About this file

This is a Justification Review Document for an Exception to Fair Opportunity under a Multiple Award Indefinite Delivery Contract. The U.S. Army Contracting Command – Rock Island (ACC-RI) requests approval for a cost-plus fixed fee Undefinitized Contract Action (UCA) under the Logistics Civil Augmentation Program (LOGCAP) contract W52P1J-19-D-0044, task order W52P1J-19-F-0395 with KBR Services, LLC. The requirement is for staff augmentation to address severe personnel shortages at the United States Military Academy (USMA) Logistics Readiness Center (LRC) at West Point, New York, spanning 32 positions across three critical directorates: Supply & Services (18 personnel), Cadet Uniform Factory (10 personnel), and Transportation (3 personnel). Specific services include Supply Support Activity operations, property book office assessment management, ammunition and munitions operations, program management office support, and project planning. The anticipated period of performance extends from a specified date with two four-month evaluated option periods, with an expected award in May 2026 obligating fiscal year 2026 Operations and Maintenance, Army funds.

The justification cites RFO FAR 16.507-6(b)(1), asserting that the agency's need is so urgent that providing fair opportunity would result in unacceptable delays. The LRC provides essential support to over 4,000 cadets and manages critical operations including maintenance readiness for 17,500 weapons, supply accountability for $70 million in equipment, and transportation services. Persistent hiring challenges, the Department of the Army civilian hiring freeze, deferred resignation programs, and retirements have created an untenable staffing shortage with no available military units or civilians to absorb duties. Market research evaluated EAGLE West Point and sole source awards but determined both infeasible due to scope limitations and time constraints. KBR is the regionally aligned LOGCAP V contractor for USNORTHCOM and the only LOGCAP V contractor providing support in that area of responsibility, making it uniquely positioned for rapid execution. The document notes that competing this requirement among four LOGCAP V contractors would require at least 180 days, while a standalone contract would take approximately 18 months, neither compatible with the critical operational need requiring performance within seven days of the urgency statement.

Contractor: KBR Services, LLC Service: LOGCAP V Support, LRC Staff Augmentation at WPNY

Department of the Army Justification for Exception to Fair Opportunity

Under Multiple Award Indefinite Delivery Contracts

1. Contracting Activity: U.S. Army Contracting Command – Rock Island (ACC-RI), Rock Island Arsenal, Rock Island, IL 61299-8000.

2. Description of Action: Army Sustainment Command (ASC) requests a cost-plus fixed fee Undefinitized Contract Action (UCA) under Logistics Civil Augmentation Program (LOGCAP) contract W52P1J-19-D-0044, task order W52P1J-19-F-0395 with KBR Services, LLC (KBR). KBR is fulfilling an urgent requirement for staff augmentation to address severe and ongoing personnel shortages in critical roles, including installation supply at the Central Issue Facility (CIF), Installation Supply Support Activity (SSA), and Cadet Supply Division; installation transportation; armament repair; and operations at the Cadet Uniform Factory (CUF) within the United States Military Academy (USMA) Logistics Readiness Center (LRC) at West Point, New York. ACC-RI will execute this action against LOGCAP V Indefinite-Delivery/Indefinite-Quantity (IDIQ) multiple task order award contract W52P1J-19-D-0044 and it will be placed on the Setting the Theater (STT) Task Order W52P1J-19-F-0395 to KBR for administrative convenience. ACC-RI projects award for May 2026 and will obligate fiscal year 2026, Operations and Maintenance, Army funds to support this effort.

An Acquisition Plan is not required in accordance with (IAW) Defense Federal Acquisition Regulation Supplement 207.103(e) because this acquisition is included in the Principal Assistant Responsible for Contracting approved LOGCAP V program level Acquisition Plan, dated 18 December 2017. The LOGCAP V Acquisition Plan approved the use of Multiple Award IDIQs with regionally aligned Setting the Theater (STT) task orders to satisfy the guaranteed minimum. Initial service performance task orders were awarded to the regionally aligned contractor. New requirements within a theater are competed unless a JEFO approval is obtained. IAW the LOGCAP V Acquisition Strategy, Business Arrangement, requirements approved under a JEFO are sourced to the regionally aligned contractor.

