PERFORMANCE WORK STATEMENT (PWS)

Conduct Review & Update of Modeling Relationships and Associated Computerized Applications – CADET, Hull Lines Flexibility, Powering & Emissions Handling, Ballast Templates & Wake Screening Application Introduction The U.S. Army Corps of Engineers (USACE) routinely conducts engineering and economic evaluations of coastal deep-draft waterway systems and associated general navigation features (GNFs) which are under Federal authority and jurisdiction. These evaluations are for programmatic support and implementation of waterway system improvements in addition to justification of future ongoing or subsequent operation and maintenance (O&M). Specific efforts also include analysis of ongoing evaluation of waterway system improvements respective to initial placement and subsequent maintenance costs versus associated economic benefits or return on a life-cycle basis. To support these analytical requirements, USACE employs an array of analytical models and methods which incorporate numerical relationships and input data which must be updated and enhanced on a periodic basis over time. Correspondingly, as new applications are realized for a given model or method, models and input data or information sometimes must also be revised or further developed so that models can address multiple needs or types of analysis, currency of related data, or increased detail made available in an effort to reduce error and uncertainty related to output or estimates and related support for decision making.

The purpose of the performance work statement (PWS) specifications described herein where specific to vessel lines and related work is to describe the technical needs and deliverables for baseline work efforts to conduct review and revisions (to the extent appropriate) for affiliated applications incorporating use of the hull lines library and development of capacity or capability within applications for evaluation and adjustment of vessel parameters of the world fleet employed for assessment of vessel operations. Addition(s) to the hull lines library are included in the PWS herein as optional work for a limited number of hulls. The hull lines library serves as the basis for a readily-available library of vessel hull geometries that can be used as primary input for various analytical models or applications such as vessel motion (CADET; Channel Analysis & Design Evaluation Tool for evaluation of vessel vertical motion in the offshore or open ocean approach channel environment) in addition to other applications that can potentially use cross-application format and information or specifications affiliated with hull lines profiles. These additional models in turn serve as generators of input for models and methods for economic and cost analysis of vessel operations which ultimately are used to determine economic benefits and costs of development and ongoing stewardship of Federally-sponsored waterborne navigation projects. More directly related to the lines library itself is a supporting further prototypical application for flexible adjustment of hull profiles available within the library to allow greater coverage of hull types by size and geometry within or across the world fleet (i.e., the hull lines flexibility application). The flexibility application allows moderate or limited modification of baseline library profiles to create new profiles particular to need or purpose.

As the scope of the lines library largely approaches baseline or targeted completion for commercial cargo carriers and passenger vessels, the library needs to be further expanded to include a few or limited number of remaining select hull configurations, for cargo vessels, ocean-going passenger or cruise vessels and potentially a limited range of offshore supply and support hulls. This is attributable in part due to the structural change in the composition of the world fleet over time which to some extent is ever evolving based on drivers for more efficient technology and changing needs for service in various shipping markets. To primarily complete the library in terms of commercial cargo hulls (at least for the foreseeable future), it is estimated that a comparatively limited number of additional hulls will need to be added, some being comprehensively compiled or developed with others developed via application of the lines flexibility program to test and verify functionality and correct any remaining minor technical issues for continued or future use.

The PWS as set forth herein will address addition of selected cargo, passenger and offshore support or assistance hulls. Part of this PWS will also address the integration of additional hulls to applications for powering, emissions handling, wake and vessel ballast utilities as well as review for refinement or minor adjustment to subject applications. Correspondingly, each of the subject applications (other than CADET) that may use lines profiles require a common or generally standardized format for input to provide compatibility of coverage for a more detailed and comprehensive library that will provide better coverage of the world fleet by primary vessel type and size class.

To summarize needs and requirements for deliverables under the PWS detailed herein regarding expansion of hull line profiles combined with review and update or enhancement of existing associated computerized analytical applications for function and library compatibility, any newly-developed lines profiles as set forth by the PWS herein must be compatible with the following listing of existing applications:

1.) CADET [relevant for deep-draft commercial cargo, offshore support & passenger hulls], 2.) Hull Lines Flexibility Program [primarily for application to deep-draft commercial cargo & passenger hulls, offshore support hulls, and for development of limited capabilities for tug assistance vessels], 3.) Powering & Emissions Handling Model(s) [relevant for deep-draft commercial cargo hulls, offshore support hulls, and passenger hulls with comparable capabilities for tug assistance or service vessels], 4.) Ballast Application (primarily for deep-draft commercial cargo hulls, offshore support hulls & passenger hulls], 5.) Wake Screening Application [primarily for deep-draft commercial cargo hulls, passenger hulls, and offshore support hulls with comparability of capabilities for tug assistance or service vessels; with applicability to all noted vessel types with emphasis on protected water environments]

