SOLE SOURCE MEMORANDUM FOR ACTIONS UNDER THE SAT
IAW FAR 13.106-1(b)(1)(i)
1. Contracting Activity: The United States Army Corps of Engineers (USACE), Humphreys Engineer Center Support Activity (HECSA)
2. Description of Action: This approval is for a new firm fixed-price contract entitled “Enhance HydroBID water management model suite to facilitate linkage to a front-end excel interface.” Funding for this contract is provided by the U.S. Agency for International Development through an interagency agreement called a Participating Agency Services Agreement (PASA). This Agreement between the USACE and the United States Agency for International Development (USAID) is entered into under the authority of Section 632(b) of the Foreign Assistance Act of 1961, as amended, 22 U.S.C. Sec. 2392(b).
3. Description of Supplies/Services: IWR seeks services and support to develop a plug-in application that allows stakeholders and decision makers develop dashboards on MS Excel that is coupled to the hydrology and hydraulic model Hydrobid to allow a large flexibility of user defined economic, social, and environmental functions. The user will be able to execute simulations from MS Excel and visualize results. Additionally, the Contractor will develop some new capabilities in HydroBid and provide training to the end users in the Dominican Republic. The Independent Government Cost Estimate is $XXX,XXX.XX. The period of performance is 12 months from the date of contract award.
4. Authority Cited: 10 U.S.C. 2304(C)(1) or 41 U.S.C. 253(C)(1) as implemented in FAR 13.106-1(b)(1)(i)
5. Reason for Authority Cited: This contract is in direct support of work IWR is performing for USAID in the Dominican Republic under the USAID-USACE PASA agreement. The IWR team has been working in collaboration with the IDB HydroBID team to develop sustainable water resources planning tools for USAID Dominican Republic partners. The HydroBID model suite is built upon proprietary software that is owned, developed, and maintained by the nonprofit, Research Triangle Institute (RTI) International. The principal reason is exclusive licensing agreements since the App developed for MS Excel must interact with a proprietary tool. Moreover, some modifications of the HydroBID software is expected. Therefore, IWR recommends that this contract be sole sourced to RTI International.
6. Efforts to Obtain Competition: It is not practical to solicit offers from other potential sources because it is deemed necessary for successful delivery that the developer of the MS Excel App knows the coding of software that the App is expected to interact with. Further, this requirement is subject to multinational cooperation between the US Government and Government of the Dominican Republic through its partnership with USAID. A Notice of Intent to Sole Source this contract will be posted to SAM.gov.
7. Actions to Increase Competition: Not applicable.
8. Market Research: The use and modification of HydroBID specifically is needed in order to meet the needs of USAID and its Dominican partners. The HydroBID Support Center or the “Centro de Soporte HydroBID” (CeSH) within the IDB provides free technical support across Latin America and the Caribbean (LAC) region, making HydroBID the most sustainable modeling option for water resources management in the Dominican Republic. Given this constraint, RTI International is the only entity capable of performing the work described in this contract.
9. Interested Sources: To date, no other sources have written to express an interest.
10. Other Facts: Not applicable.
11. Fair and Reasonable Cost Determination: I hereby determine that the anticipated price to the Government for this contract action will be fair and reasonable, based on a comparison to an Independent Government Cost Estimate in accordance with FAR 13.106-3(a)(2)(vi) “Comparison to an independent Government estimate”. Per FAR 15.403-1(b)(3), certified cost and pricing data is not required.

12. Contracting Officer Certification: I certify that this justification is accurate and complete to the best of my knowledge and belief.
David A. Kaplan Procuring Contracting Officer Phone: 703-428-8487
Approval Based on the foregoing justification, I hereby approve award of a firm fixed-price contract in the amount of $XXX,XXX.XX on an other than full and open competition basis pursuant to the authority of FAR 13.106-1(b)(1)(i), subject to availability of funds, and provided that the services and property herein described have otherwise been authorized for acquisition.
