FAR PART 6 JUSTIFICATION AND APPROVAL FOR

OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity: Department of the Army U.S. Army Contracting Command Aberdeen Proving Ground 6001 Combat Drive Aberdeen Proving Ground, Maryland 21005-1846

2. Description of Action: C5ISR, I2WD EWAGS Ground Branch requests a Cost Plus Fixed Fee (CPFF) Task Order (TO) Modification to contract W56KGU-15-D-0004 with Booz Allen Hamilton, Inc. (BAH), 8283 Greensboro Drive, McLean, VA 22102-4904. The Government projects award for 31 March 2020 and Fiscal Years 2018, 2019 and 2020 Defense Research, Development, Test and Evaluation (RDT&E), Other Procurement - Army/Aircraft Procurement - Aircraft (OPA/ /APA) and Operations and Maintenance Army (OMA) funds will be utilized for this effort.

The TO was competed through the Technical Information Engineering Services (TIES) Multiple Award Task Order Contract (MATOC) vehicle which has since expired, and was awarded on 30 April 2018 with a twelve-month option period. The Acquisition Plan was approved in March 2013 in accordance with DFARS 207.103(d)(i)(B). This action will increase the TO ceiling amount by .

3. Description of Supplies/Services: A ceiling increase to the existing TO is necessary to fund EW against NAPS for the Electronic Warfare Tactical Vehicle (EWTV) program as directed by Rapid Equipping Force (REF) for Engineering Support services with the current contractor, BAH.

Service: NAPS

FOR OFFICIAL USE ONLY

The projected ceiling increase to the current TO is broken out as follows

Cost Element Additional Ceiling Requested for EWTV

EWTV – The Government requires engineering and programmatic support for EWTV.

EWTV is a mobile system which implements the GATOR EW capabilities into the MaxxPro Dash Mine Resistant Ambush Protected (MRAP) tactical vehicle as directed by Joint Urgent Operational Need Statement (JUONS) CC-0427, dated 12 November 2010 and REF 10 Liner. EWTV provides enhanced EW capabilities to defeat Radio Controlled Improvised Explosive Devices (RCIEDs) and increase situational awareness, force protection and survivability for our warfighters. The EWTV effort includes vehicle integration, testing, training, and sustainment. Travel to Yuma, AZ; Ft. Hood, TX; Ft.

Riley, KS; and, and APG, MD is required to support program reviews, technical interchange meetings, testing and training events. EWTV will provide enhanced EW capabilities in fixed and mobile implementations in order to increase situational awareness and spectrum dominance and enhanced capabilities to defeat RCIEDs, thereby increasing force protection and survivability for our warfighters.

4. Authority Cited: 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

5. Reason for Authority Cited:

As described at FAR 6.302-1(a)(2), when the supplies or services required by the agency are available only from one responsible source, or for DoD, NASA and the Coast Guard, from only one or a limited number of responsible sources, and no other types of supplies or services will satisfy agency requirements, full and open competition need not be provided for. The proposed source is BAH. BAH is the only viable source for meeting the mission requirements at this time. BAH has the intricate understanding of C5ISR I2WD’s requirement to support the unique engineering expertise that is required to provide software engineering support and sustainment for the EWTV efforts. BAH has been supporting C5ISR I2WD under the existing NAPS TO.

On 12 June 2018, the EWAG’s team identified the need to increase the ceiling on the current NAPS TO. JUONS CC-0427, dated 12 November 2010 identified an urgent need

