for Offutt lab storage annex to house the comparative collection of exemplar assets at the Nebraska location. The comparative collection is currently stored in shipping containers (tri-walls) and cannot be readily accessed or properly managed. Proper management of these assets require a flexible and secure storage management solution of cabinets that allow for maintaining, accessing, and preserving these assets in support of the accountability mission.

4. AUTHORITY CITED: This action is authorized under provisions of 10 U.S.C.
2304(c) as implemented by Federal Acquisition Regulation (FAR) 6.302-1(a)(2)(ii), only one source and no other supplies or services will satisfy agency requirements.
5. REASON FOR AUTHORITY CITED: The highest priority of the organization is the recovery and return of the remains of fallen service members to their families.
DPAA performs material analyses for field investigations and recovery missions for organic and partnership missions. The management of the large comparative collection of exemplar assets at the Nebraska location is currently inaccessible and artifact comparisons impossible, with the assets in storage containers (tri-walls).
Proper management of the comparative collection requires a flexible and secure storage management solution of cabinets that allow for maintaining, accessing, and preserving these assets in support of the personnel accountability mission for projects on the scale of the USS Oklahoma, Ploesti and the upcoming projects of Enoura Maru and Myitkyina will require a more flexible and secure evidence storage management solution. The laboratory purchased previous Spacesaver cabinets for the preservation of evidence, since that purchase, we have received more items to store and to be able retrieve rapidly. The cabinets are to be designed to fit our laboratory space and will be identical to equipment already in use by laboratory personnel. Vikings provides a lockable cabinet for storing laboratory items used in the identification process. Midwest Storage Solutions is the only authorized distributor of Spacesaver cabinets in the region. Due to the storage requirements for laboratory operations and evidence storage requirements, Spacesaver is the only manufacturer of the Viking Preservation cabinets. DPAA Laboratory is an accredited forensics laboratory under ISO/IEC 17025:2017, we are required to store large volumes of remains and comparative collection of exemplar assets (boots, uniforms, equipment). These items will be in a controlled environment. Spacesaver cabinets provides us the best opportunity to secure, retrieval, and also maximize the floor space.
6. EFFORTS TO OBTAIN COMPETITION: See Market Research, Tab #8
Control Date: 18 January 2024 Approving Authority: Lead Quality Manager Page 3 of 4 UNCLASSIFIED
7. FAIR AND REASONABLE COST DETERMINATION: I hereby determine that the anticipated price for this contract action will be fair and reasonable. The techniques identified at FAR 12.209 will be used to ensure award will be at fair and reasonable prices.
8. MARKET RESEARCH: Market research was conducted using GSA eLibrary Federal
Acquisition Services. Spacesaver has a FSS contract (GS-28F-006BA) is not small business concern under NAICS 337127. A call was placed to Spacesaver and their Sales Representative confirmed that the required Viking 920 Series Preservation Cabinets are not on their FSS. Also, Spacesaver has authorized distributors, aligned by region.
Midwest Storage Solutions is the distributor for the area where Offutt AFB, NE is located. An SBA Dynamic Small Business Search, using the keyword Viking, was also conducted, which returned 5 small business; however, only distributors authorized by Spacesaver are allowed to sell Viking cabinets, of the vendors identified, none of them are capable of meeting the requirement. Due to the required storage requirements for laboratory operations and evidence storage requirements, Spacesaver is the only manufacturer of the Viking Preservation cabinets.
9. OTHER FACTS: Spacesaver has a GSA Federal Supply Schedule (FSS), but the
Viking 920 Series cabinets are not on the FSS.
10. INTERESTED SOURCES: Not applicable.
11. ACTIONS TO INCREASE COMPETITION: No actions can be taken at this time, as the size, space, and specialized nature of work conducted by DPAA require specialized equipment that are commercial in nature but specific to the mission at hand.
12. Is this acquisition for a non-competitive follow-on acquisition previously awarded on a non-competitive basis?
☐Yes. A copy of the previous justification is attached1.
The Actions to remove any barriers to competition cited on the previous justification were completed:
☐Yes.
☐No2
☒No.
