LSJ – EITSD –Task Management Tool (TMT) 1
ACQUISITION DIRECTORATE
DEPARTMENT OF DEFENSE WASHINGTON
HEADQUARTERS SERVICES
1155 DEFENSE PENTAGON
WASHINGTON, DC 20301-1155
Limited Source Justification (Sole-Source)
1. AGENCY AND CONTRACTING ACTIVITY:
The Department of Defense (DoD), Washington Headquarters Services (WHS), Acquisition Directorate on behalf of the WHS Enterprise Information Technology Services Directorate
(EITSD).
2. NATURE/DESCRIPTION OF ACTION(S):
The purpose of this action is to procure licenses, installation, configuration and maintenance support for the Task Management Tool (TMT) system used by Office of the Secretary of Defense (OSD), Washington Headquarters Services (WHS), WHS-Supported Organizations (WSO), and the Pentagon Force Protection Agency (PFPA). The Government is seeking to award a sole-source task order to Accenture Federal Services LLC, herein after referred to as Accenture, for implementation and maintenance of the Task Management Tool (TMT) system. Accenture is the sole seller of the required TMT licenses and does not have authorized resellers. The Government is not able to procure these TMT licenses or maintenance from any source other than Accenture. The intended task order will be a follow-on to a contract awarded to Accenture for the purpose of TMT development, implementation and integration services. That award was a sole source contract under the authority of FAR 6.302-1.
3. DESCRIPTION OF SUPPLIES/SERVICES:
A firm fixed price task-order is being sought for one (1) base period from January 19, 2015 to January 18, 2016 with one (1) option year. The total estimated value, including all options, is $4,800,000.00. The intended task order is off of Accenture’s GSA Schedule 70, contract number GS-35F-0371N.
WHS / EITSD requires licenses and installation support for the TMT. The TMT will leverage existing EITSD infrastructure and provide seamless integration to the Customer Management Relationship (CRM), Microsoft SharePoint servers and Microsoft Office.
These implementation services will integrate TMT software into the WHS/EITSD server environment; provide Tier One, Tier Two, and Tier Three support services; provide at least 7,100 TMT licenses; provide user training for at least 6,100 users; and provide configuration/enhancement services for TMT software in order to meet the specific needs of OSD and EITSD.

The goal for this requirement is to fully integrate the TMT program into supported workflow/staff functions and enable a more streamlined tasking procedure through provision of increased transparency, visibility, and accountability within the TMT supported footprint.
The seven major objectives to be supported by TMT under the follow-on task order are as follows:
a. Automate the dissemination and reporting of tasking’s, Requests for Information
(RFIs), and directives originating from DoD organizations to internal staff directorates and external subordinate units.
b. Automate the dissemination and reporting requirements of administrative instructions originating from DoD organizations to staff directorates and external subordinate units.
c. Automate the staffing of Awards, Decorations, and Evaluations.
d. Enable an unparalleled level of transparency and accountability of TMT incorporated staff processes, providing DoD leaders with valuable organizational data including workflow bottlenecks, workload comparisons, and efficiencies.
e. Leverage existing infrastructure with providing seamless integration to Microsoft
Office SharePoint Servers (MOSS).
f. Reduce overall life cycle support costs by limiting the need for additional Operations & Maintenance (O&M) support.
g. Utilize commercial off-the-shelf software (COTS) to the maximum extent possible in order to maximize reuse of the existing infrastructure to reduce the delivery time and development costs.
4. IDENTIFICATION OF STATUTORY AUTHORITY:
FAR 8.405-6 requires an ordering activity to justify its actions when limiting sources. The specific circumstance that justifies restriction for this acquisition is FAR 8.405-6(a)(1)(i)(B), Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized. In a letter dated December 1, 2014 from Accenture, it is stated that the required “TMT software and underlying source code are owned by Avanade but, TMT is considered proprietary to both Accenture and Avanade. Moreover, Accenture is the sole seller of TMT licenses and does not have authorized resellers.”

5. DEMONSTRATION OF CONTRACTOR’S UNIQUE QUALIFICATIONS:
Avanade Federal Services (Avanade), founded in 2000 by Microsoft and Accenture, developed early versions of the Task Management Tool (TMT). The TMT related business of Avanade was transferred to Accenture Federal Services, LLC (AFS), a wholly owned subsidiary of Accenture. In part was an amended inter-organizational license agreement between Avanade and Accenture to include the express and exclusive right for Accenture and its affiliates to license TMT 3.x and TMT Versions 3.x. At this time, Accenture is the only company that produces and maintains the TMT code.
TMT is the only acceptable software available that operates on the Customer Relationship Management (CRM) platform that is explicitly designed to manage and execute complex tasking workflow within and across organizations. The TMT capability portfolio coupled with the implementation plan offered by Accenture Federal Services results in Accenture being the only vendor who can provide all the requirements listed in paragraphs (a) and
(b) of this section.
Specifically, Accenture’s TMT is the only CRM based tasking tool that provides the following capabilities:
a. Ability to send and track tasks within the TMT environment, to/from users who do not possess a CRM license. A fiscally constrained environment limits the ability to provide CRM licenses to every action officer within the DoD and its subordinate organizations. This capability will allow the extension of tasks to subordinates down to the lowest conceivable level of any organization without first being required to purchase and provide a license. Although action officers outside of the TMT environment will have a reduced capability versus those who possess a license, they will maintain the ability to collaborate, provide products, and participate in a task workflow that exists within a TMT environment. Additionally, TMT users will be able to maintain visibility of workflow pertaining to a specific task outside of the TMT environment. This capability not only affords the flexibility to maintain a task (regardless of its destination) within the TMT environment under any circumstance, but it will also allow for significant cost savings without the requirement to provide licenses to users who do not regularly participate in TMT tasks.
b. Ability to apply privacy settings to specific tasks without imposing blanket privacy restrictions to all tasks. Routine staffing actions are required in varying degrees of privacy. The need for privacy in some taskers while facilitating visibility in all others is a cause for serious conflict within the solution itself and can be problematic to achieve. TMT is the only off the shelf tasking solution that affords a built-in privacy setting that can be applied to a specific task without imposing blanket restrictions to all other tasks as a secondary effect.