Basel Task – Review and Update of Modeling Relationships and Associated Computerized Applications – CADET, Hull Lines Flexibility, Powering & Emissions Handling, Ballast Templates & Wake Screening Application Base Task Requirements for work efforts entail an overall comprehensive review and reconciliation of hull lines developed to-date and secondary verification and compatibility of functioning of affiliated applications. As the hull lines library is near or approaching completion, buildout and development of additional hulls will primarily constitute optional work efforts to be undertaken subject to priorities for evaluation of changes in the world vessel fleet and availability of Government resources for time, schedule and funding. Accordingly, respective to baseline requirements the contractor will be required to do a comprehensive review of all applications as developed to-date and test functionality of the following programs or applications relative to the assemblage of hull lines profiles to-date to the extent applicable (including for example that tug assistance vessels are not applicable to CADET):

1.) CADET

2.) Hull Lines Flexibility Program 3.) Powering & Emissions Handling Model 4.) Ballast Templates & Immersion Formulas or Relationships 5.) Wake Screening Application (WSA)

Respective to each of the listed applications, the contractor will review and ensure completion or invoke any reasonably warranted updates needed respective to any applicable changes applicable or required concerning existing hull profiles. In addition, the contractor will also verify compatibility and intake and functioning with all profiles and currently applicable PC-based computerized operating environments (generally Windows 10 and 11 or greater as may be applicable at the time for assignment of technical work under the PWS as set forth herein).

Specific to CADET, the contractor will review all hull lines profiles and reasonably verify that they have been validated for compatibility. Where hulls are not fully validated or it is determined correction(s) are required the contractor will undertake required corrections and\or complete validation. Respective to the hull lines flexibility program, the contractor will select three (3) hulls (i.e., a “small”, “medium”, and “large” in DWT capacity or size) for each of the primary vessel types of concern (identified as fully cellular container, tanker, and a form of bulk carrier) and apply the flexibility program to each hull to test both the ability to enlarge the hull in size and to the reduce the hull in size. In as much as described this will entail tests for the following:

1.) Single variable tests

a. Increase in length, decrease in length

b. Increase in breadth, decrease in breadth

c. Increase in summer maximum summer loadline draft; decrease in maximum summer loadline draft Multi-variable tests

d. Limited increase in all three of the above (length, breadth and draft); limited decrease in all three of the above.

Based on the preceding, the contractor will reasonably verify that the flexibility program produces viable adjustments to base input hull profiles to produce viable parameters (dimensions, capacity, and critical parameters for motion response) for creation of a both a larger or smaller vessel from a given base hull profile for initial input. Upon completion of each of these tests each created hull profile shall be added to or become part of the hull lines library (with designation how created). In addition, the contractor will be required to complete and update a general user’s guide that provides technical instruction and illustration for all of the usable features of the (hull lines modeling flexibility) program.

Specific to the powering and emissions handling model, the contractor will be required to review the computational relationships for emissions output assembled to-date and revise relationships for any current updates to the speciate database assembled by the Federal Environmental Protection Agency (EPA). Relationships for application of the model to any size and powering of a given vessel type will also be reviewed and verified. The contractor will also be required to update the independent computerized version of the model and update supporting user’s guide.

Vessel ballast evaluation templates have been developed for all vessel profiles in the lines library via prior work efforts. Under the performance work statement herein the contractor will be required to review all ballast templates as developed to-date and revise any templates where appropriate for any applicable general technological changes in parameters for vessel design and vessel\ballast management. The contractor will also be required to update the general user’s guide to provide technical instruction and illustration for all the usable features of ballast templates. Associated work will also entail review and update or revision (to the extent applicable) of the polynomial relationships for immersion by general vessel type and size.

The wake screening application is still in process but approaching completion of development. While the application has been successfully used in the interim for a number of waterway projects, there remains a margin available for improvement or incorporation for additional features. The wake screening application incorporates research on numerical and physical modeling and testing results for vessel response for hydraulic displacement under varying conditions. The contractor will be required review the associated prior research and conduct additional research to the extent appropriate to determine if additional research and findings need to be incorporated into the model, possibly leading to additional options for use. Of particular interest is the consideration of potential impact of parallel line hull shapes, related influence on bow shape and potential impacts for bow wake profile adjustment from the baseline assumptions for wave profile assumptions incorporated into the model.

