PROGRAM.

SUBJECT PROPERTY

FRSP Tract 05-155 The property is a 60.45-acre tract of land located in Spotsylvania County, Virginia on Courthouse Road/State Route 208. To the west side of the tract is the USA-owned lands of Fredericksburg and Spotsylvania National Miliary Park, directly abutting the park. To the north and east sides of Tract 05-155 is privately held land. Virginia Route 208/Courthouse Road adjoins the southerly boundary of the tract.

The tract will become an exterior boundary of the park. Tract 05-155 is improved with a vacant-single family house built around 1860 (but vacant for 10 years), an occupied mobile home, several outbuildings, agricultural and construction equipment, and some debris.

TRACT 05-155

ALL that portion of land in the Courtland Magisterial District, County of Spotsylvania, and Commonwealth of Virginia, depicted on the plat titled “Boundary Survey of the Land of Mary Ann Wilkerson & John K. Wolfrey”, dated January 22, 2024, and certified by Jon Gilmore, L.S. 003040, with Marsh & Legge Land Surveyors, P.L.C., and recorded Month XX, 20XX, with the Clerk's Office of the Circuit Court of Spotsylvania County, Virginia, as Instrument No. XXXXXXXXXXXX, and being more particularly described as:

BEGINNING at Corner D, monumented with an aluminum post with 3 1/4 inch diameter aluminum cap marked Dept of the Interior - National Park Service, COR. D, LS3040, 2024, on the westerly right of way line of VA. Route 280, a/k/a Courthouse Road, a corner to the land of the American Battlefield Trust, as recorded in the Clerk’s Office of the Circuit Court of Spotsylvania County, Virginia in Instrument No.

230003736, and designated as NPS Tract FRSP 05-171;

THENCE, along said land now or formerly of American Battlefield Trust, North 53° 45' 05" West, a distance of 838.33 feet, to Corner C, monumented with an 8 x 8 inch concrete monument and 3 inch diameter brass cap marked National Military Park, a corner to the land of the United States of America, as recorded in the aforesaid Clerk's Office in Deed Book 109 at Page 429, and designated as NPS Tract

FRSP 05-146;

THENCE, along said land of the United States of America, and other land of the United States of America, as recorded in the aforesaid Clerk's Office in Deed Book 108 at Page 277, and designated as NPS Tract FRSP 05-135, North 49° 07' 46" West, a distance of 1,481.65 feet, to Corner E, monumented with an 8 x 8 inch concrete monument with 3 inch diameter brass cap marked National Military Park, a corner to the land of the United States of America, as recorded in the aforesaid Clerk's Office in Deed Book 405 at Page 136, and designated as NPS Tract FRSP 05-154;

THENCE, along other land of the United States of America, North 49° 07' 46" West, a distance of 1,281.77 feet, to Corner F, monumented with a 6 inch diameter concrete monument with 3 inch diameter brass cap marked U.S. Department of the Interior N.P.S., a corner to the land of Michael S. Harbert, as recorded in the aforesaid Clerk's Office in Instrument 200800023207, and common with a corner to the United States of America, as recorded in the aforesaid Clerk's Office in Deed Book 396 at Page 88, and designated as NPS Tract FRSP 05-153;

THENCE, along said land of Michael S. Harbert, North 61° 04' 33" East, a distance of 959.30 feet, to Corner G, monumented with a 5 x 7 inch granite stone, a corner to the Stevenson Ridge Division of Land as recorded in the aforesaid Clerk's Office in Plat File 8 at Page 189;

THENCE, along said Stevenson Ridge Division of Land, the following (3) three courses:

1. South 43° 29' 10" East, a distance of 1,645.80 feet, to Corner H, monumented with a 1 inch diameter iron pipe;

2. South 47° 10' 22" East, a distance of 586.55 feet to Corner I, monumented with a 1 inch diameter iron pipe;

3. South 47° 42' 40" East, a distance of 1,064.27 feet, to Corner J, monumented with a broken 6 x 6 inch concrete monument on the westerly right of way line of Courthouse Road;

THENCE, along the westerly right of way line of Courthouse Road, the following (4) four courses:

1. South 42° 57' 53" West, a distance of 261.44 feet, to Corner K, a point not monumented this survey;

2. South 40° 06' 08" West, a distance of 100.12 feet, to Corner L, a point not monumented this survey;

3. South 42° 57' 53" West, a distance of 100.00 feet, to Corner M, a point not monumented this survey;

4. South 43° 49' 26" West, a distance of 163.40 feet, to the said POINT OF BEGINNING.

CONTAINING 60.45 acres of land.

