About this file
This document is a Justification and Approval (J&A) for a sole source contract for equipment maintenance services. The Defense Health Agency (DHA), specifically the Defense Centers for Public Health-Aberdeen (DCPH-A) and United States Army Medical Research Acquisition Activity (USAMRAA), is seeking maintenance services for laboratory equipment from Revvity Health Services, Inc. The contract covers annual equipment maintenance for one (1) annual preventive maintenance service and unlimited repair services for specific scientific instruments, including three Quantulus Liquid Scintillation Counters, one Nucleic Acid Processor, and three Chemagic Rod Head variants (96, 24, and 12 Rod Head).
The total contract value is $461,248.83 over a 60-month period, consisting of a 12-month base period and four 12-month option periods. Revvity is identified as the sole source provider because they are the only approved source for new or remanufactured repair parts and service support for these specific instruments. The government conducted market research and a 15-day notice on sam.gov, which yielded no competitive responses. The maintenance services include OEM certified parts, software support services, software updates, and unlimited technical support calls. The contract is justified under FAR 13.501(a) as a sole source acquisition for commercial items.

4. Statutory Authority Permitting the Sole Source Acquisition: 41 United States Code 1901 as implemented in FAR 13.501(a), sole source (including brand name) under the authority of the simplified procedures for certain commercial items.
5. Rationale Justifying Use of Authority Cited: Revvity Health Services Inc., (Revvity) previously known as PerkinElmer Health Science, was identified as the proprietary service provider for Perkin Elmer instruments listed above. Per Revvity’s proprietary letter dated 11 November 2023:
“Revvity Health Sciences Inc is the only approved source for new or remanufactured repair parts and service support for your Revvity equipment listed on quote # 40868447 Revvity Health Sciences Inc; TINS, DUNS Federal ID, Tax ID, Banking info, etc. has not changed only the company name.”
6. Efforts to Obtain Competition: The Government examined all possible strategies to increase competition before moving forward with the justification. The requirement was synopsized on the Governmentwide Point of Entry (GPE) at sam.gov via a Notice of Intent to Sole Source for a period of 15 days (in accordance with FAR subpart 5.2). The notice was posted on 4 April 2025 with responses due on 21 April 2025. No responses were received from the industry.
7. Actions to Increase Competition/Remove or Overcome any Barriers to Competition: The Government examined all possible strategies to increase competition for the subject requirement and determined that competition was not viable for the requirement since Ravvity is the sole provider of parts and software and certified technicians to perform the work. Before each new requirement, DCPH-A and the USAMRAA’s Contracting Office will review upcoming requirements for competitive acquisition strategies by conducting market research to see if Revvity has changed to licensing third- party technicians or third-party sellers for parts and software. In addition, once these systems reach the end of its lifecycle, attempts will be made to see if there are similar systems available which provide third-party support.
8. Market Research: A search for “lab equipment and Revvity” was conducted in the Ability One website. There were no results. A search for “Revvity Lab Equipment” on the Unicor website resulted in “no matches found”. A search in the GSA Library for Services catalog using “lab equipment and perkin elmer equipment maintenance” provided a GSA MAS contract GS-07F-5934R for medical equipment and consumables.
Upon further review of this contract the equipment requiring maintenance are not included on the contract and it is for purchasing only. Another search was conducted on FPDS-NG using the Cage Code “1MCW2” and resulted with a contract number N4523A22D5709 with Revvity for another maintenance contract that was awarded on sole source basis and cited the same justification as this requirement.

9. Other Facts:
a. Procurement History: No history is available as the repairs and updates to software were covered under the OEM warranty from the purchase of the equipment.
(1) Is this a new requirement? Yes
(2) If 9.a.(1) is No, was the action just prior to this one competed?
(3) If 9.a.(2) is Yes, what has changed where this action cannot be competed? This requirement was not competed as the services, parts, and software updates were covered under a warranty from the purchase of the equipment. This document demonstrates this new requirement cannot be completed.
b. Additional information: The equipment is manufactured by Perkin Elmer however; the equipment is solely maintenance by Revvity. A recent awarded contract by USAMRAA for similar equipment for preventive maintenance; repairs; software updates; and telephone support services, HT942525P0054, contains a total contract price of $610,600.00 with a similar period of performance of twelve (12) month base year and four (4) option periods. The award was released on 14 April 2025 as a sole source citing the same FAR reference and justification.
10. Interested Sources: To date, no other sources have written to express an interest in this requirement.