Additional Hull Profile configurations and Testing \ Verification of Hull Lines Flexibility Program Foreseeable to needs for application of CADET and prudent foresight of development or update of other applications as listed or described, optional requirements (if exercised) will include comprehensive compilation or development of up to three (3) deep-draft displacement cargo vessel hulls in addition to one (1) passenger vessel hull and up to two (2) offshore support and assistance hull configurations. These will be mostly developed in base configuration (i.e., newly-developed comprehensively compiled profiles developed without use of the flexibility application). If the option for more than three (3) cargo hulls is exercised, one will be developed employing the hull lines flexibility application. Specifications or parameters for hulls are to be verified and finalized in consultation with the contractor (naval architect) and the USACE technical POC or representative based on current review of related displacement hull designs of the world fleet. All base configuration hulls are to be developed to specifications of detail and completeness for existing or prior hulls with regard to verification or validation for full compatibility of usage first and foremost with CADET in addition to other existing applications including the aforementioned ballast, powering and emissions, and wake screening applications.

The flexibility program is designed to allow rapid and abbreviated effort for derivation of additional profiles from baseline configurations of the established or compiled hull lines library. This application was developed to minimize time or costs for future expansion of the lines library where needed. Any profile(s) created via the flexibility program will be created with specifications for regard to validation or verification to the same specifications and technical detail as required and developed for base or comprehensively compiled configurations concerning compatibility with CADET to the extent possible and respective to other applications as previously described. Any deficiencies in the functioning and capabilities for applied use of the flexibility program will be evaluated by the contractor and the contractor will develop and implement corrections to the application to the extent applicable. This is required to support intended ongoing or standing capability or functionality for future application and development of hull profiles as may be undertaken in the future. Technical correctness is essential to development and potential future use for adjustment of the full array of specifications and fully functional derivative profile compilation for all vessel types and range of size characteristics reasonably representative and with the range of parameters (size and capacity) viably encompassing the existing library and additional or supplemental base profiles specified additionally herein.

Based on the preceding information, the performance work statement (PWS) as written is structured to address the following areas of technical need and associated deliverables:

While the final allocation of selection of size or class of vessels amongst vessel types is to be determined or finalized in consultation with the contractor based on expertise in naval architecture and characteristics of the world fleet, the general anticipated structure of the listing of optional additional hull profiles needed by general vessel type is summarized as follows:

Additional (Optional) Deep-Draft Cargo Vessel Types – Requirements for base and flexibility hull configurations;

a.) Development of a minimum of two (2) but possibly three (3) or up to a total of four (4) new cargo carrier displacement hull profiles to be compiled with only one to be developed via the hull lines flexibility program if the option is exercised for four (4) hulls, with vessel type and size to be determined in consultation with the contractor. Tentatively it is anticipated one (1) of which will be a bulk carrier, one (1) a liquid tanker and one (1) a fully cellular containerized carrier with possibly a profile selection drawn from the type groupings of other carrier types. Deadweight (DWT) specifications are to be determined based on current composition of the world fleet, but it is anticipated that selected hull profiles will have DWT ratings exceeding 100,000 DWTs.

b.) Development of one (1) new ocean-going passenger vessel displacement hull profile to be comprehensively compiled; with specifications for Gross Registered Tonnage (GRT) and capacity to be determined but with general design likely within neo-Panamax specifications.

c.) Development of a minimum of one (1) but up to two (2) Offshore Support vessel configurations with final specifications to be determined in consultation with the contractor based on the most current information for the world fleet specific to this hull segment (with one or both of which to be comprehensively compiled).

Summarized for reiteration; optional contract requirements include profile configuration development of profiles for cargo, passenger and offshore support vessels totaling four (4) to six (7) hulls in number of deep-draft displacement hulls generally comprehensively developed (i.e., without application of the flexibility program) with one cargo hull potentially developed via the flexibility program to include up to four (4) cargo carriers, one (1) passenger vessel, and up to two (2) offshore support vessels. These hull profiles are an (optional) addition to the profiles generated as a result or by default of single and multi-variable testing of the flexibility application for a selection of small, medium, and large size hulls as precedingly described.

