ATTN: CCAP-SCG

(6) month partial extension of services (CLIN 2001) pursuant to FAR Clause 52.217-8, Option to Extend Services and FAR 6.302-1(a)(2)(iii)(B). This modification will extend the Firm-Fixed Priced (FFP) maintenance and support services contract line item for the Enhanced/Next Generation 911 (e-911) system citing Fiscal Year 2016 Operations & Maintenance, Army funds.
The period of performance for the order will run from 14 June 2016 – 13 December 2016. The contractor is E-9 Corporation. The anticipated cost of modification (W91ZLK-13-P-0631- P00008) is
The current contractor, E-9 Corporation, a SDVOSB, has a size standard $38.5 million, maintains an active account on System for Award Management (SAM), is in good standing with the Federal Government and does not have any active or inactive exclusions. E-9 Corporation is currently within good financial and performance standing under subject contract.
5. Description of Supplies/Services: This action is for the continued performance of maintenance and support services for the e-911 system including but not limited to, Computer Aided Dispatch/National Crime Information Computer (CAD/NCIC) maintenance, CAD professional services, Next Generation 911 (NG911) maintenance, Interaction WebCAD, Gas Insulated Substations (GIS) maintenance, and system maintenance at the Edgewood area of APG, MD. The requiring activity is the Directorate of Emergency Services (DES), APG, Maryland.
6. Authority for Justification: FAR 6.302-1(a)(2)(iii)(B) – “For DoD, NASA, and the Coast Guard, services may be deemed to be available only from the original source in the case of follow-on contracts for the continued provision of highly specialized services when it is likely that award to any other source would result in…Unacceptable delays in fulfilling the agency’s requirements.”
FAR Clause 52-217-8, Option to Extend Services states the Government may require continued performance of any services within the limits and rates specified in the contract not to exceed six
(6) months. The price for the six (6) month extension was not solicited nor evaluated as part of the initial procurement of this contract.
7. Reason for Authority Cited: Utilizing E-9 Corporation, for the continuation of maintenance and support services is important and necessary for the following reasons:
DES is required to utilize the e-911 system in order to be compliant with Department of Defense (DOD) Emergency Response mandates. E-911 is a mandatory requirement in accordance with Public Law 108-494, Enhanced 911 Services. The law dictates the use of state-of-the-art telecommunications capabilities to 911 systems and further states that emergency services shall be coordinated at the Federal, State and local levels. The e-911 system is currently used by the state of Maryland and Harford County local governments. In order to communicate and coordinate efficiently amongst first responders, DES installed the same system in September of 2013. Prior to the installation, APG NEC approved the system for installation on APG networks.
a. Failure to provide continuous maintenance and support services to the e-911 system could cause system failure which would inhibit first responders from receiving, prioritizing and responding to 911 emergency and non-emergency calls. Failure of the system would also inhibit first responders from determining appropriate jurisdictions (APG v. Harford County v. Cecil County v. Baltimore County) and services needed, transferring callers to proper agencies and providing public safety personnel with accurate information. This could prevent or delay emergency responses needed to government facilities and/or personnel and result in the loss of property and/or life.
b. Failure to provide continuous maintenance and upgrades to the system could result in the loss of DES’ Federal Communications Commission (FCC) certification which is a mandatory certification pursuant to 47 CFR Section 2.907.
8. Actions to Increase Competition: DES is currently in the process of re-procuring maintenance and support services and will continue to do so during the six (6) month extension.
e-911 maintenance services is only available from E-9 Corporation due to the proprietary nature of the system. FAR 19.1406 states that a Contracting Officer may award to a SDVOSB on a sole source basis provided that there is not a reasonable expectation that offers would be received from two or more SDVOSBs and the SDVOSB is determined to be responsible. Prior to re-procurement, a Sources Sought Notice will be posted to FBO in order to determine current market conditions and whether or not the requirement can be opened to competition.
9. Market Research: Market research was conducted in order to determine if there was currently a contract vehicle that the DES could utilize in order to maintain continuity of services while the re-compete was conducted by the ACC-APG, Installation Division. Currently there is no other contract vehicle administered by ACC-APG that could temporarily support this effort without causing delays in services which could subsequently impact the mission in a negative manner.
10. Procurement History: Contract W91ZLK-13-P-0631 was awarded as a SDVOSB sole source acquisition utilizing NAICS Code 511210. It was awarded on 12 September 2013 and was issued for one (1) base year (installation of the system) and two (2) option years for maintenance and support.
11. Contracting Officer’s Determination: I hereby determine that this partial extension represents the best value to the Government.
