About this file
This justification and approval document describes a sole source award for critical repairs to equipment at the Folsom Dam control structure. The contract will provide brand name replacement parts that match the original equipment specifications, including one Levelgage submersible pressure transducer from Keller America, six XV-152 Micro Panel gasket seal kits from Eaton, and remanufacturing of a Type 4X floor mount double door enclosure left main door unit from Schaefer Electrical Enclosures. Additionally, the contract awards sole source calibration work to Electro Hydraulic Machinery Company as the original designer and installer of the dam equipment. The justification cites only one responsible source considerations and the need for brand name products to ensure proper fit, form and function. The Army Corps of Engineers awarded contract W9123820C0030 to Hankins Group, Inc. on September 22, 2020 for $520,901 to complete the repairs.

Control No: FY20-14
FOR OFFICIAL USE ONLY
FAR Part 6 Justification and Approval for Other than Full and Open Competition
1. Contracting Activity: U.S. Army Corps of Engineers, Sacramento District
2. Description of Action: The JFP requires a firm-fixed-priced contract for repairs to critical equipment at the Folsom Dam. Brand name parts are required, in order to maintain the same fit, form and function of those that are broken.
3. Description of Supplies/Services: This contract will complete remaining construction activities from the original Phase III contract that constructed the Control Structure that houses six bulkhead gates (BHG), six Tainter gates and control systems. This action will also perform repairs to equipment that was installed under Phase III and will make improvements to control and data collection systems essential to proper operation of the Control Structure.
Below are the required brand name products and estimated cost breakdown. The project includes the requirement to provide and install the following:
Equipment Company
One (1) Levelgage submersible pressure transducer and 120 ft. of HYTREL cable
Keller America
Six (6) XV-152 Micro Panel Gasket Seal Kits Eaton
Six (6) Type 4X Floor Mount Double Door Enclosure – Left Main Door with attached outer door and hinged door kit
Schaefer Electrical Enclosures
Additionally, Only One Responsible Source (subcontractor Electro Hydraulic Machinery Company (EHM)) is capable of performing necessary calibration work for this repair project.
EHM is the only qualified contractor for this work because they are the designer and installer of the original Tainter and BHG systems. EHM’s work will include rearranging all of the control switches, push buttons, and disconnecting and reconnecting all control signal wires from the panel. There is system set up/calibration needed for the BHG cabinets work item because of the dismantling/reassembly of the cabinet. EHM will ensure all functionality of the system is restored once reassembled. EHM will also perform calibration of the pressure and radar transducers.
4. Authority Cited: 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1(a)(2) and 6.302-1(c), Only one responsible source and no other supplies or services will satisfy agency requirements, and brand name descriptions.
5. Reason for Authority Cited: The brand name equipment listed above are the only products that will work in accomplishing the required repairs. As the parts must be the same brand in order to preserve the form, fit and function of the Control Structure. In addition, the sole source subcontractor is the only firm capable of performing the necessary calibration, due to their experience as both the designer and installer of the equipment.
As described at FAR 6.302-1(a)(2), when the supplies or services required by the agency are available only from one responsible source, or for DoD, NASA and the Coast Guard, from only one or a limited number of responsible sources, and no other types of supplies or services will satisfy agency requirements, full and open competition need not be provided for. As further described in FAR 6.302-1(c), an acquisition or portion of an acquisition that uses a brand-name description or other purchase description to specify a particular brand-name, product, or feature of a product, peculiar to one manufacturer does not provide for full and open competition, regardless of the number of sources solicited; and shall be justified and approved in accordance with FAR
6.303 and 6.304.
Three brand name components are required:
1) Levelgage Submersible Pressure Transducer - Keller America: Currently, there are eight pressure transducers (model Levelgage, manufactured by Keller America) which were installed and used at the Folsom JFP Auxiliary Spillway Dam to measure the pool water level. One of the transducers is defective and needs to be replaced. The replacement will have to be an identical part for form, fit and function with the existing infrastructure. No other similar parts can be guaranteed to work with the existing control systems without any modifications and introducing risks. Upstream and downstream water level readings from multiple pressure transducers send data to the BHG programmable logic controller (PLC) units to allow operation of the BHGs. All pressure transducers should be of the same type so the signal sent to the BHG PLCs is uniform.
The inability of the BHGs to open due to a communication error between the pressure transducer and PLC would result in the paired Tainter gate being out of service. Having multiple brands of pressure transducers would increase the operation and maintenance complexity of the BHG controls system for Controls and Instrumentation staff.
2) XV-152 Micro Panel Gasket Seal Kit - Eaton: The JFP Folsom Auxiliary Spillway Dam has six BHG control systems. These systems are located outdoors. Each system has a touchscreen monitor (XV-152 Micro Panel), a critical component for the control and operation of the gates.