Flexibility Adjustment Application for Hull Lines Library – Further Detail To make the hull lines library more useful while supporting its application and ongoing development with or toward an efficiency and economy for adding profiles or compiled configurations in the future, a computerized flexibility application has been developed. This application, for any selected configuration or profile, allows the user or analyst to adjust (i.e., either increase or decrease) one or more primary dimensional parameters of a given hull profile such as the vessel’s length (length overall [LOA] and length between perpendiculars [LBP]), breadth, and maximum summer loadline draught (MXSSLD), or any combination thereof within a limited margin and range of a given lines library base hull configuration. Ongoing work efforts involve the review and further refinement and verification of capabilities for such an application that has been developed to currently functional form (which is part of the technical work required via the PWS herein). In addition to user-adjustment by dimensions, specifications also include compensating adjustment (by the flexibility application itself) of all three-dimensional points or loci of reference for prediction of vessel stability and motion or motion response as needed for evaluation within the CADET model. The application has also been developed to better estimate roll damping coefficients (needed by CADET) and support scaling by displacement as well as (as opposed to only) dimensional scaling. Output of the flexibility program provides a format directly usable or readily importable by the current version of the CADET program and in limited capacity, other existing applications.

Among the enhancements currently under development for CADET is the capability to (in limited form) evaluate vessel motion in the horizontal plane based on influence of hydraulic currents and waves in addition to wind and turning motion-induced list. Compatible with these efforts, for each added vessel library profile the contractor will assemble or develop specifications or characteristics also necessary for evaluation of vessel movement and control in the horizontal plane including (but not necessarily limited to):

· Rudder surface area (measured in square metres) and dimensions, and capability of angle (measured in in degrees)

· Wind sail (360-degree angle of approach) area above the waterline respective to the elevation of moulded depth and elevation of surface area above the elevation of moulded depth (and relevant specifications for variability with variability for immersed draft and loading with particular interest for fully cellular containerships, some RO\RO carriers, vehicles carriers, and some gaseous tankers characteristics for which often present notable or significant windsail profiles and related properties).

Wind sail area above the waterline shall be measured both longitudinally and cross-sectionally in square metres. Longitudinally, wind sail area shall be divided into stations commensurate with station spacing available or as applied in SCORES or its enhanced version (20 stations defined by 21 demarcations or 40 stations defined by 41 demarcations) wind sail area. Wind sail shall include specifications for funnel height (whether or not the highest fixed point for a given profile) and highest fixed height and the full extent of reference measurements for (fixed) height and air draft and funnel height relative to air draft.

Ballast, Powering, Bunkerage Consumption, and Emissions Handling Modeling – Further Detail Ballast, powering, and emissions handling modeling efforts and resulting formulas or quantitative relationships developed based on the hull lines library as completed to-date and via contractual services defined herein will be recompiled or adjusted as applicable and based on additional hulls or hull profiles to be added. This requirement pertains to ocean-going cargo, passenger, and offshore or tug vessel relationships in addition to other or new or variant deep-draft hull configurations undertaken as a part of the PWS as specified or set forth herein. In addition, powering, emissions handling, and information needed for wake relationships comparable in nature and level of detail as developed for currently existing hulls of the lines library will also be required for any (optional) additional hulls developed under specifications of the PWS herein.

With respect to powering and bunkerage consumption, the contractor will compile respective data and develop numerical relationships for bunkerage consumption respective to load condition (i.e., or immersed draft) and speed in comparable form, detail and manner as assembled for the existing hull profiles of the lines library. Associated efforts shall be based on applicable parameters for prime mover and auxiliary engine specifications for propulsive, auxiliary and total power rating, typical operations at sea and when in port as applicable, and such relationships will be compiled respective to typically employed and foreseeable fuels. Based on subject relationships, the contractor will also develop emissions profiles for the same constituents (CO, CO2, SO2, etc.) as primarily evaluated in the existing emissions handling model and hull lines library. Additional specifications include ejection or exhaust volume and velocities at the funnel (with estimation of respective typical cross-sectional areas of the vessel exhaust plume) for each profile with variability of engine load and conditions for operations and associated fuel consumed. Resulting parameters in turn can be applied to evaluation of concentration and dispersion patterning for engine emissions handling and requirements for scrubber or catalytic converter maintenance costs (including reagent or catalyst material replenishment, etc.).