Service: NAPS

FOR OFFICIAL USE ONLY

to address emerging EW threats to our warfighters. The emerging EW threats were observed, validated and assessed to be significantly urgent enough to warrant immediate action. The urgent need was directed by PM Electronic Warfare & Cyber (EW&C) to field EWTV systems to provide enhanced capabilities to defeat the emerging EW threats. Three EWTV trucks with systems were to be provided to gaining units. The systems integrated into the EWTV vehicle are from the Product Director Electronic Attack (PD EA) portfolio of systems that have been placed as Program of Record. These systems and their integration requires unique engineering expertise. The EWTV effort was supposed to be completed under W15P7T-10-D-D415, TO KY06; however, that TO ended on 23 August 2018. During the EWTV task/effort, two of the three vehicles sustained significant damage during various phases of the program. The first truck was damaged during ATEC testing at YPG, AZ where it became unusable and testing could not be completed. The second truck sustained detrimental system and system sub-components damage during an accident while in transit from YPG, AZ to Detroit, MI. These sustained damages to both vehicles caused severe impacts to schedule and significant increased costs to the program for repair and replacement. The required repairs have been completed under W15P7T-10-D- D415, TO KY06, but severely impacted the schedule for the rest of the effort. The completion of this effort includes software support and sustainment efforts over a 12-18 month period after the trucks are provided to the gaining unit. The training, both operator and master courses, has also been delayed by three months due to the incidents that occurred during testing and transit. The completion of the trucks, equipment deployment, and training had to be shifted to NAPS TO and are currently on-going under contract

W56KGU-15-D-0004, TO 0006.

The damage that occurred to two of the trucks resulted in assessments, repairs, and procurement of replacement parts. The below quantifies the delay in schedule:

1. Three complete trucks delayed eight months

2. One complete set of spare material delayed eight to ten months

3. Software support has been delayed at least six months

4. Training delayed three months

The additional ceiling will allow for the completion and deployment of EWTV. Without the requested ceiling increase under the NAPS TO, the U.S. Army would be forced to set up a new contract, delaying the effort by 12-18 months, based on projected award timelines for Responsive Strategic Sourcing for Services IDIQ (RS3). A 12-18 month schedule delay would result in additional cost to the program and delay potential lifesaving capabilities to the warfighter. Having to re-acquire unique engineering expertise that is already resident on this TO and the associated learning curve associated with reinitiating the effort would result in an additional cost of approximately $3 Million. The figure is derived from historical data on the engineering, testing, training and procurements of the initial three vehicles before they were damaged. No other source has assets with the requisite knowledge and skills to train/maintain the EWTV system, nor would it be

Service: NAPS

FOR OFFICIAL USE ONLY

economical or efficient to award this effort to another source at this time. The learning curve associated with training new SMEs on the system is estimated to be six to nine months. The additional costs and schedule delay to get new contractor personnel trained in T3P and innovative technology solutions in support of EWTV would not be beneficial to the Government or the Army.

6. Efforts to Obtain Competition: This action will be synopsized.

a. Effective Competition: Because this is a sole source action, effective competition is not applicable.

b. Subcontracting Competition: Subcontracting competition will be achieved by the continued support BAH has provided to date. BAH will continue to subcontract at least 20% of the work to an established team of small business partners, 2% to woman owned businesses and 2% to service disabled veteran small businesses.

7. Actions to Increase Competition: Competition was achieved during the solicitation process for this contract and the current TO 0006 was awarded via Fair Opportunity. The request for proposal was issued on 12 December 2017 and the Government received three proposals on 19 January 2018. TO 0006 was awarded to BAH on 30 April 2018.

Any future requirements for a follow-on contract will be acquired competitively under the RS3 omnibus.

8. Market Research: During the last 12 months, Government technical personnel have conducted extensive Internet research, visited trade shows and made personal contacts with other engineers and procurement personnel involved in the assessment of the availability of offerors to provide EWTV support for the US Army I2WD EWAGS Division.

In the June/July 2018 timeframe, it was determined by the ACC and I2WD technical team that increasing the ceiling on the NAPS TO 0006 was the best option to execute the EWTV effort in accordance with the cost, schedule and performance requirements.

Also on 3 October 2018, Army Contracting Command – Aberdeen Providing Ground (ACC-APG) on behalf I2WD, EWAGS released a Request for Information (RFI) on the Federal Business Opportunities (FBO) website as part of market research refresh. The market survey was intended to identify sources with the capability and necessary resources to provide support to the EWTV program. On 10 October 2018, only one response was received, which was from BAH.

The Government review showed that BAH had the expertise and resources to support the required efforts.

9. Interested Sources: Only BAH provided a response to the RFI. To date, no other sources have written to express interest in the acquisition.