The description of land above was composed by Jon Gilmore, PLS No. 003040, on 04/11/2024, being the same property previously described of record as:

TRACT ONE

PARCEL 1

ALL that certain lot or parcel of land containing 33-1/3 acres, more or less, with improvements thereon and appurtenances thereto belonging, lying and being in Spotsylvania County, Virginia, which said 33- 1/3 acres of land is bounded and described as follows; namely: commencing at a stone, a corner to John F.

Chilton on the Fredericksburg Road, thence along said road N. 35° E., 25-1/5 poles to a point opposite the center of the gate leading to the dwelling; thence N. 39-1/4° W., 200 poles to a stake in McCoull's line, a new corner between John F. Chilton and William M. Chilton; thence S. 64° W., 30 poles to a white oak, corner to John F. Chilton; thence S. 42-1/2° E., 203 poles to the beginning as for survey made September, 21st, 1890 by John M. Smith, Deputy Surveyor.

BEING the same property conveyed to John F. Chilton by Deed of Partition between John F. Chilton and William M. Chilton dated September 29, 1890, and recorded in the Clerk's Office of the Circuit Court of Spotsylvania County, Virginia in Deed Book AC at page 409, and being a partition of the 100 acres conveyed to John F. Chilton and William M. Chilton by deeds recorded in the aforesaid Clerk's Office in Deed Book AB at page 150 and in Deed Book AB at page 292.

PARCEL 2

ALL that certain piece, parcel and lot of land, situated in Spotsylvania County, Virginia and adjoining the lands of the said Rosa B. Chilton and the said John F. Chilton, containing about two acres and two thirds of an acre be the same, more or less, and bounded as follows, viz: Beginning at an implanted stone in the center of the gateway at the outlet of the said John F. Chilton leading from his residence to the public road leading from Spotsylvania Court House to Fredericksburg and where said outlet touches said public road;

thence running along the line of said public road in a north east course nine (9) rods to an implanted stone, a corner to said Rosa B. Chilton and a new corner to John F. Chilton; thence in a northwesterly course about 92-8/33 rods to an implanted rock in the breastworks in the line between said Rosa B.

Chilton and the said John F. Chilton; thence in a southeasterly course along the said line between Rosa B.

Chilton and John F. Chilton about 95-5/33 rods to the point of beginning.

BEING the same property conveyed to John F. Chilton by Deed from William M. Chilton, Rosa B.

Chilton and Henry Roberts dated March 15, 1901 and recorded in the Clerk's Office of the Circuit Court of Spotsylvania County, Virginia in Deed Book AN at page 165.

BE IT KNOWN that John F. Chilton died testate and by virtue of his Last Will and Testament and Codicil attached thereto, recorded in the aforesaid Clerk's Office in Will Book BB at page 214, he devised the 36 acre property comprised of Parcel 1 and Parcel 2 above to his son, John Moncure Chilton, subject to the life estate of his wife, Hester Chilton. Hester Chilton died testate in or before 1913 as evidenced by her Last Will and Testament recorded in the aforesaid Clerk's Office in Will Book CC at page 96. Fee simple ownership of the 36 acre property was confirmed to be vested in John Moncure Chilton by Deed from F. W. Coleman, Special Commissioner dated September 12, 1914 and recorded in the aforesaid Clerk's Office in Deed Book 84 at page 305. John M. Chilton died testate on December 30, 1969 and by virtue of his Last Will and Testament recorded in the aforesaid Clerk's Office in Will Book LL at page 199, he devised his entire estate to his daughter, Merle C. Strickler.