As an additional requirement related to the powering and emissions handling models, the contractor will be required to verify and further update and develop or refine mathematically valid cross-class relationships to enable ready application of bunkerage consumption and emissions relationships to any size or class of hull respective to vessel type (bulk carrier, tanker, etc.) and associated operating condition(s). This is essential to more accurately allow estimation of such relationships via method(s) most appropriate across size classes of hull with statistical best fit (which may require development of multiple separate functions or predictive equations across the DWT or size range of a given vessel type). Such cross-class relationships shall comprehensively be based on or derived from conditions of vessel type, size, speed, immersed draft and other significant conditions and physical specifications for all previous base profiles of the lines library in addition to or with integration of the hull profiles to be added per the PWS as defined herein.

Compatibility with Enhancement of Vessel Wake Application – Further Detail The evaluation of vessel wake (particularly in protected waters) is often a concern for waterway project analyses. This is especially so when there exists circumstances supporting a change or migration in commercial fleet service regime toward larger vessels, changes and differences in operating conditions or procedures (such as increased speed, increased immersed draft, etc.) or changes in waterway specifications which have the potential to significantly influence the parameters of wake, hydraulic resistance, and potential related impacts. Ideally precise evaluation of vessel wake can require significant effort, time, and expense, especially when potential impacts are uncertain and notably variable. However, there are methods and research that has been completed which has allowed development of abbreviated formulas and applications to initially assess or screen whether potential wake conditions are or are not likely to be a notable or significant issue (depending on circumstance) or whether the change in conditions for vessel wake warrants more detailed evaluations with comprehensive capabilities for numerical or more compute-intensive quantitative modeling (involving computational fluid dynamics, etc.).

Accordingly, USACE-IWR has undertaken efforts via professional services to develop a first-generation abbreviated vessel wake screening tool linked to general physical parameters for vessel hull types, physical size, and general hull form parameters. As a basis for reference these hull form parameters were modeled on the hull lines library developed to-date for application to CADET and the current powering and emissions models and ballast templates. Objectives were to develop a wake screening tool to perform general preliminary assessment of potentially significant wake parameters (height, speed, distance before dissipation, angle of dispersal, evaluation of wave break, and energy, etc.). Technical review and limited use of the wake tool developed to-date reveals that it has proven applicable to a variety of rapid-response inquiries and investigations regarding both its original purpose (evaluating only basic impacts for wave generation and adjustment of vessel speeds for waterway traffic capacity analysis) in addition to more detailed within-harbor shoreline impacts and enhanced calibration of vessel size and speeds for vessel traffic respective to general waterway system traffic capacity modeling.

In addition to integration of new hulls into the library for the wake program, the contractor will be required to coordinate review of the program as resources permit with the technical representative for IWR at its present level of development and outline or identify the need for any minor improvements or minor corrections needed (display of additional statistics, format errors or refinement of viewing or display presentation, etc.).

Ballast Model Template(s) With the compilation of all vessel profiles developed to-date, as an integral and technical supporting requirement the contractor has developed ballast model templates to allow limited or basic evaluation of ballast requirements for each profile based on typical accommodations and disposition of cargo, associated weight distribution and stowage characteristics, and capabilities for ballast typically characteristic according to vessel type and size class. As with past profile compilation or development, the contractor will be required to develop ballast model templates for any new hulls by vessel type as appropriate (for deep-draft cargo, passenger, and Offshore Support hulls) comparable in specification(s) to such templates already compiled for existing profiles of the lines library.

Travel & Reimbursable Expenses Travel - It is requested that the contractor formulate and include for proposal any estimates for travel resources (time and costs) as deemed prudent or necessary to acceptably and competently execute requirements, specifications, and needs for competent fulfillment of the PWS as set forth herein. Where necessary and valid, the contractor will be granted allowances for reimbursement for reasonable expenses to support travel to conduct in-person or on-site technical meetings with representatives of IWR. Travel reimbursement will be generally limited to or in accordance with allowances for the current Federal Joint Travel Regulation (JTR) and guidelines of the Office of Personnel Management (OPM) for travel expenses addressing transportation and per diem or daily expenses. Exception may be permissible where marginal or increased costs can be determined to be fair and reasonable given circumstance (i.e., such as ineligibility of contractor staff for Federal lodging rates and seasonal or other market issues impacting lodging rates or airfares, etc.). Under circumstances where travel cannot be conducted within standard or typical Federal travel allowances the contractor will be responsible for conducting travel where needed with efforts to limit costs to what is considered fair and reasonable and not excessive given circumstance in an effort to minimize costs to the Government. Should the contractor determine there will exist valid need for marginal reimbursable expenses such as the acquisition of data or information in the absence of provision of such data by the Government, the contractor will formulate a fair and reasonable estimate of time and costs as a separable reimbursable element for inclusion in the overall proposal.

