4. Authority: FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold (SAT), only one source reasonably available, urgency, exclusive licensing agreements, brand name, or industrial mobilization.

5. Reasons for Authority Cited:

CCDC-CBC currently has Agilent and Thermo Fisher Scientific spectrometers in house.

Using this equipment involves consumable items. These items include: vials, caps, and columns, which are designed specifically to work with their devices. Therefore, only brand name consumables will meet the Government’s need. Generic parts are not compatible with these brand name spectrometers, and would require the Government to replace the spectrometers currently in house with models compatible with generic parts. This would lead to duplication of costs (to re-stock the current inventory of mass spectrometers and brand name parts already in house). Additionally, this would require personnel to be re-trained on the new instruments. To re-train employees, and re-stock the current inventory of spectrometers would cost approximately $500,000;

therefore, being cost prohibitive to the Government. Finally, without these brand name consumable items, the lab workers will not be able to process environmental samples from the chemical and biological operations. If the samples are not tested, operations will stop and the mission will be impacted.

6. Publicizing Contract Actions: The public display and synopsis requirements of FAR

5.101 and FAR 5.203 are not required in accordance with the exception found at FAR 5.202(a)(4).

7. Market Research: In October 2019, historical acquisitions, personal knowledge, contact with other government professionals, and review of catalogs were used as part of the market research. It was determined that aftermarket laboratory consumables were not available for use with CCDC-CBC’s existing spectrometers.

A Sources Sought Synopsis was posted to GSA and Beta.SAM.Gov from 14 JAN 2020 to 21 JAN 2020. There were no respondents from GSA. There were four respondents from Beta.SAM.gov. One offeror was identified as a participant in the 8(a) Small Business Administration Program: FlexBiosys, Inc., cage code 7K6B6. Therefore, it was concluded this contract should be solicited and awarded following the procedures set forth IAW FAR Subpart 19.8.

8. Technical/Requirements Certification: I certify that the supporting data under my cognizance which are included in the justification are accurate and complete to the best of my knowledge and belief.

John Barczak Date Biologist

10. Contracting Officer Certification/Approval:

I hereby determine that the anticipated cost or price to the Government for this contract action will be fair and reasonable based upon comparison of the proposed price with prices found reasonable on previous purchases in accordance with (IAW) FAR 13.106- 3(a)(2)(ii), and comparison to the IGCE in accordance with FAR 13.106-3(a)(2)(vi).

I certify that this justification is accurate and complete to the best of my knowledge and belief, and that completing this purchase pursuant to the procedures set forth IAW FAR Subpart 19.8, “Contracting with the Small Business Administration (The 8(a) Program) is in the best interest of the Government. Additionally, I approve this justification to limit competition subject to the availability of funds and provided that the supplies herein described have otherwise been authorized for acquisition.