Accenture is the only vendor that has experience implementing the TMT program into DoD staff organizations and successfully integrating the software into a workable solution for DoD entities. Furthermore, it is the only company that possesses the institutional knowledge and experience needed to provide competent user level training to 6,100 separate individuals on ten separate installations, and system administrator training to help desk personnel. This track record of success is imperative for successful implementation within the supported organizations.
WHS/EITSD has determined that purchasing the TMT tasking software solution and utilizing Accenture to implement and maintain the TMT software is in the best interest of the Government based on the following:
a. The need for an enterprise tasking solution to interact with action officers who do not possess licenses or do not operate within DoD's TMT environment.
b. Accenture is the only company to successfully implement a TMT solution into any DoD organization.
c. The inability of non-proprietary companies to access TMT source code in order to customize a TMT solution to meet users’ needs.
Awarding to a company other than Accenture will lead to a core inability to customize the TMT program to meet the specific needs of supported user organizations due to an inability to access TMT source code.
Without the use of TMT, supported organizations will be forced to continue to use its current antiquated tasking software that is incompatible with partner units, and significantly lacks capability when compared to current technology or required to initiate a new acquisition program with the potential of significant duplication of costs associated with the current acquisition efforts to date.
6. DETERMINATION OF FAIR AND REASONABLE COST/PRICE:
The Contracting Officer will ensure that the resulting task-order price is fair and reasonable per FAR 8.404(d) and FAR 15.404-1(b). The price will be determined fair and reasonable via the use of price analysis based on the comparison of prior efforts of similar size and scope and by comparing the proposal to the independent government cost estimate.
7. DESCRIPTION OF MARKET RESEARCH:
A “Special Notice of the Government’s Intent to Sole Source” was posted to Federal Business Opportunities (FedBizOpps) on November 12, 2014, allowing for vendors to respond to this intent. On December 03, 2014, the special notice closed with no response of interest or challenges from industry.

Per market research it was confirmed that Avanade was the sole developer of TMT.
Avanade is now 80% owned by and is a subsidiary of Accenture. Accordingly, TMT is now available only through Accenture which has the exclusive rights to sell the TMT license as part of an inter-agreement with Avanade. Accenture is the sole seller of TMT and does not have any authorized resellers. Therefore, the Government is not able to procure support for the TMT application and the proprietary source code from any source other than Accenture.
Accenture retains proprietary rights to the TMT source code and does not have any obligation to provide (nor will it provide) this source code to any other company. Because of this, Accenture is the only company that can implement enhancements into TMT's source code in order to facilitate proper integration into the server construct.
Additional market research was conducted on other tasking solutions offered by the private sector. The overarching criteria for solution elimination were assessed by two sequential factors.
a. Will the tasking solution operate on the CRM platform? All tasking solutions with the exception of one (outside of TMT), do not operate on a CRM platform. This inherently limits a solution's ability to leverage and work seamlessly with MS Outlook and MS SharePoint in order to provide automatic tasking notifications (MS Outlook), or utilize servers for the purpose of automated storage and archiving (SharePoint). A tasking solution that operates within the CRM platform will offer "out of the box" capability to integrate with and leverage the already present capability of Outlook and SharePoint, while also hedging the business intelligence capability inherent in CRM itself.
b. Will the CRM-based tasking solution allow incorporation of non-licensed users a nd external organizations using other tasking solutions? When viewing DoD organizations and its subordinated organizations holistically, it is clear that WHS cannot reasonably provide tasking solution licenses to every possible action officer within its footprint. Acknowledging this fact, the concept for implementing a tasking solution would allow for comprehensive licensing of individuals and their subordinate organizations. However, because of DoD's organizational magnitude, it is inevitable that tasks will continue to flow outside of the network of licensed tasking solution users. In order to maintain visibility and accountability of such tasks, non-licensed users must have the ability to collaborate, and integrate into and existing tasking solution workflow.
After reviewing capabilities of products offered by vendors, and discussing product capabilities with vendors, it was apparent that the only product available that possesses a unique and suitable non-licensed user interoperability feature, without the requirement for additional software development is the TMT solution.

8. ANY OTHER SUPPORTING FACTS:
No other CRM-based tasking solutions exist with the ability to incorporate non-licensed users as a distinctive capability to meet OSD/WHS requirements, other venders will have to incorporate the price of software development into the contract and the additional time required to develop the software during an extended period of performance.
9. ACTIONS TAKEN TO REMOVE BARRIERS TO COMPETITION:
At this time, TMT is exclusively sold and maintained by Accenture. However, the Government is negotiating data rights for custom code developed with this EITSD TMT solution. With these data rights, EITSD will be able to a) have Government-appointed personnel trained to maintain the custom code baseline, and b) initiate maintenance support of CRM and custom code by other CRM vendors.