TRACT TWO

ALL that certain lot or parcel containing 20 acres of land lying in Spotsylvania County, Virginia, and bounded as follows, to-wit: Commencing at a stone on the main road leading from Spotsylvania Courthouse to Fredericksburg, corner to Chilton; thence N. 44-1/2° W., 203 poles to a white oak in Harper's line and corner to Chilton; thence S. 65° W., 28 poles to a red oak, a new corner to Alrich;

thence S. 45° E., 218 poles to a white oak as pointer on said main road, a new corner; thence along said road 8 poles to the beginning, containing 20 acres.

BEING the same property conveyed to Hester A. Chilton by Deed from Samuel W. Alrich and Annie F.

Alrich dated February 25, 1889 and recorded in the Clerk's Office of the Circuit Court of Spotsylvania County, Virginia in Deed Book AC at page 18. Hester Chilton died testate in or before 1913 and by virtue of her Last Will and Testament recorded in the aforesaid Clerk's Office in Will Book CC at page 96, she devised the 20 acre property to her son, John M. Chilton. John M. Chilton died testate on December 30, 1969 and by virtue of his Last Will and Testament recorded in the aforesaid Clerk's Office in Will Book LL at page 199, he devised his entire estate to his daughter, Merle C. Strickler.

TRACT THREE

ALL that certain tract or parcel of land situated in Spotsylvania County, Virginia, and bounded as follows: Beginning in road leading from Spotsylvania Court House to Fredericksburg opposite a rock on West side, a corner to Chilton; thence along the road S. 45° W., 14 poles to a point in said road opposite a rock on West side, a new corner to said Alrich’s; thence N. 44° W., 57-2/5 poles to a rock in pines, a new corner to said Alrich; thence N. 45° E., 14 poles to a rock by fence in Chilton's line and a new corner to said Alrich; thence with Chilton's line S. 44° E., 57-2/5 poles to the beginning, containing 5 acres.

BEING the same property conveyed to John M. Chilton by Deed from E. R. Gardner, Special Commissioner, dated June 22, 1922 and recorded in the Clerk's Office of the Circuit Court of Spotsylvania County, Virginia in Deed Book 95 at page 116. John M. Chilton died testate on December 30, 1969 and by virtue of his Last Will and Testament recorded in the aforesaid Clerk's Office in Will Book LL at page 199, he devised his entire estate to his daughter, Merle C. Strickler.

LESS AND EXCEPT the following three conveyances from the above parcels of land:

0.19 acre conveyed to the Commonwealth of Virginia by Deed dated April 18, 1923 and recorded in the aforesaid Clerk's Office in Deed Book 96 at page 329.

0.53 acre conveyed to the United States of America by Deed dated June 24, 1932 and recorded in the aforesaid Clerk's Office in Deed Book 109 at page 429.

5.00 acres conveyed to John R. Wolfrey and J. K. Wolfrey by Deed dated July 27, 1992 and recorded in the aforesaid Clerk's Office in Deed Book 1052 at page 821.

TRACT FOUR

ALL that certain tract or parcel of land situate, lying and being in Courtland District, Spotsylvania County, Virginia, containing four-tenths (0.4) acre, more or less, according to a plat and survey made by J. W. Massey, Surveyor, June 9, 1953, which plat is attached to Deed recorded in the Clerk's Office of the Circuit Court of Spotsylvania County, Virginia in Deed Book 164 at page 398.

BEING the same property conveyed to Merle Chilton Strickler by Deed from T. Towles Dickerson and DeWitt T. Dickerson dated June 17, 1953 and recorded in the Clerk's Office of the Circuit Court of Spotsylvania County, Virginia in Deed Book 164 at page 398.

The tracts described above are designated Fredericksburg and Spotsylvania National Military Park Tract 05-155 and are intended to be all those lands conveyed to Lola P. Wolfrey, John R. Wolfrey, John K.

Wolfrey, and Mary Ann Wilkerson by virtue of the Last Will and Testament of Merle C. Strickler, recorded in the Clerk's Office of the Circuit Court of Spotsylvania County, Virginia in Will Book QQQ at page 612. Lola P. Wolfrey died intestate on March 11, 2010 and her interest in the property vested with her husband, John R. Wolfrey. John R. Wolfrey died testate on August 19, 2012 and by virtue of his Last Will and Testament recorded in the aforesaid Clerk's Office in Will File 201200000756, he devised his interest in the property equally to Mary Wolfrey Wilkerson (A/K/A Mary Ann Wilkerson) and John K.

