FAR Part 16 Exception to Fair Opportunity Justification
Under Multiple Award Indefinite Delivery Contracts
For Actions Exceeding the Simplified Acquisition Threshold (SAT)
1. Contracting Activity: ACC-APG Division E (W56JSR), 6001 Combat Dr., APG, MD 21005
2. Description of Action: Communications Electronics Command (CECOM) Software Engineering
Center (SEC) Enterprise Information System Directorate (EISD) Satellite and Systems Management
Division (SSMD) requests a Cost-Plus-Fixed-Fee (CPFF) Term Modification 18 to Task Order (TO)
W15P7T-12-D-E006-KX01 with Engility Corporation, 3750 CENTERVIEW DR, CHANTILLY, VA
20151-3200. The Government Projects award for March 2017. The value of this action is $7,061,499.00 and will be funded using FY17 Operation and Maintenance, Army (OMA) funds and customer
Procurement funding. This action is to extend the period of performance (POP) by six (6) months from 29
March 2017 to 28 September 2017 plus a two (2) month option from 29 September 2017 to 28 November
2017. The eight (8) month extension is requested to enable the Government to continue daily operations of the Satellite Communications Software Support (SAT COMM) effort.
An acquisition plan is not required because an acquisition plan was approved for the NexGen Base
Indefinite Delivery Indefinite Quantity (IDIQ) contract which therefore exempts individual task orders from this requirement.
3. Description of Supplies/Services: The SAT-COMM TO supports the EISD SSMD mission encompassing acquisition, Post Deployment Software Support (PDSS) and Post Production Software
Support (PPSS) for over thirty (30) Satellite Communications (SATCOM) Systems, with support for the facilities testbed of the same. This effort includes software technical support in the following areas:
development, software and system engineering, acceptance testing, information security management, quality assurance, configuration management, replication and distribution, cost benefit analysis of future technology assessments, and interoperability testing. The facility support effort includes inventory management of the software development facilities resources; maintaining the equipment which resides in the facility, ensuring that the equipment is available and operational, testing the interoperability of the equipment, assisting with the procurement, tracking, and maintenance of software licenses; and providing administrative support as required in support of these efforts.
SSMD provides systems and software engineering support for Army Program Executive Officers (PEOs), Program Managers (PM), Product Developers (PD), Headquarters Department of the Army (HQDA) and its components, and other Department of Defense (DoD) elements. The ultimate customer and consumer of the products and services is the Warfighter in the field.
SSMD supports the PM by providing the required software engineering management support, technical expertise, and professional guidance and assistance. For SATCOM MCDSs that have been deployed but remain under production, EISD provides PDSS to the PM, by providing acquisition software engineering support in the development, design, and implementation of software enhancements and corrections to software defects. After the SATCOM MCDS production is complete, the system enters the Post
Production Software Support (PPSS) phase.
TO W15P7T-12-D-E006-KX01 provides services including consolidated engineering, technical, and facility support services to support EISD SSMD at Aberdeen Proving Ground (APG), MD, Ft Lee, VA, Ft
Belvoir, VA and Shriever Air Force Base, Colorado Springs, CO. This support includes a full suite of functional and technical capabilities necessary to support the Post Production Software Support/ Post
Deployment Software Support (PPSS/PDSS) and facility support as detailed in the Performance Work
Statement (PWS) associated with the referenced task order. The SSMD provides systems and software engineering support for Army Program Executive Officers (PEOs), Program Managers (PM), Product
Satellite Communications Software Support
Developers (PD), Headquarters Department of the Army (HQDA) and its components, and other
Department of Defense (DoD) elements. The ultimate customer and consumer of the products and services is the Warfighter in the field. There are no changes to the existing PWS.
4. Authority Cited: 10 U.S.C. 2304c(b)(1) as implemented by Federal Acquisition Regulation
(FAR) section 16.505(b)(2)(i)(A) – The order will be issued on a sole-source basis as the need for the services is so urgent that providing a fair opportunity would result in unacceptable delays.