The gasket seals that protect these monitors from water intrusion are worn out and need to be replaced. The replacement gasket seal kits will have to be provided by the same manufacture of the touchscreen monitors to maintain form, fit and function and to retain the certification for outdoor qualifications and warranty from the manufacture. The BHG control cabinets have external touchscreens to allow the Operators to control gates and read data. These touchscreens use a factory installed gasket seal on their backside that mates to the stainless steel of the control cabinet to provide a watertight seal. An upgraded gasket seal kit is manufactured by Eaton, who also manufactured the touchscreens. This kit will improve the reliability of the touchscreens during periods of wet weather and stop any water from flowing past the backside of the touchscreen into the interior of the touchscreen housing. During wet commissioning testing, water was able to get past these seals and cause multiple touchscreens malfunctions. This condition cannot be allowed to repeat in the future, especially during flood operations where timeliness of gate operations is vital. Replacement of the original gasket seals will enhance the reliability of the touchscreens.
3) Type 4x Floor Mount Double Door Enclosure – Left Main Door - Schaefer Electrical Enclosures: The BHG control cabinet contains all controls and power components for operating the BHG. The control interface is a touchscreen that mounts through an opening cut into the front of the left main door of the cabinet. The face of the touchscreen provides control and data readout for Operators without having to open the left main door. This touchscreen requires protection from adverse weather since the cabinet is an exterior feature. To accomplish this, an outer door has been attached to the front of the left main door, however, this outer door was a field attached feature and as such, it does not seal and water can still get to the touchscreen. The left main door and attached outer door need to be remanufactured as one unit by the original manufacturer so a NEMA-4 weatherproof rating is maintained. Only the original manufacture can reproduce the left main door to the original design with the cutouts for the touchscreen, pushbuttons and indicator lights. The manufacturer will also need to incorporate the attachment of a sealable outer door to protect the touchscreen, pushbuttons and indicator lights. Having the touchscreen, pushbuttons and indicator lights on the BHG control cabinet protected from adverse weather is critical to the facility being able to operate at all times without fail. Past experience shows that continual exposure to adverse weather and constant sunlight can reduce the reliability of the exposed touchscreen therefore, it must be protected. Only the original manufacturer of the cabinet can easily remanufacture the same left main door with an attached outer door since they possess the dimensions and specific layout of the cutouts in that door from the original manufacturing. As with the gasket seal kit, during wet commissioning testing, water was able to cause multiple touchscreens malfunctions. This condition cannot be allowed to repeat in the future, especially during flood operations where timeliness of gate operations is vital. Replacement of the BHG left main door and attached outer door will enhance the reliability of the touchscreens, pushbuttons and indicator lights.
No technical data packages, specifications, engineering descriptions, statements of work or purchase descriptions suitable for full and open competition exist or are available due to the proprietary nature of these products. The manufacturers that engineered, designed, and manufactured these parts and components are not known to have made their proprietary technical information for these commercial, and application-specific items available commercially, and no form, fit, or function equivalent item technical data is known to be available, and there are no known planned efforts to remedy this condition.
No viable alternatives to the required brand name parts and subcontractor services will satisfy agency requirements. There are no technical alternatives, as the time-sensitive work must be performed expeditiously using the specific brand-name supplies and subcontractor services identified in this justification document. The work must be performed now – this civil works infrastructure work cannot be appropriately postponed or suspended due to operational requirements including seasonal low Folsom Reservoir water levels. No in-house personnel with the wide spectrum of required services are available. The required work cannot be de-scoped to a lesser level – only the required brand name products are suitable, and only the required subcontractor service provider can produce a complete and usable project.
6. Efforts to Obtain Competition: In accordance with FAR 5.202(a)(4), this action will not be synopsized.
a. Effective Competition: Because this is a sole source action, effective competition is not applicable.
b. Subcontracting Competition: this sole source with brand name descriptions effort is being awarded to an SBA-certified Small Disadvantaged (8(a)) business
7. Actions to Increase Competition: This work is non-recurring, but also not constructively capable of being included in any known competitive future work requirement due to its unique repair requirements. Where repairs of this nature may be properly identified and prepared for a competitive procurement given the availability of technical data, competitive expertise, and a pool of capable contractors, the work should be competed in the future as possible. No other known actions can be taken to improve competition given the unique nature of the required critical civil works infrastructure work scope.
8. Market Research: The work detailed in this Justification and Approval is part of a larger repair contract. The work is all electrical and civil engineering in nature. Once the scope of this work was determined, coupled with the estimated value of the work, the type of money it is funded by, and the needed time-frame for this work, it was determined 8a sole source is the best acquisition strategy. Once that strategy was approved, SBA was contacted, and Hankins Group, Inc. was recommended.
