FAR Part 16 Exception to Fair Opportunity Justification Under Multiple Award Indefinite Delivery Contracts
For Actions Exceeding the Simplified Acquisition Threshold (SAT)
1. Contracting Activity: U.S. Army Contracting Command-Aberdeen Proving Ground (ACC-APG) Belvoir Division, 10205 Burbeck Road, Building 362, Fort Belvoir, VA 22060-5811.
2. Description of Action: Communications-Electronics, Research, Development and Engineering Center (CERDEC), Night Vision and Electronic Sensors Directorate (NVESD), Modeling and Simulation Division (MSD), Simulation Applications (SA) Branch requests a Cost Plus Fixed Fee six-month extension modification to Task Order (TO) BD33, Contract W15P7T-06-D-E402 with CACI Technologies Inc. (CACI), 14370 Newbrook Drive, Chantilly, VA 20151-2218, which expires on 31 January 2017. This action requests that performance of services on the existing TO be extended by six months until 31 July 2017. Projected award is January 2017, and Fiscal Year (FY) 2017, Operations and Maintenance, Army; Other Procurement, Army; and Research, Development, Test and Evaluation funds will be used.
An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B).
Ms. Kathleen Walk approved an acquisition plan in accordance with DFARS 207.103(d)(i)(B) for Mr. Edward G. Elgart, Principal Assistant Responsible for Contracting on 5 April 2005 for the CECOM Strategic Services Sourcing (S3) Program.
The required acquisition plan in accordance with DFARS 207.103(d)(i)(B) is currently awaiting approval.
3. Description of Supplies/Services: NVESD, MSD, SA Branch conducts modeling and simulation research and development for the Command, Control, Communications, Computer, Intelligence, Surveillance and Reconnaissance (C4ISR) environment. The use of these modeling and simulation applications provide a realistic approach to using future hardware in theatre. Simulation applications, when developed, are expected to provide a close replication of human interaction, direct the development of engineering design alternatives, allow users to evaluate new tactics, techniques and procedures, and participate in a virtual environment for Joint and Army Live, Virtual and Constructive (LVC) experiments. This order supports modelling and simulation for C4ISR models in a LVC simulation environment. These simulation applications are used to support current state of the art sensor technology development, concept exploration, system integration, potential test and evaluation phase, production of releasable hardware, pre-deployment training and planned support of sensor based systems for the US Army and other Department of Defense (DoD) organizations in the focus areas of Sensors, Sensor Systems and Force Protection at locations in the Contiguous United States, Outside of the Contiguous United States and Theatre locations. This effort also provides support in planning, development, execution, and analysis of LVC C4ISR experiments which
Program/Equipment: Night Vision and Electronic Sensors Directorate/ address key technology and military utility issues. Support is needed for the training and field support of the fielded equipment, Soldier’s pre-deployment training (occurring in a classroom environment and/or at various Contiguous United States mobile and Fixed Site Training locations) and Field Service Representatives for Outside Contiguous United States deployments to cover operational assessments, fielding, training, and sustainment support. Contractor deployments require extended stays in Theatre and other locations which are vital in order to adequately support fielded equipment. Finally, contractor technical support for customer products and product training includes:
training hardware, training software, Program of Instructions (POI) management, instructor personnel, and property transfer management. In extending the TO by 6 months, CACI will be performing the same effort with no additional scope being added.
The independent Government Cost Estimate IGCE was broken out by labor categories and not by the work efforts (not feasible with this type of effort).
Period of Performance: 1 February 2017 to 31 July 2017 Total Value: $24,958,033.57
4. Authority Cited: 10 U.S.C. § 2304c(b)(2) as implemented by FAR 16.505(b)(2)(i)(B)
– Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.
5. Reason for Authority Cited: Only CACI can continue to perform these services without reduction of manpower, quality of services and interrupting customers now through the award of the follow-on effort.
Program/Equipment: Night Vision and Electronic Sensors Directorate/
Therefore, CACI’s expertise is necessary to providing the support required in a timely manner. At this time, only CACI possesses these unique capabilities and has the experience required to successfully complete all of the requirements of the task without a detrimental disruption to the Warfighter. This is specifically due to the highly specialized expertise required to support all of the US Army’s EO/IR sensors, multi-modal integrated
Program/Equipment: Night Vision and Electronic Sensors Directorate/ sensor systems, force protection sensor systems, and vehicle based sensor system technology areas in current operations.
The Government estimated that utilizing any other contractor (other than the incumbent) would require a duplication of expenditures
This would introduce a significant gap in support to the Warfighter for the deployed sensors and systems, which is unacceptable. Any other contractor (other than the incumbent) would have to build a complete team with a sufficient number of deployable and system trained employees, as well as experienced ready personnel to research, develop, test, and integrate simulation software in order to properly maintain the fielded equipment and train soldiers ready to deploy for these sensor systems
The duplication of cost and schedule is not expected to be recovered through competition due to the temporary nature of this bridge modification. Failure to extend this effort would require personnel that are currently deployed to multiple theatres supporting warfighting commanders on the ground to be withdrawn, causing a significant degradation in support and greatly impacting the operational availability of all the critical deployed systems listed above.
6. Actions to Increase Competition: W15P7T-06-D-E402, BD33 was awarded under the Strategic Sourcing for Service (S3) multiple award contract (MAC) with 7 contract holders and the ordering period ended March 2016. The acquisition strategy for this follow-on effort is to solicit via fair opportunity through the R2-3G MAC which has 18 contract holders. Since the R2-3G MAC has a larger amount of primes than the S3 MAC, competition is anticipated to increase. The R2-3G contract vehicle ensures more visibility and opportunity for competition.
7. Market Research: ACC-APG Belvoir Division issued a Request for Information (RFI) containing a list of Market Research questions, as well as, a Performance Work Statement Pre-Release to the 18 contract holders on the R2-3G contract vehicle on 01 June 2016, as a means to gauge interest in the follow-on requirement.