General\Additional Terms & Conditions of Sale or Acquisition Respective to the Performance Work Statement (PWS) & Technical Scoping, Specifications & Requirements as Described

Capacity or compliance with needs for (vendor or contractor) audit or verification with contract terms and conditions of sale or acquisition - Periodically it is understood that the vendor or contractor of products or services may need to conduct review or audit for verification of compliance with contract conditions, most notably in regard to assignment of user access and application or use of a given product. Such efforts shall not entail rights of physical access or visitation to premises or facilities owned, controlled or occupied by USACE and its personnel. Due to requirements for systems security and integrity, the vendor shall not have or be granted in any manner physical or electronic access to data storage systems or electronic platforms employed for access or application and use of subject vendor products, data and information. The contractor however may employ what generally constitutes passive measures such as recording and evaluating IP addresses and product password and identification names, codes or tags directly assigned to and employed by USACE personnel accessing or using its products, computerized applications, and information. This does not include the right to track or use any such information in any other way or for any other purpose than to verify use at the point of, or via the physical or electronic means of access for the vendor’s products and supporting systems where or as applicable. No other method or mechanism is implied or is allowed outside that described and as may be required for the Government without written permission by the Government or explicit mutual agreement that may be otherwise included in the Terms and conditions of sale.

Indemnification - The Government cannot enter into any terms and conditions of sale with agreement for indemnification, including acceptance of terms for financial liability or otherwise in any form or context in association with access, handling, and use of a given vendor’s products, associated data or information, or any derivative product or output thereof. This position also extends to any secondary or third part agreements the prime vendor may have for constituent or sub-contractual relations whether for the provision of any application, data, information, technical labor or staff support, or any other professional services furnished or offered to Government under the contract and PWS as set forth herein.

Ownership and Retention of Data, Information, Algorithms or any Product(s) uniquely created by or for Government at Government expense - Data and information downloaded or obtained via the vendor’s systems or products shall become property of the Government for retention and use as long as the data and information is deemed of value or purpose to the Government for studies, evaluations and analyses conducted by the Government or purchaser (IWR and its designated constituent organizations IWR-WRC and WCSC and the entities they in turn support as so described in the PWS herein). The Government will, as long as subject data and information is held or retained, continue to treat subject data and information as a commercially acquired product in appropriate and fair contexts of protection(s) from non-disclosure to the public in addition to limitations on distribution, sharing, or otherwise common, joint or collaborative provision and use other than as described by the respective PWS requirements as described or set forth herein. Data, information, algorithms, formulae, methodologies or any products acquired by the Government under the terms and conditions of this contract which are considered and reasonably verifiable to be common knowledge, readily available within the public realm of data, information and knowledge, or as may be developed by the Government shall not necessarily be subject to restrictions, treatment, or protections reasonably afforded commercially acquired data, information, and products acknowledged as or acceptably considered proprietary in nature or which have exclusivity for valid sale or resale value for the subject vendor in the marketplace. Subject protections for what may in some contexts be typically considered common knowledge for data or information may be applicable where such data and information is being provided with reasonable identification by the vendor as a commercially recognized source with professional reputation of verification for quality or accuracy and completeness of the data and information of concern. In similar contexts, some formulae, analytical relationships models, data and information assembled or developed by the Government may be considered sensitive and entitled to specific protections from release or disclosure outside of IWR and the Government when based on critically developed data and information deemed or determined to be sensitive or proprietary in nature.

Non-Personal Services - The contractor shall provide strictly non-personal services as contractor employees are not subject to direct supervision and control by the Government. The contractor’s technical staff and personnel in regard to use and application of the vendor’s products may advise and support the Government but shall not make determinations, decisions or certifications on behalf of the Government considered to be in the realm of Government functions or analyses for, under, or in association with this contract nor perform any functions or services deemed inherently Governmental. The contractor and its employees shall not represent the government nor appear to represent the government in performance of assigned contract services. Contractor personnel shall clearly identify themselves as contractor or vendor employees (or otherwise if applicable) in all interactions with the public and otherwise during contract performance.

Data & Information Privacy & Protections - Where applicable any data or information furnished by the government for this performance work statement (PWS) are not to be further disclosed or distributed except where expressly permitted in compiled and aggregated form and shall not be used for any work or…