On 12 April 2019, the four LOGCAP V base IDIQ contracts and multiple task orders were awarded. This included a task order award to KBR for the United States Northern Command (USNORTHCOM) STT activities, which includes crisis action planning and emerging requirements. KBR was the only contractor to receive a LOGCAP V task order in the USNORTHCOM region. Under the STT task order, the regional LOGCAP contractor conducts pre-activation planning, including efforts prior to LOGCAP being authorized to perform services, to shorten response time and establish the conditions for successful execution of future operations. Pre-activation planning includes developing an in-depth knowledge of the area of operations, a robust vendor base with possible sub-contractors, and an in-depth understanding of the geo-political environment in order to function in a multitude of possible scenarios. As stated above, KBR is the regionally aligned contractor for USNORTHCOM and is the only LOGCAP V contractor currently providing LOGCAP support in the USNORTHCOM area of responsibility. As such, the services described above supporting the USMA LRC will be awarded to KBR on a sole source basis due to ASC’s urgent and compelling need for LOGCAP support. Providing fair opportunity amongst all LOGCAP V IDIQ contract holders would have resulted in unacceptable delays to this critical requirement, which is further explained in paragraph 5 below.

3. Description of Supplies/Services: Army Regulation (AR) 700-137 established the Logistics Civil Augmentation Program (LOGCAP) as a DA regulatory program to plan for and provide contracted capabilities to assist commanders in accomplishing their missions when the sustainment force structure is not available or not an option for contingency and non-contingency requirements LOGCAP V services include, but are not limited to, the following:

This LOGCAP request is for 32 positions across three critical directorates: Supply & Services (18 personnel), the Cadet Uniform Factory (10 personnel), and Transportation (3 personnel).

These functions provide direct, daily support to cadet training, readiness, and quality of life.

The Technical Data Package for this UCA activates the following:

Supply Support Activity (SSA) Operations, Property Book Office - Assessment Management Services, and Ammunition and Munition Operations (personnel augmentation only);

Contractor enabling functions of:

Program Management Office – allows corporate back-office support of the effort (e.g. Human Resources, Contracting, etc.)

Project Planning – allows planning to meet the specific requirements of the task order

As stated above, ASC requests LOGCAP services for installation supply, installation transportation, armament repair, and operations augmentation support at the USMA LRC, West Point, NY. As also stated above, this UCA action currently includes three activated services, listed above.

The anticipated period of performance for this UCA action is from with two four-month evaluated option periods extending from The base period is intended to provide the LRC sufficient time to initiate and complete hiring actions, including posting Requests to Fill within 3 to 4 weeks following final approval and processing of the ETP. Based on pre-hiring freeze timelines, the end-to-end hiring process is expected to take between 120 and 180 days from the release of the job posting to final onboarding.

The cumulative price ceiling of this JEFO is

4. Authority Cited: RFO FAR 16.507-6(b)(1). The agency’s need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays.

5. Reason for Authority Cited:

a. Title 10, United States Code (U.S.C.) 3406, “Task and delivery order contracts:

orders” and RFO FAR 16.507-2(a)(1) “Fair opportunity procedures” require generally that when multiple task or delivery order contracts are awarded, all awardees shall be provided a fair opportunity to be considered for each task or delivery order that is to be issued. 10 U.S.C. 3406(c)(1), and RFO FAR 16.507-6(b)(1) provide an exception to the fair opportunity process when the agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays.

b. LRC West Point serves as the essential “life support” for the United States Military Academy, ensuring that over 4,000 Cadets are properly nourished, clothed, and equipped. The LRC oversees critical operations including Laundry & Dry Cleaning, Ammunition management, Maintenance Readiness for over 17,500 weapons and night vision devices, Supply and Property Accountability for more than $70 million in equipment, and Transportation Services such as Harbor Operations, Household Goods Processing, and Fleet Management. Many of these positions are trade or craft wage grade roles that are vital to the safety, health, wellness, and overall success of all Cadets.

Persistent hiring challenges, the loss of expertise, and a Department of the Army civilian hiring freeze—incrementally extended throughout 2025 and 2026—have resulted in staffing shortages of 32 Department of Army Civilian (DAC) personnel across three critical directorates: Supply & Services, the Cadet Uniform Factory, and Transportation.

