About this file
This document is a Justification for Exception to Fair Opportunity (JEFO) under Federal Acquisition Regulation Subpart 16.5. The Department of Defense, Washington Headquarters Services, Acquisition Directorate is planning a firm fixed price contract with a total estimated value of $95,676 to procure twelve (12) Covert Audio and Video Micro Oculus Button Recorder kits for the Department of Defense Office of Inspector General, Defense Criminal Investigative Services (DCIS) to support law enforcement sensitive activities. The justification cites FAR 16.505(b)(2)(i)(B) as the exception to the fair opportunity process, as only one manufacturer can provide the unique and highly specialized product requested. The Contracting Officer determined the price to be fair and reasonable based on a comparison of competitive pricing. The Government will continue to monitor the market to identify other products that meet their needs, and DCIS will consider the cost benefit of changing the equipment in the future.