Wolfrey.

BACKGROUND

Since 1971, the acquisition of land for a variety of government programs and projects has been subject to the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (the Uniform Act). The Uniform Act provides for fair and equitable treatment of persons whose property will be acquired or who will be displaced because of programs or projects financed with Federal funds. Congress amended and updated the Uniform Act in 1987.

All Federal, State and local public agencies (and others receiving Federal financial assistance for public programs and projects requiring acquisition of real property) must comply with the policies and provisions set forth in the Uniform Act and its amendments.

The controlling Federal authority for Uniform Relocation Assistance and Real Property Acquisition for Federal and Federally assisted programs is Section 213, Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, Public Law 91-646, 84. Stat.

1894 (42 U.S.C. 4601) as amended by the Surface Transportation and Uniform Relocation Assistance Act of 1987, Title IV of Public Law 100-17, 101 Stat. 246-256 (42 U.S.C. 4601 note).

To support current National Park Service (NPS) and Department of the Interior (DOI) goals to comply with the Uniform Act, relocation and moving costs should be calculated prior to or during land purchases and transactions. To facilitate this process we seek assistance with relocation and moving cost estimates and services. The relocation assessment and services will include an analysis of the residential property and moving costs for the landowner of the property. The goal of the relocation/site assessment is to identify the estimates and costs for replacement housing and/or moving costs and to help conduct and complete the relocation segments of the land transaction. Relocation services and estimates should be conducted by a learned professional who is familiar with the Relocation Act and all processes and procedures for relocation.

All relocation services will be performed according to regulations and laws as stated in the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, as amended (the Act), and as adopted by New Mexico State law, unless otherwise directed by the client.

CONTRACT RELOCATION SERVICES

Provide for the comprehensive management of relocation assistance for one (1) residential household move, requiring compliance with the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, as amended.

1. BASE EFFORT: Meet with the displaced party at their residence to explain the relocation process and benefits, ascertain their desires, intentions and needs. Maintain ongoing dialogue and contact with NPS representative Realty Specialist, Sarah Love, and the displacee throughout the process.

2. BASE EFFORT: Provide regular progress updates by phone or email, bi-monthly and as needed. Advise NPS immediately of any unique issues that are encountered along the way during the relocation process.

3. OPTION EFFORT: Provide all phases of Relocation Assistance Advisory Services and

Financial Assistance pertaining to Replacement Housing Payment to include Price Differential Payment, Mortgage Interest Differential Payment, and Incidental Expenses.

In addition provide information for moving costs of personal property using the Fixed Residential Move Cost Schedule, or a commercial moving company based on estimates received or a hybrid move combination of the self move and the commercial company move.

4. OPTION EFFORT: Assist displacee in preparation of any and all relocation claim forms required for reimbursement payments from the National Park Service relocation account.

5. Project Administration.

6. Final File Disposition. Submit copies of all relocation documents created and completed to Lands Resource Program Center with electronic copy to sarah_love@nps.gov

7. Must be registered in www.sam.gov in order for us to award a contract for these services.

OPTION WORK

There are two options for work under this contract; the base effort and the option effort. All options for additional work must follow the requirements of this SOW as specified for the base effort. At the option of the Government, the scope of work performed under this contract may be increased by the Contracting Officer to include one or all of the following:

1. Base Effort (items 1-2 from above)

2. Option Effort (items 3-4 from above)

3. Items 5-7 from above apply to both the Base Effort and the Option Effort

SCHEDULE

It is expected that the base effort will be in effect until or completed within 30 days of the Offer to Sell being sent to the landowner (or 30 days from initial meeting with displaced party if Offer was already sent). It is further expected that the option effort will be completed within 90-180 days or a set time decided by the relocation firm and the NPS Realty Specialist following the closing and recordation of deed of the acquired real estate described in “Project Name”. This timeline can be delayed or extended with mutual agreement of all involved parties and will be documented through contracting procedures.