These shortages are due to the Deferred Resignation Program (DRP), retirements, and the ongoing hiring freeze. There are no available military units or DA Civilians at West Point with the capacity or training to absorb these duties, and internal measures such as cross-leveling personnel and authorizing significant overtime have proven unsustainable.

c. The Secretary of War memorandum dated 27 May 2025, SUBJECT: Implementation of Executive Order 14222 – Department of Government Efficiency and Cost Efficiency Initiative, authorizes the use of contractor support to augment existing efforts where workload demands exceed current civilian capacity. An initial Exception to Policy (ETP) request was denied, requiring leadership to exhaust all internal alternatives. It is now evident that external augmentation is the only viable solution

, U.S. Army Sustainment Command (ASC) received notification that a blanket ETP approval to resume hiring would be issued to onboard additional staff for the aforementioned roles. The LRC is actively preparing Requests to Fill (RTFs) and anticipates posting them within 3 to 4 weeks following final approval and processing.

However, based on pre-hiring freeze timelines, the end-to-end hiring process is expected to take between 120 and 180 days from the release of the job posting to final onboarding, with significant challenges and delays outside the Army’s control.

Essential services such as food, clothing, equipment issuance, ammunition management, and transportation are at risk of disruption, which could compromise daily operations, critical training events, and high-profile, zero-fail events such as Reception Day (R-Day)

d. Due to the inherent flexibility of LOGCAP to on- and off-ramp services, as the LRC successfully hires for these positions, corresponding services can be descoped from the current task order, W52P1J-19-F-0395, if hiring is completed before the end of the base period. However, there is a possibility that option periods may need to be exercised in the event of hiring and onboarding delays. Should hiring and onboarding be completed prior to the conclusion of any option period, the relevant services can be promptly descoped from the LOGCAP contract at that time.

e. The urgent and compelling nature of this requirement, combined with the extremely limited timeframe for planning and execution, precludes any delay in contract award.

Given the immediate need, the requirement’s scope flexibility, and the necessity for rapid execution, LOGCAP is uniquely positioned to fulfill these operational requirements.

LOGCAP provides the contracted capabilities to plan for and, when directed, rapidly deliver the sustainment support necessary to set theaters and enable Army, Joint, Interagency, Intergovernmental, and Multinational operations. Accordingly, ASC requests the use of LOGCAP to support USMA LRC staff augmentation in order to meet critical mission requirements without delay.

The LOGCAP V competition required all offerors to demonstrate a global capability. This means that all four LOGCAP V contract holders are capable of performing the required services. However, due to the immediate support required for the USMA LRC staff augmentation, there was insufficient time to conduct a task order competition under LOGCAP V using fair opportunity procedures. The augmentation requirements were not defined or formally requested until , via Statement of Urgency titled, Statement of Urgency for Logistics Civil Augmentation Program (LOGCAP) Support at Logistics Readiness Center - West Point (LRC-WP). Based on the statement of urgency, required LOGCAP services were needed on . This left less than 7 days until the target date for initial LOGCAP performance. Standard procurement timelines could not be applied to requirements in support of this mission. Based on similar LOGCAP procurements, it would take at least 180 days for ACC-RI to compete the requirement amongst the four LOGCAP V contract holders. This encompasses a minimum of 30 days to provide adequate time to request and receive proposals from the four LOGCAP V contract holders, followed by evaluations, meaningful exchanges (if required), task order award, debriefings, and potential protests.

Existing contracts in the area do not have the similar scope, ceiling, responsiveness or capability to replace LOGCAP. Moreover, there is insufficient time to solicit and award a stand-alone contract. The time required to solicit and award an equivalent stand-alone contract would take at least 18 months, based on research conducted for similar previous urgent actions. Additionally, LOGCAP V was designed so that the contractor awarded a STT task order would be uniquely suited to perform in response to emerging requirements within its geographically awarded area. As stated above, KBR is the regionally aligned contractor for USNORTHCOM and is the only LOGCAP V contractor currently providing LOGCAP support in the USNORTHCOM area of responsibility.

As such, due to the urgent timeline, scope flexibility, and need for rapid execution, LOGCAP is uniquely suited to meeting the operational requirements. LOGCAP’s contracting agility make it the optimal vehicle to deliver a rapid and responsive solution.

Utilizing LOGCAP, an Army strategic sourcing capability, allows for quick mobilization of augmentation staff, minimizing operational risk to USMA.