5. Reason for Authority Cited: The work performed under TO W15P7T-12-D-E006-KX01 ensures the operational readiness of the SAT-COMM systems, and it will be detrimental to the Government if there is a lapse of service. The EIS-SSMD Directorate/Division provides overall support in the areas of:
development, software engineering, system engineering, network engineering, program management, testing, information security management, quality assurance, configuration management, equipment management support, technical writing, and administration support. If support for these services is not continued, it impacts the SEC EIS directorate’s ability to provide mission support to deployed military personnel and may put lives at risk.
The proposed extension modification is required to maintain continuity of essential services provided under the current SAT-COMM TO W15P7T-12-D-E006-KX01 until the re-compete SAT-COMM solicitation SSESR-2068 is awarded. Due to unforeseen pre-award delays, including substantial changes required to the document package, changes in requirements due to unforeseen changes in the availability of seating space for the contractors on site at APG, MD, an increase in the level of effort required by the addition of Ft Lee, VA and Ft Belvoir, VA and significant questions from industry all substantially extended the proposal period. Therefore, the re-compete Task Order under solicitation number SSESR-
2068 will not be awarded before the current Task Order expires on 28 March 2017. Because of the aforementioned delays, the final solicitation has not been issued which has delayed receipt of proposals.
As such, the Government anticipates award of the SAT-COMM re-compete on or about 25 September
2017. After award, there is a requirement for a sixty (60) day transition period to ensure no interruption of services for this critical mission.
Timeline for the current solicitation SSESR-2068 is as follows:
Proposals Received 15 May 2017
Evaluation of Technical Proposals Due 06 June 2017
Evaluation of Cost Proposals Due 14 July 2017
Award Decision 21 July 2017
Pre Award Peer Review 25 August 2017
Contract Award 25 September 2017
ENGILITY CORPORATION, 3750 CENTERVIEW DR, CHANTILLY, VA 20151-3200, is currently performing SAT-COMM under competitively awarded Task Order W15P7T-12-D-E006-KX01. Engility as the incumbent contractor, has the necessary manpower, skills and abilities to perform the tasks required within the required schedule. It is anticipated that it will take six (6) months to complete the follow-on competition and sixty (60) additional days to fully transition all tasks. Based on the circumstances described, Engility is the only contractor that can reasonably and realistically provide the required urgent services without a severe interruption of services. Transferring responsibility to another contractor at this time would cause an unacceptable delay, based on the need for a 60-day phase-in and phase-out period and to complete the already in-progress fair opportunity competition for the follow-on task order.
6. Actions to Increase Competition: Per paragraph 7, below the Contracting Officer conducted market research and determined the sources considered were not feasible due to the long lead time needed to do a competitive solicitation, proposal evaluation, conduct negotiations and make award of a new task order by the expiration of existing task order W15P7T-12-D-E006-KX01 by 28 March 2017.
Satellite Communications Software Support
7. Market Research: On 15 February 2017, the Contracting Officer (KO) completed market research.
During the market research assessment, the Contracting Officer considered other sources on existing IDIQ contracts. The Contracting Officer reviewed the performance work statement on the NexGen IDIQ contract and found the performance work statement includes similar software engineering support services for PPSS and PDSS. As a result, the KO has determined all sources under the multiple award SSES
NexGen IDIQ contract are capable of performing the required services. However, based on the expertise of
KO, the KO determined no other source would be capable of performing the required services by the current task order’s expiration date of 28 March 2017. In making this determination, the KO considered the lengthy solicitation source selection process, the time for staffing personnel after award and staff clearance requirements. The KO determined from this assessment that it would be impossible for any other source other than the incumbent contractor EIS to staff and complete work in progress and to provide the contractual 60-day phase-in and phase-out period without a break in service.
8. Other Facts:
